He submitted that the learned Special Judge has<br \/>\nnot given due weightage to the evidence of the complainant &#8211;<br \/>\nKarshabbhai Ghelabhai, PW-2, Exh.15.  The learned APP submitted that<br \/>\nthe learned Special Judge ought to have appreciated that assuming for<br \/>\nthe sake of argument that the presence of the fifth person &#8211;<br \/>\naccused was not established then also, the offence was committed and<br \/>\nthe learned Judge was duty-bound to convict the accused of the<br \/>\noffences, which stand proved, even if the graver offences under<br \/>\nSections 143, 147, 148 and 149 of the Indian Penal Code were not<br \/>\nproved.  The learned APP submitted that it is not the submission that<br \/>\noffences under Sections 143, 147, 148 and 149 of the Indian Penal<br \/>\nCode were not established, but assuming that the same were not<br \/>\nestablished under these Sections then atleast, in some other Sections<br \/>\noffenders were required to be punished.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the aforesaid submissions of the learned APP, the application<br \/>\nis required to be allowed.  It is according allowed.
