Provide the year-wise breakup of principal amount and interest Accounts are with auditor as of now and<br \/>\n     for the list of defaulters&#8230;&#8230;..                                 as such information is not available at<br \/>\n                                                                    this stage.\n<\/p>\n<p id=\"p_25\">Grounds for the First Appeal:\n<\/p>\n<p id=\"p_26\">Not Enclosed<\/p>\n<p>Order of the First Appellate Authority (FAA):\n<\/p>\n<p id=\"p_27\">The FAA reiterated the PIO&#8217;s statement and disposed off the appeal accordingly.\n<\/p>\n<p id=\"p_28\">Grounds for the Second Appeal:\n<\/p>\n<p id=\"p_29\">Unsatisfactory information provided by the PIO and unfair disposal of the matter by the FAA.\n<\/p>\n<p id=\"p_30\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_31\">The following were present<br \/>\nAppellant: Mr. Rajesh Sharma representing Ms. Geeti Sharma;<br \/>\nRespondent: Mr. R. K. Mudgal, Assistant on behalf of Mr. Ashok Kumar, PIO &amp; AR(CND); Deemed PIO<br \/>\nMr. K. S. Meena the then Administrator;\n<\/p>\n<p id=\"p_32\">       The information on certain queries have not been provided by the PIO on the grounds that this<br \/>\ninformation is not available on the records of the Society. The appellant however brought before the<br \/>\nCommission a letter on 08 August 2009 addressed to Registrar in which it has been stated:\n<\/p>\n<p id=\"p_33\">&#8220;No.-1: All the affairs of society were managed by a self styled and extra constructional body named as<br \/>\n       Dharamvihar RWA and thus intervene in the shoe of the Managing Committee.<br \/>\nNo.2: The RWA was formed in April 2002 by some original members as well as power of attorney<br \/>\n       holders of the society in connivance to the self styled president of the defunct Managing<br \/>\n       Committee.&#8221;\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                                                                  Page 3 of 4<\/span><\/p>\n<p id=\"p_34\"> The deemed PIO Mr. Meena also states that with respect to query -9 no such information is available on<br \/>\nthe records of the society. Mr. Meena has stated that his letter of 08 August 2009 addressed to the<br \/>\nRegistrar was based on various records of the RWA which was produced before him as well as verbal<br \/>\ncommunications by different members, but these were not the part of the record of the society and hence<br \/>\nhe was not able to provide the records. With respect to query-12 &amp; 13 the PIO has already stated that there<br \/>\nis no record of the minutes of such a meeting. With respect to query-14 the respondent from RCS Mr. R.<br \/>\nK. Mudgal has stated that no actions have been taken against the RWA. Regarding query-18<\/p>\n<p>Decision:\n<\/p>\n<p id=\"p_35\">The Appeal is disposed.\n<\/p>\n<p id=\"p_36\">       The Commission recommends to the RCS to conduct an inquiry into the matters<br \/>\nreferred to by the then Administrator in his letter of 08 August 2009.\n<\/p>\n<p id=\"p_37\">This decision is announced in open chamber.\n<\/p>\n<p id=\"p_38\">Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per <a href=\"\/doc\/383252\/\" id=\"a_1\">Section 7(6)<\/a> of RTI Act.\n<\/p>\n<p id=\"p_39\">                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                     03 September 2010<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
