DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tAt<br \/>\nthe outset, learned counsel for applicants does not press this<br \/>\napplication qua applicant Nos. 1, 2, 3, and 6, namely, Jethabhai<br \/>\nRajshi Danger, Khimabhai Rajshi Danger, jagabhai Rajshi Dangar and<br \/>\nGogan Jaga Dangar, at this stage. Rule qua them is discharged.\n<\/p>\n<p id=\"p_1\">\tThis<br \/>\napplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-8 of 2010  with Sheth Vadala police station for the offences<br \/>\npunishable under <a href=\"\/doc\/1096965\/\" id=\"a_1\">Sections 143<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_2\">147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_3\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_4\">149<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_5\">504<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_6\">34<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_7\">506(2)<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_8\">307<\/a><br \/>\nand <a href=\"\/doc\/1560742\/\" id=\"a_9\">302<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_2\">\tHeard<br \/>\nlearned counsel for the parties and perused the record and the charge<br \/>\nsheet filed in the case.\n<\/p>\n<p id=\"p_3\">\tLearned<br \/>\ncounsel for the applicants submits that, so far as applicant Nos. 4<br \/>\nand 5 are concerned, the family members of four brothers are<br \/>\narraigned as accused by attributing various weapons including sticks<br \/>\nand considering different version of the complainant before the<br \/>\nIncharge Medical Officer of Jamjodhpur Referral Hospital, Jamnagar<br \/>\nMedical Hospital, and later on at Civil Hospital, Ahmedabad, and<br \/>\nlooking to the injuries received, this application for bail qua<br \/>\napplicant Nos. 4 and 5 may kindly be considered.\n<\/p>\n<p id=\"p_4\">\tThe<br \/>\nlearned Additional Public Prosecutor has opposed grant of bail<br \/>\nlooking to the nature and gravity of offence.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nthe facts and circumstances of the case and considering the role<br \/>\nattributed to the applicant Nos. 4 and 5, nature of injuries, now<br \/>\ncharge sheet is filed,  without discussing the evidence in detail,<br \/>\nprima facie, this Court is of the opinion that this is a fit case to<br \/>\nexercise the discretion to enlarge the applicant Nos. 4 and 5 on<br \/>\nbail.\n<\/p>\n<p id=\"p_6\">\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant Nos. 4 and 5, namely, Sumat Rajshi Dangar and Ramde<br \/>\nSumat Dangar, are ordered to be released on bail in connection with<br \/>\nfirst information report registered at C.R.No.I-8 of 2010  with Sheth<br \/>\nVadala police station  on their executing a bond of Rs.5,000\/-<br \/>\n(Rupees five thousand only) each with one surety of the like amount<br \/>\nto the satisfaction of the trial court and subject to the conditions<br \/>\nthat they shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of their liberty or misuse their liberty;\n<\/p>\n<p id=\"p_8\">not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p id=\"p_9\">surrender<br \/>\n\ttheir passports, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_10\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_11\">mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10 a.m. And 3 p.m for six months only.\n<\/p>\n<p id=\"p_12\">furnish<br \/>\n\tthe present  address of their residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_13\">\tThe<br \/>\nAuthorities will release applicant Nos. 4 and 5 only if they are not<br \/>\nrequired in connection with any other offence for the time being. If<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter. Bail bond to be executed before the lower court<br \/>\nhaving jurisdiction to try the case. At the trial, the trial court<br \/>\nshall not be influenced by the observations of preliminary nature,<br \/>\nqua the evidence at this stage, made by this Court while enlarging<br \/>\napplicant Nos. 4 and 5 on bail.\n<\/p>\n<p id=\"p_14\">\tRule<br \/>\nis made absolute to the aforesaid extent.
