Justice S.S.SATHEESACHANDRAN\n\n Dated :28\/04\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n             Crl.M.C.No.1381 OF 2009\n           --------------------------\n      Dated this the 28th day of April 2009\n     -------------------------------------\n\n\n                    O R D E R\n<\/pre>\n<p id=\"p_1\">    This petition is filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the<\/p>\n<p>Code of Criminal Procedure to quash Annexure A1<\/p>\n<p>complaint and proceedings in C.C.No.84\/08 pending<\/p>\n<p>before  the   Chief  Judicial   Magistrate   Court,<\/p>\n<p>Pathanamthitta.    Notice  being   given,  the  2nd<\/p>\n<p>respondent\/the de facto complainant in the above<\/p>\n<p>petition has entered appearance through counsel.<\/p>\n<p>Petitioners are prosecuted for the   offence under<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_1\">Section  494<\/a>  read   with  34   <a href=\"\/doc\/1569253\/\" id=\"a_2\">I.P.C<\/a>.     Parallel<\/p>\n<p>proceedings are pending before the Family Court,<\/p>\n<p>Thiruvalla  and pursuant  to   mediation,  disputes<\/p>\n<p>between  the  partner  are  settled  and  a   joint<\/p>\n<p>compromise petition has been filed before that<\/p>\n<p>court in which the de facto complainant has agreed<\/p>\n<p>to withdraw the criminal case pending before the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.1381\/2009           2<\/span><\/p>\n<p>Magistrate, is the case of the petitioners for the<\/p>\n<p>reliefs claimed in the petition.\n<\/p>\n<p id=\"p_1\">      2.    I heard the learned counsel on both sides.<\/p>\n<p>The application is opposed by the learned counsel<\/p>\n<p>for the 2nd respondent\/complainant contending that<\/p>\n<p>terms of the compromise entered into have not been<\/p>\n<p>fulfilled by the petitioners and so much so there<\/p>\n<p>is no merit in the prayer for quashing                the<\/p>\n<p>criminal      case    on  the  basis  of  the  compromise<\/p>\n<p>petition filed by the petitioners.             Evidently,<\/p>\n<p>dispute as between the parties over the compromise<\/p>\n<p>entered into as to whether the terms thereunder<\/p>\n<p>have been complied with, still survive and as such<\/p>\n<p>it is not proper for this court to have an enquiry<\/p>\n<p>over      that      matter  which   is   still   awaiting<\/p>\n<p>consideration before the family court.            In the<\/p>\n<p>facts and circumstances involved, the petitioners<\/p>\n<p>are not entitled to        invoke  the inherent powers of<\/p>\n<p>this court for quashing the complaint and the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.1381\/2009        3<\/span><\/p>\n<p>proceedings in the criminal case pending before the<\/p>\n<p>Chief Judicial Magistrate Court, Pathanamthitta.<\/p>\n<p id=\"p_2\">      3.
