Laik, Senior Advocate &amp;\n                                         Smita Mitra, Advocate\n                              ---\n\n5. 10.02.2010<\/pre>\n<p id=\"p_1\">:   This writ petition has been filed against the order dated<br \/>\n           4.9.2008 passed by the Land Acquisition Judge, Dhanbad in L. A.<br \/>\n           Reference Case No. 10 of 1999 allowing the prayer of respondents<br \/>\n           under Order I Rule 10 of C.P.C. and adding them party in the<br \/>\n           proceeding.\n<\/p>\n<p id=\"p_1\">                 Mr. D. K. Prasad, learned counsel for the petitioner submitted<br \/>\n           that <a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition Act<\/a> is a complete Code and C.P.C. is not<br \/>\n           applicable; and that the respondents are not the interested persons,<br \/>\n           and therefore, they should not have been impleaded as party. He<br \/>\n           further submitted that at best the respondents could take recourse to<br \/>\n           <a href=\"\/doc\/2587\/\" id=\"a_1\">Section 30<\/a> for seeking reference. He relied on the case of Gorakhpur<br \/>\n           Development Authority, Gorakhpur Vs. District Judge, Gorakhpur and<br \/>\n           others reported in AIR 1991 Allahabad 241 and Shyamali Das Vs.<br \/>\n           ILLA Chowdhry and others reported in (2006) 12 SCC 300.\n<\/p>\n<p id=\"p_2\">                 Mr. Laik, learned senior counsel on the other hand supported<br \/>\n           the impugned order and submitted that learned Judge was prima<br \/>\n           facie satisfied that the respondents should be impleaded as party.<br \/>\n           Referring to <a href=\"\/doc\/721282\/\" id=\"a_2\">Section 53<\/a> of the Land Acquisition Act, he submitted that<br \/>\n           provisions of C.P.C. are applicable save so far as not inconsistent<br \/>\n           with <a href=\"\/doc\/7832\/\" id=\"a_3\">Land Acquisition Act<\/a>. He further submitted that Order I Rule 10<br \/>\n           can be invoked and if the court is satisfied that they are interested<br \/>\n           persons, they can be added as parties, at the stage of reference<br \/>\n           under <a href=\"\/doc\/1517117\/\" id=\"a_4\">Section 18<\/a> of the Land Acquisition Act and not at the stage of<br \/>\n           <a href=\"\/doc\/2587\/\" id=\"a_5\">Section 30<\/a>. He distinguished the judgments cited by Mr. Prasad, and<br \/>\n           relied on the judgment in the case of Bagh Singh and others Vs. The<br \/>\n           Special Land Acquisition Collector, Jalandhar and another reported in<br \/>\n           AIR 1984 Punjab and Haryana 177.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                           -2-<\/span><\/p>\n<p id=\"p_3\">                    The judgment of Gorakhpur Development Authority (supra) is<br \/>\n              not applicable in the present case as in that case the beneficiaries for<br \/>\n              whose benefit the land was sought to be acquired wanted to be<br \/>\n              impleaded as party and in that context, it was said that such<br \/>\n              application could not be made, in a proceeding under <a href=\"\/doc\/1517117\/\" id=\"a_6\">Section 18<\/a> of<br \/>\n              the Land Acquisition Act.\n<\/p>\n<p id=\"p_4\">                    The judgment of Shyamali Das (supra) is also not applicable in<br \/>\n              the present case. It will appear from paragraph 20 of the said case<br \/>\n              that the application earlier made for impleading the party was rejected<br \/>\n              holding that such party was not interested party, and that order having<br \/>\n              become final, another application for impleadment of party could not<br \/>\n              be made; and moreover, it further appears that an application under<br \/>\n              Order I Rule 10(2) of C.P.C. can be filed in a proceeding under<br \/>\n              <a href=\"\/doc\/1517117\/\" id=\"a_7\">Section 18<\/a> of the Land Acquisition Act.\n<\/p>\n<p id=\"p_5\">                    The learned court below, after considering the respective cases<br \/>\n              of the parties, was prima-facie satisfied that the respondent should be<br \/>\n              added as a party in this proceeding. The submission of Mr. Prasad<br \/>\n              that respondent could make an application for reference under<br \/>\n              <a href=\"\/doc\/2587\/\" id=\"a_8\">Section 30<\/a> of the Land Acquisition Act is wholly misconceived.\n<\/p>\n<p id=\"p_6\">                    In the circumstances, I find no reason to interfere with the<br \/>\n              impugned order in exercise of my supervisory jurisdiction under<br \/>\n              <a href=\"\/doc\/1331149\/\" id=\"a_9\">Article 227<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_7\">                    The respondents are directed to file their show-cause, if not<br \/>\n              already filed, within one month from today. They are further directed<br \/>\n              to conclude their evidence within two months thereafter. If no show-<br \/>\n              cause is filed and evidence is not concluded within such time the case<br \/>\n              of the respondents will be closed. The parties are directed to<br \/>\n              cooperate in early disposal of the matter before the Land Acquisition<br \/>\n              Judge, who will try to dispose of the proceeding expeditiously.\n<\/p>\n<p id=\"p_8\">                    This order is subject to payment of cost of Rs. 2,000\/- by the<br \/>\n              respondents to the petitioner, within four weeks from today.\n<\/p>\n<p id=\"p_9\">                    With these observations and directions, this writ petition is<br \/>\n              disposed of.\n<\/p>\n<p id=\"p_10\">                                                      (R.
