DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">Learned<br \/>\n\tcounsel appearing for the applicant submitted that investigation<br \/>\n\tis over and charge sheet is filed.  It is fuhrer submitted<br \/>\n\tthat earlier in an application filed by co-accused being Criminal<br \/>\n\tMisc. Application No.1663 of 2011, vide order dated 24.02.2011,<br \/>\n\tliberty was granted that in case if trial is not over within a<br \/>\n\tperiod of six months to seek remedy of bail. The petitioner is a<br \/>\n\tco-accused, who has filed the application though successive but<br \/>\n\tafter charge sheet.  It is further submitted that the applicant is<br \/>\n\tattributed of inflicting a stick blow, which are by and large<br \/>\n\tabrasions and contusions.  It is further submitted that<br \/>\n\tco-accused is enlarged on bail by this Court and very recently<br \/>\n\tco-ordinate Bench of this Court enlarged a co-accused vide order<br \/>\n\tdated 12.09.2011 passed in Misc. Criminal Application No.12235 of<br \/>\n\t2011.  It is further submitted that considering the nature of<br \/>\n\tallegations and role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions,  the applicant may be enlarged on bail.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p id=\"p_2\">Having<br \/>\n\theard learned counsel for the parties and perusing the<br \/>\n\trecord of the case and taking into consideration the facts of the<br \/>\n\tcase, nature of allegations, role attributed to the accused and<br \/>\n\tpunishment prescribed for the alleged offences coupled with<br \/>\n\tthe facts that charge sheet is<br \/>\n\tfiled and co-accused is enlarged on bail, without discussing<br \/>\n\tthe evidence in detail, at this stage, I am inclined to enlarge the<br \/>\n\tapplicant on bail  in connection with C.R.No.I-78\/2010 of Idar<br \/>\n\tPolice Station  for the offences punishable under <a href=\"\/doc\/1258372\/\" id=\"a_1\">sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a>,<br \/>\n\t<a href=\"\/doc\/999134\/\" id=\"a_2\">149<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_3\">120B<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_4\">302<\/a> &amp; <a href=\"\/doc\/37788\/\" id=\"a_5\">34<\/a> of the Indian Penal Code and Section 135 of<br \/>\n\tthe Bomaby Police Act, on furnishing bond of Rs.10,000\/- (Rupees ten<br \/>\n\tthousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p id=\"p_3\">[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p id=\"p_4\">[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_5\">[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p id=\"p_6\">[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p id=\"p_7\">[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p id=\"p_8\">[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p id=\"p_9\">[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p id=\"p_10\">If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p id=\"p_11\">At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p id=\"p_12\">Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_13\">Rule<br \/>\n\tis made absolute.
