DATTU, J:\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">         Leave granted.\n<\/p>\n<p id=\"p_3\">2)   Challenging the judgment and order passed by the High Court in<\/p>\n<p>     W.P.S.T. No. 1010 of 2003 dated 13.6.2005, the Secretary, Forest<\/p>\n<p>     Department and others, have filed this appeal.<\/p>\n<p id=\"p_4\">3)   The facts in nutshell are, the respondent while he was working in wild<\/p>\n<p>     life Division &#8211; II at Jalpaiguri was served with a memo dated<\/p>\n<p>     10.3.1987, inter alia directing him to show cause, why disciplinary<\/p>\n<p>     action should not be taken against him by the Divisional Forest<\/p>\n<p>     Officer for gross financial irregularities in respect of measurement<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                       1<\/span><br \/>\ntaken and payment made thereof for some of the works undertaken by<\/p>\n<p>him as Care Taker, Tourist Lodge, Jaldapara, as detected during the<\/p>\n<p>course of checking by the Divisional Forest Officers, Wild Life<\/p>\n<p>Division &#8211; II. Since the explanation offered by the respondent was<\/p>\n<p>not satisfactory, he was kept under suspension, pending departmental<\/p>\n<p>enquiry proceedings by the Divisional Forest Officer, Cooch Bihar<\/p>\n<p>Division vide his order dated 13.8.1987. Thereafter, a charge memo<\/p>\n<p>dated 13.8.1987 was served on the respondent by the disciplinary<\/p>\n<p>authority.    The Articles of charges against respondent were two,<\/p>\n<p>namely :-\n<\/p>\n<p id=\"p_5\">   (i)      The respondent while functioning as Care Taker, Tourist<\/p>\n<p>            Lodge, Jaldapara under Cooch Bihar Division from October<\/p>\n<p>            1985 to January 1987, deliberately neglected his duty in<\/p>\n<p>            execution of works entrusted on him as care taker of the said<\/p>\n<p>            Tourist Lodge and made excess payments against inflated<\/p>\n<p>            measurements to the contractors for malafide personal gain,<\/p>\n<p>            causing financial loss to the government to the tune of<\/p>\n<p>            Rs.1,25,293.34 paisa.\n<\/p>\n<p id=\"p_6\">   (ii)     While functioning as care taker of the tourist lodge,<\/p>\n<p>            Jaldapara, the respondent intentionally falsified government<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                     2<\/span><br \/>\n           documents and tempered with the same with ulterior motive<\/p>\n<p>           of personal gain.\n<\/p>\n<p id=\"p_7\">4)   After initiation of departmental proceedings nothing seems to have<\/p>\n<p>     been done by the disciplinary authority.\n<\/p>\n<p id=\"p_8\">5)   The respondent retired from service on 31st day of March, 1995, on<\/p>\n<p>     attaining the age of superannuation.\n<\/p>\n<p id=\"p_9\">6)   As the authorities neither completed the departmental enquiry<\/p>\n<p>     proceedings, nor released the retirement benefits to the respondent,<\/p>\n<p>     he was constrained to file original application before the West<\/p>\n<p>     Bengal Administrative Tribunal in O.A. No. 5963 of 1999, inter<\/p>\n<p>     alia, requesting the tribunal to direct the respondents therein to<\/p>\n<p>     pass an order dropping the disciplinary proceedings, in view of<\/p>\n<p>     inordinate   delay     in   completing   the   disciplinary   enquiry<\/p>\n<p>     proceedings though it was initiated by issuing the charge memo<\/p>\n<p>     dated 13.8.1987; to revoke the order of suspension dated<\/p>\n<p>     13.8.1987; to direct the respondents to pass an order declaring that<\/p>\n<p>     the entire service period of the applicant from 13.8.1987 to<\/p>\n<p>     31.3.1995 as the period spent on duty and the applicant is entitled<\/p>\n<p>     to salaries and the other emoluments for the said period; and lastly<\/p>\n<p>     to pass an order computing the retiral benefits, including<\/p>\n<p>     pensionary benefits.\n<\/p>\n<p id=\"p_10\">\n<span class=\"hidden_text\" id=\"span_2\">                                                                      3<\/span>\n<\/p>\n<p id=\"p_11\">7)   The Administrative Tribunal vide its order dated 1st day of August,<\/p>\n<p>     2003, disposed of the original application by directing the<\/p>\n<p>     respondents\/petitioners to conclude the departmental enquiry<\/p>\n<p>     proceedings initiated against the applicant within a period of six<\/p>\n<p>     months in accordance with Rule 10(1) of West Bengal Service<\/p>\n<p>     (Death-cum-Retirement Benefits) Rules, 1971, with a further<\/p>\n<p>     direction to settle the entire subsistence allowance payable to the<\/p>\n<p>     applicant.\n<\/p>\n<p id=\"p_12\">8)   The applicant being aggrieved by the aforesaid order passed by the<\/p>\n<p>     Administrative Tribunal, had filed a Writ Petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article<\/p>\n<p>     227<\/a> of the Constitution of India, inter alia, requesting the court to<\/p>\n<p>     set aside the orders passed by the tribunal and to grant reliefs<\/p>\n<p>     sought for by the applicant in the original application.<\/p>\n<p id=\"p_13\">9)   The High Court has allowed the writ petition, inter alia, holding<\/p>\n<p>     that during the pendency of departmental enquiry proceedings, the<\/p>\n<p>     delinquent employee has retired from service on attaining the age<\/p>\n<p>     of superannuation and there is no provision\/Rule which would<\/p>\n<p>     permit the employer from continuing with the enquiry proceedings.<\/p>\n<p>     Secondly, Rule 10 of West Bengal Services (Death-cum-<\/p>\n<p>     Retirement) Benefits Rules, 1971, cannot be resorted to by the<\/p>\n<p>     employer, since the said rule has been declared as ultra-vires by the<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                                                      4<\/span><br \/>\n      courts and, lastly, that the charge sheet having been issued on 13th<\/p>\n<p>      August, 1987, the disciplinary authority had not proceeded with<\/p>\n<p>      the enquiry till the delinquent employee retired from service on<\/p>\n<p>      attaining the age of superannuation and, therefore, the employer<\/p>\n<p>      now cannot proceed with the domestic enquiry proceedings.<\/p>\n<p id=\"p_14\">10)   The State being aggrieved by the aforesaid order of the High<\/p>\n<p>      Court, has presented this Special Leave Petition.<\/p>\n<p id=\"p_15\">11)   The learned counsel Shri Tara Chandra Sharma would submit Rule<\/p>\n<p>      10(1) of West Bengal Services (Death-cum-Retirement Benefit)<\/p>\n<p>      Rules, 1971, would permit the employer to reduce or withhold<\/p>\n<p>      pension by initiating proceedings against a government servant<\/p>\n<p>      even after his retirement from service and the vires of the said rule<\/p>\n<p>      has been upheld by this court in the case of <a href=\"\/doc\/281850\/\" id=\"a_1\">State of West Bengal<\/p>\n<p>      vs. Haresh C. Banerjee and Others<\/a>, (2006) 7 SCC 651. It is further<\/p>\n<p>      contended that departmental proceedings though initiated in 1987,<\/p>\n<p>      the same could not be completed before the respondent retired<\/p>\n<p>      from service on attaining the age of superannuation in view of non-<\/p>\n<p>      cooperation of the respondent and, if any body has to be blamed, it<\/p>\n<p>      is the respondent and not the employer for the delay in completing<\/p>\n<p>      the proceedings.\n<\/p>\n<p id=\"p_16\">\n<p><span class=\"hidden_text\" id=\"span_4\">                                                                       5<\/span>\n<\/p>\n<p id=\"p_17\">12)   The learned counsel Shri D.N. Ray, appearing for the respondent<\/p>\n<p>      justifies the judgment of the High Court.\n<\/p>\n<p id=\"p_18\">13)   Two issues would arise for our consideration and consequent<\/p>\n<p>      decision. They are :-\n<\/p>\n<p id=\"p_19\">      (i)      Whether the employer could continue with the departmental<\/p>\n<p>               enquiry proceedings initiated prior to the retirement of<\/p>\n<p>               government servant by virtue of Rule 10(1) of the West<\/p>\n<p>               Bengal Services (Death-cum-Retirement Benefit) Rules,<\/p>\n<p>               1971?\n<\/p>\n<p id=\"p_20\">      (ii)     Whether the delay in completing the domestic enquiry<\/p>\n<p>               proceedings would be fatal to the proceedings?<\/p>\n<p id=\"p_21\">14)   To answer the first issue which we have framed for our<\/p>\n<p>      consideration, Rule 10(1) of the Rules, 1971, requires to be noticed<\/p>\n<p>      and, therefore, it is extracted :-\n<\/p>\n<p id=\"p_22\">         &#8220;10. Right of the Governor to withhold pension in<br \/>\n      certain cases.&#8211;(1) The Governor reserves to himself the<br \/>\n      right of withholding of withdrawing a pension or any part<br \/>\n      of it whether permanently or for a specified period, and<br \/>\n      the right of ordering the recovery from a pension of the<br \/>\n      whole or part of any pecuniary loss caused to the<br \/>\n      Government, if the pensioner is found in a departmental<br \/>\n      or judicial proceeding to have been guilty of grave<br \/>\n      misconduct or negligence, during the period of his<br \/>\n      service, including service rendered on re-employment<br \/>\n      after retirement:\n<\/p>\n<p id=\"p_23\">             Provided that&#8211;\n<\/p>\n<p id=\"p_24\">\n<p><span class=\"hidden_text\" id=\"span_5\">                                                                      6<\/span>\n<\/p>\n<p id=\"p_25\">   (a) such departmental proceeding if instituted while<br \/>\nthe officer was in service, whether before his retirement<br \/>\nor during his re-employment, shall after the final<br \/>\nretirement of the officer, be deemed to be a proceeding<br \/>\nunder this article and shall be continued and concluded<br \/>\nby the authority by which it was commenced in the same<br \/>\nmanner as if the officer had continued in service;\n<\/p>\n<p id=\"p_26\">     (b) such departmental proceedings, if not instituted<br \/>\nwhile the officer was in service, whether before his<br \/>\nretirement or during his re-employment&#8211;\n<\/p>\n<p id=\"p_27\">  (i) shall not be instituted save with the sanction of the<br \/>\nGovernor;\n<\/p>\n<p id=\"p_28\">   (ii) shall not be in respect of any event which took<br \/>\nplace more than four years before such institution; and\n<\/p>\n<p id=\"p_29\">    (iii) shall be conducted by such authority and in such<br \/>\nplace as the Governor may direct and in accordance with<br \/>\nthe procedure applicable to departmental proceedings in<br \/>\nwhich an order of dismissal from service could be made<br \/>\nin relation to the officer during his service;\n<\/p>\n<p id=\"p_30\">    (c) no such judicial proceeding, if not instituted while<br \/>\nthe officer was in service, whether before his retirement<br \/>\nor during his re-employment shall be instituted in respect<br \/>\nof a cause of action which arose on an event which took<br \/>\nplace more than four years before such institution; and\n<\/p>\n<p id=\"p_31\">   (d) the Public Service Commission, West Bengal, shall<br \/>\nbe consulted before final orders are passed.<br \/>\n   Explanation.&#8211;For the purpose of this article&#8211;\n<\/p>\n<p id=\"p_32\">     (a) a departmental proceeding shall be deemed to<br \/>\nhave been instituted on the date on which the statement<br \/>\nof charges is issued to the officer or pensioner, or if the<br \/>\nofficer has been placed under suspension from an earlier<br \/>\ndate, on such date; and\n<\/p>\n<p id=\"p_33\">  (b) a judicial proceeding shall be deemed to have<br \/>\nbeen instituted&#8211;\n<\/p>\n<p id=\"p_34\">   (i) in the case of criminal proceeding, on the date on<br \/>\nwhich the complaint or report of police officer, on which<br \/>\nthe Magistrate takes cognizance, is made, and\n<\/p>\n<p id=\"p_35\">  (ii) in the case of a civil proceeding, on the date on<br \/>\nwhich the plaint is presented or, as the case may be, an<br \/>\napplication is made to a civil court.&#8221;\n<\/p>\n<p id=\"p_36\">\n<p><span class=\"hidden_text\" id=\"span_6\">                                                               7<\/span>\n<\/p>\n<p id=\"p_37\">15)   Rule 10 of the rules speaks of the right of the Governor to withhold<\/p>\n<p>      pension in certain cases. Sub-Rule 10(1) says that the Governor<\/p>\n<p>      reserves himself the right of withholding or withdrawing pension<\/p>\n<p>      or any part of it whether permanently or for a specified period and<\/p>\n<p>      the right of ordering the recovery from pension or the whole or the<\/p>\n<p>      part of any pecuniary loss caused to the government, if the<\/p>\n<p>      pensioner is found in a departmental or judicial proceedings to<\/p>\n<p>      have been guilty of grave misconduct or negligence during the<\/p>\n<p>      period of service, including service rendered on re-employment<\/p>\n<p>      after retirement.    Proviso appended to the rules specifically<\/p>\n<p>      provides that the resort to sub-Rule (1) to Rule 10 can be made<\/p>\n<p>      only apart from others, that the departmental proceedings had been<\/p>\n<p>      instituted while the officer in service.   This rule came up for<\/p>\n<p>      interpretation before this court in Haresh C. Banerjee&#8217;s case<\/p>\n<p>      (supra) and this court after considering the object, purpose and<\/p>\n<p>      purport of the rule has stated :\n<\/p>\n<p id=\"p_38\">\n<p id=\"p_39\">          &#8220;7. Various State rules or regulations vest power of<br \/>\n       withholding or reduction of pension on compliance with<br \/>\n       the principles of natural justice. The question of an<br \/>\n       order withholding or reducing pension being invalid and<br \/>\n       bad in law on a legally permissible ground is one thing<br \/>\n       but to hold the rule ultra vires is another. <a href=\"\/doc\/592033\/\" id=\"a_2\">In State of<br \/>\n       U.P. v. Brahm Datt Sharma2<\/a> this Court observed that if<br \/>\n       the Government incurs pecuniary loss on account of<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                                                      8<\/span><br \/>\n       misconduct or negligence of a government servant and<br \/>\n       if he retires from service before any departmental<br \/>\n       proceedings are taken against him, it is open to the<br \/>\n       State Government to initiate departmental proceedings,<br \/>\n       and if in those proceedings, he is found guilty of<br \/>\n       misconduct, negligence or any other such act or<br \/>\n       omission as a result of which the Government is put to<br \/>\n       pecuniary loss, the State Government is entitled to<br \/>\n       withhold, reduce or recover the loss suffered by it by<br \/>\n       forfeiture or reduction of pension. <a href=\"\/doc\/315432\/\" id=\"a_3\">In State of Punjab v.<br \/>\n       K.R. Erry3<\/a> it was held that the State Government could<br \/>\n       not direct cut in pension of officers without giving a<br \/>\n       reasonable opportunity of hearing. <a href=\"\/doc\/1867924\/\" id=\"a_4\">In State of<br \/>\n       Maharashtra v. M.H. Mazumdar4<\/a> it was observed that<br \/>\n       the State Government&#8217;s power to reduce or withhold<br \/>\n       pension by taking proceedings against a government<br \/>\n       servant, even after his retirement is expressly<br \/>\n       preserved by the Rules.\n<\/p>\n<p id=\"p_40\">           8. Rule 10(1) is the authority of law under which the<br \/>\n       pension could be withheld on compliance with<br \/>\n       stipulations of the rule. We are unable to appreciate<br \/>\n       how such a rule could be held ultra vires even at a point<br \/>\n       of time when pension was a property to which <a href=\"\/doc\/258019\/\" id=\"a_5\">Article<br \/>\n       19(1)(f)<\/a> was applicable.&#8221;\n<\/p>\n<p id=\"p_41\">\n<p id=\"p_42\">16)   In the present case, while the delinquent employee was in service,<\/p>\n<p>      the departmental enquiry proceedings had been instituted by the<\/p>\n<p>      employer by issuing the charge memo and the proceedings could<\/p>\n<p>      not be completed before the government servant retired from<\/p>\n<p>      service on attaining the age of superannuation and in view of Rule<\/p>\n<p>      10(1) of the Rules, 1971, the employer can proceed with the<\/p>\n<p>      departmental enquiry proceedings though the government servant<\/p>\n<p>      has retired from service        for imposing only punishment<\/p>\n<p>      contemplated under the Rules.\n<\/p>\n<p id=\"p_43\">\n<p><span class=\"hidden_text\" id=\"span_8\">                                                                    9<\/span>\n<\/p>\n<p id=\"p_44\">17)   The next issue is with regard to delay in concluding disciplinary<\/p>\n<p>      proceedings. In our view that the delay in concluding the domestic<\/p>\n<p>      enquiry proceedings is not fatal to the proceedings. It depends on<\/p>\n<p>      the facts and circumstances of each case.         The un-explained<\/p>\n<p>      protracted delay on the part of the employer may be one of the<\/p>\n<p>      circumstance in not permitting the employer to continue with the<\/p>\n<p>      disciplinary enquiry proceedings. At the same time, if the delay is<\/p>\n<p>      explained satisfactorily then the proceedings should be permitted<\/p>\n<p>      to continue.   This court in the case of <a href=\"\/doc\/643844\/\" id=\"a_6\">Deputy Registrar, Co-<\/p>\n<p>      operative Societies vs. Sachindra Nath Pandey<\/a>, (1995) 3 SCC 134,<\/p>\n<p>      has explained the various circumstances when the departmental<\/p>\n<p>      proceedings can be directed to be closed, it is worthwhile to refer<\/p>\n<p>      to the observation made by this court in this regard :-<\/p>\n<p id=\"p_45\">          &#8220;5. The learned counsel for the appellant submits that<br \/>\n      in this case the first respondent adopted a course of total<br \/>\n      non-cooperation and procrastination and that in spite of<br \/>\n      repeated opportunities being given he did not respond or<br \/>\n      participate in the inquiry. The first respondent did not<br \/>\n      even care to file an explanation or reply to the memo of<br \/>\n      charges. In the circumstances, the authorities had no<br \/>\n      option but to hold that the charges are proved. Even<br \/>\n      after the report of the Inquiry Officer was submitted, a<br \/>\n      number of opportunities were given which he again failed<br \/>\n      to avail of. It is submitted that though the whole history<br \/>\n      of the case has been set out in the counter-affidavit filed<br \/>\n      in the High Court, the learned Judge did not notice any of<br \/>\n      those facts and yet allowed the writ petition on an<br \/>\n      untenable ground. It is further contended that according<br \/>\n      to Regulation 68 of the Cooperative Federal Authority<br \/>\n      (Business) Regulations, 1976, it was not obligatory upon<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                                                     10<\/span><br \/>\n      the Inquiry Officer to record the evidence of the<br \/>\n      witnesses where the first respondent did neither submit a<br \/>\n      reply nor an explanation to the memo of charges. Though<br \/>\n      he was apprised of the inquiry, he did not care to attend<br \/>\n      in spite of repeated opportunities. In such a situation, he<br \/>\n      cannot complain of not recording the evidence of<br \/>\n      witnesses and other evidence.&#8221;\n<\/p>\n<p id=\"p_46\">18)   In the present case the Administrative Tribunal after going through<\/p>\n<p>      the entire record from the date of initiation of the departmental<\/p>\n<p>      proceedings till the government employee retired from service on<\/p>\n<p>      attaining the age of superannuation, has observed that since the<\/p>\n<p>      government employee had left the head quarters without<\/p>\n<p>      permission of the competent authority, so the proceedings could<\/p>\n<p>      not be completed. This finding on facts need not be disturbed by<\/p>\n<p>      us, since the said finding cannot be said a perverse finding.<\/p>\n<p id=\"p_47\">19)   In view of the above discussion, the appeal is allowed and the<\/p>\n<p>      judgment and the order passed by the High Court is set aside. The<\/p>\n<p>      disciplinary authority is directed to complete the domestic enquiry<\/p>\n<p>      proceedings from the stage it was interdicted by the High Court<\/p>\n<p>      and complete the same as expeditiously as possible and at any rate<\/p>\n<p>      within three months from the date of receipt of this court&#8217;s order.<\/p>\n<p>      The respondent herein is directed to participate in the enquiry<\/p>\n<p>      without unnecessarily seeking adjournment in the enquiry<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                                      11<\/span><br \/>\n     proceedings. In the facts and circumstances of the case, parties<\/p>\n<p>     are directed to bear their own costs.
