Thakkar for the applicant<br \/>\nand Mr RC Kodekar, learned Additional Public Prosecutor for the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p id=\"p_4\">\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the accused &#8211; applicant taking into<br \/>\nconsideration the following aspects:-\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tpapers would reveal that the first informant had sustained injury on<br \/>\n\this shoulder and he has been discharged from the hospital long time<br \/>\n\tback and he is out of danger;\n<\/p>\n<p id=\"p_6\">The<br \/>\n\taccused-applicant is not present who was in possession of the fire<br \/>\n\tarm and he has not fired the shot from the said fire arm<\/p>\n<p>He<br \/>\n\tis said to be one of the co-conspirators<\/p>\n<p>The<br \/>\n\tinvestigation is practically over.\n<\/p>\n<p id=\"p_7\">\tTaking<br \/>\ninto consideration the aforesaid prima facie aspects and in the facts<br \/>\nand circumstances of the case, I am persuaded to exercise my<br \/>\ndiscretion in favour of the applicant and order to release the<br \/>\naccused-applicant on regular bail in<br \/>\nconnection with  offence registered with Varachha Police Station,<br \/>\nbeing Crime Register No.I-80 of 2011 on his executing a bond in the<br \/>\nsum of Rs.15,000\/- (Rupees fifteen thousand only) with  one solvent<br \/>\nsurety of  the  like  amount  to  the  satisfaction  of  the  lower<br \/>\nCourt  and  subject  to the  conditions that he shall,<\/p>\n<p> [a]\tnot take undue advantage of or misuse liberty;\n<\/p>\n<p id=\"p_8\">[b]\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officer;\n<\/p>\n<p id=\"p_9\">[c]\tnot<br \/>\nact in a manner injurious to the interest of the \tprosecution;\n<\/p>\n<p id=\"p_10\">[d]\tsurrender<br \/>\nhis passport, if any, to the lower court<br \/>\nwithin a \tweek;\n<\/p>\n<p id=\"p_11\">[e]\tshall mark<br \/>\nhis presence before the concerned police station on 1st<br \/>\nand 4th Sunday between 10 AM and 5 PM;\n<\/p>\n<p id=\"p_12\">[f]\tnot leave<br \/>\nthe local limits of the State of Gujarat without prior permission of<br \/>\nthe Sessions Judge concerned;\n<\/p>\n<p id=\"p_13\">[g]\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p id=\"p_14\">\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_15\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant<br \/>\nor take appropriate action in the matter.\n<\/p>\n<p id=\"p_16\">\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case. This  application is allowed.\n<\/p>\n<p id=\"p_17\">\tRule<br \/>\nis made absolute. D.S.
