     Petitioner who is the 2nd accused in Crime No. 1523 of 2010<\/p>\n
of Central Police Station, Ernakulam for offences punishable<\/p>\n
under Sections 403, 405, 408, 415, 463, 471 and 477(A) r\/w<\/p>\n
Section 34<\/a> I.P.C., seeks anticipatory bail.<\/p>\n
     2.    The    learned    Public   Prosecutor    opposed     the<\/p>\n
application.\n<\/p>\n
     3.    After evaluating the factors and parameters which<\/p>\n
are to be taken into consideration in the light of paragraph 122<\/p>\n
of the verdict     dated   2-12-2010     of the Apex Court       in<\/p>\n
Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n
and Others<\/a> (2010 (4) KLT 930),             I am of the view that<\/p>\n
anticipatory bail cannot be granted in a case of this nature, since<\/p>\n
the investigating officer     has not had      the advantage of<\/p>\n
interrogating the petitioner.      But at the same time,      I am<\/p>\n
inclined to permit the petitioner to surrender before the<\/p>\n
Investigating Officer for the purpose of interrogation and then to<\/p>\n
B.A. No. 8746\/2010<\/p>\n
                                2<\/span><\/p>\n
have his application for bail allowed by the Magistrate or the<\/p>\n
Court    having jurisdiction.   Accordingly, the petitioner shall<\/p>\n
surrender before the investigating officer on 24.01.2011 or on<\/p>\n
25.01.2011 for the purpose of interrogation and recovery of<\/p>\n
incriminating material, if any. In case the investigating officer<\/p>\n
is of the view that having regard to the facts of the case arrest<\/p>\n
of the petitioner is imperative he shall record his reasons for<\/p>\n
the arrest in the case diary as insisted in paragraph 129       of<\/p>\n
Siddharam Satlingappa Mhetre’s case (supra).                 The<\/p>\n
petitioner shall thereafter be produced before the Magistrate or<\/p>\n
the Court concerned and permitted to file an application for<\/p>\n
regular bail.     In case the interrogation of the petitioner is<\/p>\n
without arresting him, the petitioner shall thereafter appear<\/p>\n
before the Magistrate or the Court concerned        and apply for<\/p>\n
regular bail. The Magistrate or the Court on being satisfied that<\/p>\n
the petitioner has been interrogated by the police shall, after<\/p>\n
hearing the prosecution as well, release the petitioner on bail.<\/p>\n
      4.  In case the accused     while surrendering before the<\/p>\n
Investigating Officer has deprived      the investigating officer<\/p>\n
sufficient time for interrogation, the officer shall complete the<\/p>\n

interrogation even if it is beyond the time limit fixed as above<\/p>\n
and submit a report to that effect         to the Magistrate or the<\/p>\n
Court concerned. Likewise, the Magistrate or the Court also<\/p>\n
will not be bound by the time limit fixed as above if sufficient<\/p>\n
time was not available after the production or appearance of<\/p>\n
the accused .\n<\/p>\n
      5.    The release of the       petitioner shall be on the<\/p>\n
petitioner executing a bond for `15,000\/- (Rupees             fifteen<\/p>\n
thousand only) with two solvent sureties each for the like amount<\/p>\n
to the satisfaction of the Court concerned and subject to the<\/p>\n
following conditions:-\n<\/p>\n
            1.    The   petitioner     shall  report   before  the<\/p>\n
            Investigating Officer between 9 a.m. and 11 a.m. on all<\/p>\n
            Wednesdays.\n<\/p><\/blockquote>\n
<\/blockquote>\n
            2.   The petitioner shall make himself   available for<\/p>\n
            interrogation including custodial interrogation as and<\/p>\n
            when required by the Investigating Officer.<\/p><\/blockquote>\n
\n
            3.    Petitioner shall not influence or intimidate the<\/p>\n
            prosecution witnesses nor shall he attempt to tamper<\/p>\n

            with the evidence for the prosecution.\n<\/p>\n
\n
            4.    Petitioner shall not commit any offence while on<\/p>\n
            bail.\n<\/p>\n
\n
             5. If the petitioner commits breach of any of the above<\/p>\n
            conditions, the bail granted to him shall be liable to be<\/p>\n
            cancelled.\n<\/p>\n
      This petition is disposed of as above.\n<\/p>\n
