No. 3864 OF 2008\n                -----------------------------------------------\n             Dated this the 24th day of October, 2008\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Sections 452, 324, 427 and 308 read<\/p>\n<p>with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> IPC. Altogether there are four accused persons.<\/p>\n<p>Final report has already been filed and cognizance was taken. As<\/p>\n<p>against accused 1 to 3 the case has been committed to the court<\/p>\n<p>of Sessions and the same is pending as SC No. 245\/08 before the<\/p>\n<p>Additional Sessions Judge(Adhoc) Fast Track-II, Manjeri.           As<\/p>\n<p>against the 4th accused, who was not available to be committed,<\/p>\n<p>his case is pending before the learned Judicial First Class<\/p>\n<p>Magistrate Court, Malappuram as CP No.32\/08.<\/p>\n<p id=\"p_1\">      2. The crux of the allegations against the accused persons-<\/p>\n<p>four in number-is that, they had trespassed into a hotel belonging<\/p>\n<p>to respondents 1 to 3 and on account of animosity arising from a<\/p>\n<p>prior incident they had attacked respondents 1 to 3 and had<\/p>\n<p>caused injuries to them.        It is urged that the act amounts to<\/p>\n<p>commission of     criminal offence and therefore the allegation is<\/p>\n<p>raised under <a href=\"\/doc\/4266\/\" id=\"a_1\">Section 308<\/a> IPC also. Respondents 1 to 3 have also<\/p>\n<p>Crl.M.C. No. 3864 OF 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -:2:-<\/span><\/p>\n<p>appeared before the court through counsel and counsel confirm<\/p>\n<p>that there has been harmonious settlement of the dispute between<\/p>\n<p>parties. Respondents 1 to 3 have, in these circumstances, settled<\/p>\n<p>all the disputes and compounded the offences allegedly committed<\/p>\n<p>by the petitioners. Respondents 1 to 3 confirm that they have<\/p>\n<p>settled all their outstanding disputes with all the petitioners.<\/p>\n<p id=\"p_2\">      3. Counsel for the rival contestants prays that settlement of<\/p>\n<p>the dispute and composition of the offences may be accepted and<\/p>\n<p>invoking the extraordinary inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_2\">Section 482<\/a><\/p>\n<p>Cr.P.C as enabled by the dictum in <a href=\"\/doc\/1442974\/\" id=\"a_3\">Madan Mohan Abbot V.<\/p>\n<p>State of Punjab<\/a> [2008 AIR SCW 2287] and <a href=\"\/doc\/393489\/\" id=\"a_4\">Nikhil Merchant v.<\/p>\n<p>C.B.I<\/a> [2008(3) KLT 769 (SC)], the prosecution against all the<\/p>\n<p>petitioners may be brought to premature termination.<\/p>\n<p id=\"p_3\">      4. Notice was given to the learned Prosecutor. The learned<\/p>\n<p>Prosecutor does not oppose the prayer.           It is evident that the<\/p>\n<p>dispute was one between the petitioners on the one hand and<\/p>\n<p>respondents 1 to 3 on the other about some previous incident<\/p>\n<p>relating to the business of the hotel. The dispute is one which is<\/p>\n<p>private and personal between parties and I am satisfied in these<\/p>\n<p>Crl.M.C. No. 3864 OF 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -:3:-<\/span><\/p>\n<p>circumstances that this is an eminently fit case where the dictum<\/p>\n<p>in Madan Mohan Abbot and Nikhil Merchant (supra) can safely<\/p>\n<p>be pressed into service. In the absence of opposition from the<\/p>\n<p>learned Prosecutor, it is not necessary to consider the matter in<\/p>\n<p>detail.\n<\/p>\n<p id=\"p_4\">      5. In the result:\n<\/p>\n<p id=\"p_5\">      a) This Crl.M.C in these circumstances is allowed.<\/p>\n<p id=\"p_6\">      b) SC No.245\/08 against the petitioners 1 to 3 pending<\/p>\n<p>      before the       Additional Sessions Judge(Adhoc) Fast<\/p>\n<p>      Track-II, Manjeri and CP No. 32\/08 pending before the<\/p>\n<p>      JFCM, Malappuram against the 4th petitioner are hereby<\/p>\n<p>      quashed.\n<\/p>\n<p id=\"p_7\">      c) Needless to say, the proceedings, if any pending<\/p>\n<p>      against the petitioners and sureties shall be disposed of<\/p>\n<p>      by the respective court in accordance with law.<\/p>\n<p id=\"p_8\">      6.
