Salauddin\n                                            Versus\n                                    The State Of Bihar\n                                          -----------\n<\/pre>\n<p id=\"p_1\">3.   28.06.2011.             Heard the learned counsels for the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p id=\"p_1\">                             The petitioner being the husband is<\/p>\n<p>                   apprehending his arrest in complaint case in<\/p>\n<p>                   which     cognizance            has    been      taken         under<\/p>\n<p>                   <a href=\"\/doc\/538436\/\" id=\"a_1\">Section 498A<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">                             The marriage was performed 14 years<\/p>\n<p>                   prior to lodging of the complaint.<\/p>\n<p id=\"p_3\">                                It    is     submitted         by   the      learned<\/p>\n<p>                   counsel      for         the      petitioner         that       the<\/p>\n<p>                   complainant is third wife of the petitioner.<\/p>\n<p>                   It is submitted that paragraph no.4 of                           the<\/p>\n<p>                   statement         on     solemn       affirmation         of    the<\/p>\n<p>                   complainant reflects that she does not want<\/p>\n<p>                   to    stay    with       the     petitioner         as    she    is<\/p>\n<p>                   interested in divorce.\n<\/p>\n<p id=\"p_4\">                             The petitioner is ready to pay Rs.<\/p>\n<p>                   400\/-     per      month       to     the    complainant          by<\/p>\n<p>                   depositing the same in the bank account of<\/p>\n<p>                   the   complainant          by     second      week       of    every<\/p>\n<p>                   month     from         August,      2011.     The        aforesaid<\/p>\n<p>                   payment will be subject to any order being<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           2<\/span><\/p>\n<p>        passed     in     matrimonial             or     maintenance<\/p>\n<p>        proceedings.      The       petitioner         undertakes      to<\/p>\n<p>        serve a copy of the order to the complainant<\/p>\n<p>        within    two    weeks       from     today      when    it    is<\/p>\n<p>        expected from the complainant to supply her<\/p>\n<p>        bank account to the petitioner.<\/p>\n<p id=\"p_5\">                  Considering the aforesaid facts, let<\/p>\n<p>        the petitioner, above named, be released on<\/p>\n<p>        bail in the event of                arrest or        surrender<\/p>\n<p>        before    the    learned          court   below      within     a<\/p>\n<p>        period    of     twelve       weeks       from       today     in<\/p>\n<p>        connection with complaint case no. 382C of<\/p>\n<p>        2010 on furnishing bail bond of Rs.10,000\/-<\/p>\n<p>        (Ten Thousand) with two sureties of the like<\/p>\n<p>        amount    each    to        the    satisfaction         of    the<\/p>\n<p>        learned    J.M.       Ist     Class,      Danapur,       Patna,<\/p>\n<p>        subject to the conditions as laid down under<\/p>\n<p>        <a href=\"\/doc\/1692057\/\" id=\"a_1\">Section    438(2)<\/a>       of     the     Code     of    Criminal<\/p>\n<p>        Procedure.\n<\/p>\n<p id=\"p_6\">\n<pre id=\"pre_1\">U.
