PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 28\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\nis an application under Sec.439 of the Code of Criminal Procedure,<br \/>\n1973 for regular bail by the applicant who came to be arrested in<br \/>\nconnection with  CR No. I-22 of 2010 registered with Ranpur police<br \/>\nstation, for the offence punishable under <a href=\"\/doc\/1096965\/\" id=\"a_1\">Sections 143<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_1\">147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_2\">148<\/a>,<br \/>\n<a href=\"\/doc\/999134\/\" id=\"a_3\">149<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_4\">302<\/a> and <a href=\"\/doc\/555306\/\" id=\"a_5\">504<\/a> of Indian Penal Code.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\nadvocate Mr. A.M. Dagli for the applicant submitted that the<br \/>\napplicant  has  not given a blow on the vital part of the body of the<br \/>\ndeceased, but he has given a blow on the right side elbow of the<br \/>\ndeceased. Save and except the aforesaid overt act, no other act is<br \/>\ncommitted by the applicant.  Learned advocate placed reliance on the<br \/>\norder dated  15.10.2010, passed by the coordinate bench of this Court<br \/>\nin Criminal Misc. Application No. 11061 of 2010, order dated<br \/>\n29.11.2010 passed in Criminal Misc. Application No. 12430 of 2010 and<br \/>\nthe order dated 30.12.2010 passed by this Court in Criminal Misc.<br \/>\nApplication No. 14718 of 2010 and submitted that even on the ground<br \/>\nof parity, the applicant deserves to be enlarged on bail.\n<\/p>\n<p id=\"p_2\">\tLearned<br \/>\nAPP Mr. H.L. Jani, representing the opponent State, while opposing<br \/>\nthe bail application, at the outset, submitted that the applicant has<br \/>\n preferred successive bail application. Considering the role<br \/>\nattributed to the applicant which is reflected in the FIR at<br \/>\nAnnexure:A to the application and the manner in which the offence is<br \/>\ncommitted by the applicant, no discretionary relief be granted to the<br \/>\napplicant and the application may be dismissed.\n<\/p>\n<p id=\"p_3\">\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. Considering the rival submissions and on perusal of the<br \/>\naverments made in the application, role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure:A to the application,  and<br \/>\nfurther considering the fact that other accused were granted bail by<br \/>\ncoordinate bench of this Court  vide order dated 15.10.2010 passed in<br \/>\nCriminal Misc. Application No. 11061 of 2010, order dated 29.11.2010<br \/>\npassed in Criminal Misc. Application No. 12430 of 2010 and the order<br \/>\ndated 30.12.2010 passed by this Court in Criminal Misc. Application<br \/>\nNo. 14718 of 2010, I am of the view that even though this is a<br \/>\nsuccessive bail application, since earlier bail application was<br \/>\nwithdrawn without arguing the same on merits, considering the role<br \/>\nattributed to the applicant, he deserves to be enlarged on bail.\n<\/p>\n<p id=\"p_4\">\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on<br \/>\nbail in connection with CR No. I-22 of 2010 registered at Ranpur<br \/>\nPolice Station on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the Trial Court and subject to the conditions that he shall:\n<\/p>\n<p id=\"p_5\">[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_6\">[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_7\">[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_8\">[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p id=\"p_9\">[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p id=\"p_10\">[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_11\">[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p id=\"p_12\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_13\">\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_14\">\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_15\">\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p id=\"p_16\">\tDirect<br \/>\nService is permitted.\n<\/p>\n<p id=\"p_17\">\t\t\t\t\t\t\t(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote id=\"blockquote_1\"><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Kanubhai vs State on 28 January, 2011 Author: H.B.Antani,&amp;Nbsp;
