SRINIVASAN\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t      J U D G M E N T<br \/>\nSrinivasan,J.\n<\/p>\n<p id=\"p_1\">     The appellant  is challenging  the concurrent judgments<br \/>\nof the\tcourts below whereby he was convicted for an offence<br \/>\nunder  <a href=\"\/doc\/1985227\/\" id=\"a_1\">Section\t 102<\/a>  I.P.C.   and   sentenced\t to   suffer<br \/>\nimprisonment for life. he was also directed to pay a fine of<br \/>\nRs. 5000\/-.\n<\/p>\n<p id=\"p_2\">2.   On the  night of  29.6.85 the appellant poured kerosene<br \/>\noil over  the head  of\this  wife  from\t behind\t and  lit  a<br \/>\nmatchstick and\tset her\t on fire.  She was  admitted in\t the<br \/>\nhospital around\t 1.00 AM on 30.6.85. Her statement regarding<br \/>\ncause of  her death  was recorded  on 1.7.85  by PW  18, sub<br \/>\ninspector of  police marked  as\t Ex.  6.  Another  statement<br \/>\nmarked\tas  Ex.5  was  recorded\t on  11.7.85  by  PW  12,  a<br \/>\nmagistrate, who was sent to the hospital under orders of the<br \/>\nHigh Court.  In both  the statements she had stated that her<br \/>\nhusband came  home in  a drunk condition in the mid night of<br \/>\n29.6.85 and  assaulted her  severely. She  was driven out of<br \/>\nthe room  but as  her two  children were sleeping inside she<br \/>\nwent back  to the  room. Then  he poured  kerosene oil\tfrom<br \/>\nbehind and  set fire.  Her parents  were sent  for  and\t her<br \/>\nfather took her to the hospital. Thus in both the statements<br \/>\nshe had\t accused her husband of having set fire to her after<br \/>\npouring kerosene.  The courts  below  relied  upon  the\t two<br \/>\nstatements and also the evidence of the post mortem examiner<br \/>\nto the\teffect that  the burn  injuries were  such that they<br \/>\nlead to\t the conclusion\t that the  death was  homocidal. The<br \/>\ncourts below  have also referred to all the circumstances of<br \/>\nthe case  and rejected\tthe defence  that the  wife  of\t the<br \/>\nappellants committed  suicide or  that the offence should if<br \/>\nat all be considered to the one under <a href=\"\/doc\/92983\/\" id=\"a_1\">Section 306<\/a> I.P.C. and<br \/>\nnot 302 <a href=\"\/doc\/1569253\/\" id=\"a_2\">I.P.C<\/a>.\n<\/p>\n<p id=\"p_3\">3.   Learned counsel  for the  appellants places reliance on<br \/>\nthe following circumstances:-\n<\/p>\n<p id=\"p_4\">(i)  The case history noted in Ex. A by PW 9, a senior House<br \/>\nsurgeon as soon as the deceased was admitted in the hospital<br \/>\nstates that the deceased tried to burn herself after pouring<br \/>\nkerosene on her person in a suicidal attempt.\n<\/p>\n<p id=\"p_5\">(ii) The father\t of the\t deceased (PW  1) wrote\t a letter on<br \/>\n30.6.85 to  the police\twhich  has  been  treated  as  First<br \/>\nInformation Report  in\twhich  it  is  stated  that  he\t was<br \/>\nconvinced  that\t his  son-in-low  abetted  his\tdaughter  in<br \/>\ncommitting suicide.\n<\/p>\n<p id=\"p_6\">(iii) PW  7  has  stated  that\tthe  deceased  was  speaking<br \/>\nnormally soon after the incident and she claimed to have set<br \/>\nfire on herself.\n<\/p>\n<p id=\"p_7\">(iv) The two  statements recorded  by the  Sub Inspector  of<br \/>\npolice\tand   the  Magistrate\tmarked\tas   Exb.  6  and  5<br \/>\nrespectively cannot  be considered as dying  declaration and<br \/>\ngiven any  weight as  the deceased lived for twenty days and<br \/>\nmore till 31.7.85.\n<\/p>\n<p id=\"p_8\">(v)  The Judicial  Magistrate who  recorded the statement in<br \/>\nEx. 5 did not ascertain the mental condition of the deceased<br \/>\nand therefore  her statement  is not reliable in view of the<br \/>\nruling in  Kanchy Komuramma  Versus State  of Andhra Pradesh<br \/>\n1995 Supp. (4) S.C.C.118.\n<\/p>\n<p id=\"p_9\">(vi) In the  first instance  the case  was registered  under<br \/>\n<a href=\"\/doc\/92983\/\" id=\"a_3\">Section 306<\/a>. When the charge was framed it was under <a href=\"\/doc\/1560742\/\" id=\"a_4\">Section<br \/>\n302<\/a> I.P.C.  After examination  of 9 witnesses, the Presiding<br \/>\nOfficer of  the Court  framed an  alternative  charge  under<br \/>\n<a href=\"\/doc\/92983\/\" id=\"a_5\">Section 306<\/a>  I.P.C. The accused moved the High Court against<br \/>\nthe order  framing an  alternative charge  in a revision but<br \/>\nthe same  was dismissed.  Thus\tthe  prosecution  was  in  a<br \/>\nconfusion as  to whether  the  appellant  was  guilty  under<br \/>\n<a href=\"\/doc\/1560742\/\" id=\"a_6\">Section 302<\/a> I.P.C. or under 306 I.P.c.\n<\/p>\n<p id=\"p_10\">4.   All the aforesaid circumstances have been considered in<br \/>\ndetail by  both the  courts and it has been found that there<br \/>\nis no  substance in  the  contentions  put  forward  by\t the<br \/>\ndefence. A  perusal of the record shows that the death could<br \/>\nnot have  been suicidal and it was nothing but homicidal. PW<br \/>\n10 the post mortem examiner has stated as follows:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;Death in\tmy opinion  was\t due  to<br \/>\n     effect of ante-portem burns. Taking<br \/>\n     into consideration\t the  sites  and<br \/>\n     extent  of\t areas\tinvolved  in  my<br \/>\n     opinion the  burn was  homicidal in<br \/>\n     nature.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     Burn injury  causing death\t may  be<br \/>\n     accidental, suicidal  or homicidal.<br \/>\n     I found  the injuries  causing  the<br \/>\n     death to be homicidal. The sites as<br \/>\n     described on  examination\tof  dead<br \/>\n     body were\tmostly\ton  inaccessible<br \/>\n     parts of the victim, the areas were<br \/>\n     very   extensive.\tSo  I  hold  the<br \/>\n     opinion  that   the  death\t was  in<br \/>\n     homicidal in nature.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     Injury Nos.1,3,4,5,6,7 as mentioned<br \/>\n     by me  were on  the back  side part<br \/>\n     inaccessible part\ton the\tbody  of<br \/>\n     the subject.  These  injuries  were<br \/>\n     very  extensive   too.  From  these<br \/>\n     injuries I\t hold  the  opinion  the<br \/>\n     death  was\t  homicidal  in\t  nature<br \/>\n     caused by those injuries which were<br \/>\n     burn injuries. On the front side of<br \/>\n     the trunk\tof the\tbody I\tdid  not<br \/>\n     find any injuries. In regard to her<br \/>\n     face  I   did  not\t  find\tinjuries<br \/>\n     exactly on the front side.<br \/>\n     There is  no injury  observed by me<br \/>\n     that could\t lead me to hold that it<br \/>\n     was a suicidal death.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_11\">Nothing\t could\tbe  elicited  in  the  cross-examination  to<br \/>\ndiscredit  his\taforesaid  opinion.  Both  the\tcourts\thave<br \/>\naccepted his  evidence and  come to  the conclusion that the<br \/>\ncase falls  under <a href=\"\/doc\/1560742\/\" id=\"a_7\">Section  302<\/a> I.P.C.  We do  not  find\t any<br \/>\njustification to take a different view.\n<\/p>\n<p id=\"p_12\">5.   The courts below have also referred to the circumstance<br \/>\nthat the  accused who was admittedly present at the scene of<br \/>\noccurrence did\tnot make any attempt to put out the fire and<br \/>\nsave his  wife. His  case that\tthe  did  so  and  got\tburn<br \/>\ninjuries in  the process  has been  rightly  negatived.\t The<br \/>\nevidence on  record shows  that he has made a clumsy attempt<br \/>\nto inflict  some injuries  on himself  in order\t to make the<br \/>\ncourt believe that the attempted to put out the fire.\n<\/p>\n<p id=\"p_13\">6.   The history  of the  case recorded\t in the\t hospital in<br \/>\nEx.A has not been proved to have been given by the deceased.<br \/>\nThe courts  below have\trightly refused\t to attach any value<br \/>\nthereto.\n<\/p>\n<p id=\"p_14\">7.   The father\t of the\t deceased did not have the necessary<br \/>\ninformation at\tthe time of FIR as his daughter was not in a<br \/>\nposition to speak when she was taken by him to the hospital.\n<\/p>\n<p id=\"p_15\">8.   The evidence  of PW  7 has\t also been considered in the<br \/>\nproper perspective  by the courts below. There is nothing on<br \/>\nrecord to  support the\tcontention of the appellant that the<br \/>\ndeceased was  tutored by  her  parents\tto  make  statements<br \/>\nagainst her  husband when  she gave  the dying declarations.<br \/>\nThe courts below are right in rejecting that case.\n<\/p>\n<p id=\"p_16\">9.   There is  no merit in the contention that the appellant<br \/>\ndied long  after making the dying declarations and therefore<br \/>\nthose statements have no value. The contention overlooks the<br \/>\nexpress provision  in <a href=\"\/doc\/1959734\/\" id=\"a_8\">Section  32<\/a> of  the Evidence  Act. The<br \/>\nsecond paragraph of sub-section (1) reads as follows:- &#8220;Such<br \/>\nstatements are relevant whether the person who made them was<br \/>\nor  was\t not,  at  the\ttime  when  they  were\tmade,  under<br \/>\nexpectation of death, and whatever  may be the nature of the<br \/>\nproceeding in  which the  cause\t of  his  death\t comes\tinto<br \/>\nquestion&#8221; No  doubt it\thas been  pointed out  that  when  a<br \/>\nperson is expecting his death to take place shortly he would<br \/>\nnot be\tindulging in  falsehood. But that does not mean that<br \/>\nsuch a\tstatement loses\t its value if the person lives for a<br \/>\nlonger time then expected. The question has to be considered<br \/>\nin each\t case on  the facts  and  circumstances\t established<br \/>\ntherein. If  there is  nothing on  record to  show that\t the<br \/>\nstatement could\t not have been true or if the other evidence<br \/>\non record   corroborates the contents of the statements, the<br \/>\ncourt can  certainly accept the same and act upon it. In the<br \/>\npresent case  both courts have discussed the entire evidence<br \/>\non record and found that two dying declarations contained in<br \/>\nExs 5 and 6 are acceptable.\n<\/p>\n<p id=\"p_17\">10.  The records  show that  the  mental  condition  of\t the<br \/>\ndeceased was  sufficiently good\t to give  a statement to the<br \/>\nMagistrate.\n<\/p>\n<p id=\"p_18\">11.  The mere  fact that  the case  was registered  intially<br \/>\nunder <a href=\"\/doc\/92983\/\" id=\"a_9\">Section  306<\/a> I.P.C.  and later  after examination of 9<br \/>\nwitnesses as  alternative charge  under the same Section was<br \/>\nframed will  not vitiate  the proceedings or the conclusions<br \/>\nof the\tcourts below.  There is\t not doubt  that the  charge<br \/>\nunder <a href=\"\/doc\/4266\/\" id=\"a_10\">Section 308<\/a> IPC has been proved beyond doubt.\n<\/p>\n<p id=\"p_19\">12.  We have  perused the  records.  We\t find  ourselves  in<br \/>\nagreement with\tthe judgments of the courts below.
