Heard learned counsel for the petitioner and<\/p>\n<p>                           learned counsel for the State.\n<\/p>\n<p id=\"p_5\">                                        2. The prayer made in this application under<\/p>\n<p>                           <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> of the Code of Criminal Procedure<\/p>\n<p>                           (hereinafter referred to as Cr. P.C) is to quash the order<\/p>\n<p>                           of learned Sub-divisional Judicial Magistrate, Raxaul,<\/p>\n<p>                           Motihari in Raxaul PS case no. 123\/96 whereby he<\/p>\n<p>                           declined to accept the final form submitted by the police<\/p>\n<p>                           and directed for further investigation under <a href=\"\/doc\/274924\/\" id=\"a_2\">section<\/p>\n<p>                           173(8)<\/a> of the Cr. P.C.\n<\/p>\n<p id=\"p_6\">                                       3. On behalf of the petitioner the only issue<\/p>\n<p>                           raised is that of jurisdiction. It has been submitted that<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>once the police completed investigation and submitted<\/p>\n<p>final form indicating that the occurrence was true but no<\/p>\n<p>clues could be found, the Magistrate had no option but to<\/p>\n<p>accept the final report of the police declaring the case<\/p>\n<p>closed. In support of this proposition learned counsel for<\/p>\n<p>the petitioner has placed reliance upon a judgement of<\/p>\n<p>the Supreme Court in the case of Reeta Nag Vrs. State of<\/p>\n<p>West Bengal &amp; Others reported in (2009) 9 SCC 129.<\/p>\n<p id=\"p_7\">           4. No doubt the wordings used in paragraph<\/p>\n<p>25 of that judgement prima facie go to support the<\/p>\n<p>aforesaid contention advanced on behalf of the petitioner<\/p>\n<p>but on a careful reading of the said judgement, it is found<\/p>\n<p>that the conclusion in paragraphs 25 and 26 are not<\/p>\n<p>abstract principles of law but conclusion derived in the<\/p>\n<p>peculiar facts of that case.\n<\/p>\n<p id=\"p_8\">           5. To appreciate the law laid down in that<\/p>\n<p>case, it is necessary to note the facts and submissions<\/p>\n<p>advanced on behalf of rival parties. In that case on the<\/p>\n<p>basis of charge sheet filed by the Investigating Officer,<\/p>\n<p>the Magistrate took cognizance of offences alleged<\/p>\n<p>against six of the original 16 accused persons and 10<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   3<\/span><\/p>\n<p>other accused persons were discharged on the prayer of<\/p>\n<p>Investigating Officer. Subsequently, on an application<\/p>\n<p>filed by &#8220;de facto&#8221; complainant learned Magistrate in<\/p>\n<p>effect sought to review his earlier order discharging 10<\/p>\n<p>accused persons and in that context the Calcutta High<\/p>\n<p>Court set aside the order of the Magistrate ordering for<\/p>\n<p>reinvestigation and such order of the Calcutta High Court<\/p>\n<p>was confirmed by the Supreme Court. The arguments<\/p>\n<p>advanced were primarily based upon provisions under<\/p>\n<p><a href=\"\/doc\/789330\/\" id=\"a_3\">section 362<\/a> of the Cr. P.C which clearly lays down that a<\/p>\n<p>criminal court after signing its judgement or final order<\/p>\n<p>disposing of a case cannot alter or review the same<\/p>\n<p>except to correct a clerical or arithmetical error. The<\/p>\n<p>court further considered that in the facts of that case<\/p>\n<p>appropriate remedial measure could be taken by the trial<\/p>\n<p>court in exercise of power under <a href=\"\/doc\/435819\/\" id=\"a_4\">section 319<\/a> of the<\/p>\n<p>Cr. P.C. but it was not open for the Magistrate to direct<\/p>\n<p>reinvestigation or further investigation in respect of 10<\/p>\n<p>accused persons whom he discharged by his judicial<\/p>\n<p>order.\n<\/p>\n<p id=\"p_9\">          6.   The principle of law noticed above has<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                    4<\/span><\/p>\n<p>been settled since long by a catena of judgements of the<\/p>\n<p>Supreme Court, some of which have been noted by the<\/p>\n<p>Apex Court in the case of Reeta Nag (Supra).<\/p>\n<p id=\"p_10\">          7.   The power of the Magistrate to direct<\/p>\n<p>further investigation under <a href=\"\/doc\/274924\/\" id=\"a_5\">section 173(8)<\/a> of the Cr. P.C<\/p>\n<p>was noticed in that judgement also in paragraph 9 while<\/p>\n<p>referring to the judgement of the Supreme Court in the<\/p>\n<p>case of UPSC Vrs. V.S. Papaiah (1997) 7 SCC 614 and<\/p>\n<p>neither that judgement was criticized nor it was<\/p>\n<p>distinguished or dissented from by the Apex Court in the<\/p>\n<p>case of Reeta Nag (Supra).\n<\/p>\n<p id=\"p_11\">          8. In the present case, learned Magistrate has<\/p>\n<p>in no way departed from his earlier order and he had the<\/p>\n<p>necessary jurisdiction to direct further investigation to<\/p>\n<p>collect further evidence and for submitting new report.<\/p>\n<p>Such power is manifest from different sub-sections in<\/p>\n<p><a href=\"\/doc\/1412034\/\" id=\"a_6\">Section 173<\/a> (8) of the Cr. P.C.\n<\/p>\n<p id=\"p_12\">          9. In view of aforesaid discussions and<\/p>\n<p>findings, this court finds no good ground to interfere<\/p>\n<p>with impugned order of learned Magistrate. This<\/p>\n<p>application is, therefore, dismissed.<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                          5<\/span><\/p>\n<p id=\"p_13\">                                 10.
