JUSTICE SABINA\n\n                 ***\n\nPresent:     Mr.Sandeep Arora ,Advocate,\n             for the petitioners\n\n             Mr. Aman Deep Singh Rai, AAG, Punjab\n\n             Mr.G.S.Rawat, Advocate,\n             for respondent No. 2\n\n                   ***\n\nSABINA, J.\n<\/pre>\n<p id=\"p_1\">             Petitioners have filed this petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the<\/p>\n<p>Code of Criminal Procedure (hereinafter referred to as &#8216;<a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.&#8217;)for quashing<\/p>\n<p>of FIR No. 112 dated 5.7.2008 under <a href=\"\/doc\/1803184\/\" id=\"a_2\">Sections 295A<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a>           of the Indian<\/p>\n<p>Penal Code registered at Police Station, Division No. 1, Jalandhar on the<\/p>\n<p>basis of compromise.\n<\/p>\n<p id=\"p_1\">             Learned counsel for the petitioners has submitted that now with<\/p>\n<p>the intervention of the     relatives and friends, parties have arrived at a<\/p>\n<p>compromise.\n<\/p>\n<p id=\"p_2\">             Respondent No. 2 is present in person along with his counsel.<\/p>\n<p>They have placed on record the original compromise           dated 13.1.2009<\/p>\n<p>effected between the parties. A perusal of the same reveals that respondent<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Crl. Misc. No. M- 1575 of 2009                            -2-<\/span><\/p>\n<p>No. 2 has no objection if the FIR, in question, is quashed.<\/p>\n<p id=\"p_3\">              As per the Full Bench judgment of this Court in <a href=\"\/doc\/811682\/\" id=\"a_4\">Kulwinder<\/p>\n<p>Singh and others vs. State of Punjab<\/a>, 2007 (3) RCR (Criminal) 1052,<\/p>\n<p>High Court has power under <a href=\"\/doc\/1679850\/\" id=\"a_5\">Section 482<\/a> Cr.P.C. to allow the compounding<\/p>\n<p>of non-compoundable offence and quash the prosecution where the High<\/p>\n<p>Court felt that the same was required to prevent the abuse of the process of<\/p>\n<p>any Court or to otherwise secure the ends of justice.           This power of<\/p>\n<p>quashing is not confined to matrimonial disputes alone.<\/p>\n<p id=\"p_4\">             Hon&#8217;ble the Apex Court in the case of <a href=\"\/doc\/393489\/\" id=\"a_6\">Nikhil Merchant vs.<\/p>\n<p>Central<\/a> bureau of Investigation and another JT 2008 (9) SC 192 in paras<\/p>\n<p>23 and 24 has held as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;23. In the instant case, the disputes between the Company and<\/p>\n<p>            the Bank have been set at rest on the basis of the compromise<\/p>\n<p>            arrived at by them whereunder the dues of the Bank have been<\/p>\n<p>            cleared and the Bank does not appear to have any further claim<\/p>\n<p>            against the Company. What, however, remains is the fact that<\/p>\n<p>            certain documents were alleged to have been created by the<\/p>\n<p>            appellant herein in order to avail of credit facilities beyond the<\/p>\n<p>            limit to which the Company          was entitled.     The dispute<\/p>\n<p>            involved herein has overtones of a civil dispute with certain<\/p>\n<p>            criminal facets. The question which is required to be answered<\/p>\n<p>            in this case is whether the power which independently lies with<\/p>\n<p>            this court to quash the criminal proceedings pursuant to the<\/p>\n<p>            compromise arrived at, should at all be exercised?<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            24.On an overall view of the facts as indicated hereinabove<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                Crl. Misc. No. M- 1575 of 2009                 -3-<\/span><\/p>\n<p>               and keeping in mind the decision of this Court in B.S.Joshi&#8217;s<\/p>\n<p>               case (supra) and the compromise arrived at between the<\/p>\n<p>               Company and the Bank as also clause 11 of the consent terms<\/p>\n<p>               filed in the suit filled by the Bank, we are satisfied that this is a<\/p>\n<p>               fit case where technicality should not be allowed to stand in the<\/p>\n<p>               way in the quashing of the criminal proceedings, since, in our<\/p>\n<p>               view, the continuance of the same after the compromise arrived<\/p>\n<p>               at between the parties would be a futile exercise.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">\n<p id=\"p_6\">               Since the parties have arrived at a compromise, no useful<\/p>\n<p>purpose would be served by continuing the criminal proceedings, in<\/p>\n<p>question.\n<\/p>\n<p id=\"p_7\">               Accordingly, the present      petition is allowed.
