No.13729\/2007-H\n                 ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 5th day of November, 2009\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">    The main prayer in the writ petition is for a direction<\/p>\n<p>to the third respondent to report all the vacancies of<\/p>\n<p>H.S.A. (Natural Science) in Pathanamthitta District and<\/p>\n<p>also to extend the validity of the ranked list dated<\/p>\n<p>28\/04\/2004, for a further period of six months.<\/p>\n<p id=\"p_1\">    2.   By  interim  order   dated  24\/04\/2007, the  third<\/p>\n<p>respondent  was  directed  to   report  all  the  available<\/p>\n<p>vacancies of H.S.A. (Natural Science) forthwith so as to<\/p>\n<p>reach the Public Service Commission on or before 27\/04\/2007.<\/p>\n<p id=\"p_2\">    3.   The learned Standing Counsel for the Commission<\/p>\n<p>submitted that the ranked list expired on 26\/04\/2007.    The<\/p>\n<p>petitioner was included in the ranked list as rank No.1 in<\/p>\n<p>the supplementary list of LC and not advised for want of<\/p>\n<p>vacancies.  It is also submitted that the Deputy Director<\/p>\n<p>of Education reported seven vacancies for the above post<\/p>\n<p>and six candidates were advised from the ranked list.   The<\/p>\n<p>last advise was made on 30\/12\/2005.  It is also pointed out<\/p>\n<p>that no vacancies were reported in compliance with the<\/p>\n<p>interim order passed by this Court.        Even though one<\/p>\n<p>vacancy  was  reported   on   06\/01\/2007,  as  no  Dheevara<\/p>\n<p>community candidate was available to fill up the turn (MR I<\/p>\n<p>W.P.(C). No.13729\/2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -:2:-<\/span><\/p>\n<p>50 D TPO on 20\/09\/2003), the vacancy is kept unfilled to<\/p>\n<p>notify for selection, exclusively from Dheevara community<\/p>\n<p>and, there cannot be any direction to extend the validity<\/p>\n<p>of the ranked list as it had run for a full time of three<\/p>\n<p>years from 2004.\n<\/p>\n<p id=\"p_3\">     4.      Since no further vacancies were reported pursuant<\/p>\n<p>to the interim order of this Court and since the ranked was<\/p>\n<p>cancelled on 26\/04\/2007, as pointed out by the Standing<\/p>\n<p>Counsel for the P.S.C, no further orders are required to be<\/p>\n<p>passed in the writ petition.\n<\/p>\n<p id=\"p_4\">     The writ petition is dismissed.
