NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Notice on\tother respondents  has been served. They are<br \/>\nnot appearing  either in  person or  through counsel.  Delay<br \/>\ncondoned. S.R.\tBhatt appears  for  one\t respondent  in\t one<br \/>\nappeal.\n<\/p>\n<p id=\"p_1\">     Leave granted<br \/>\n     These  appeals,   by  special  leave,  arise  from\t the<br \/>\njudgment of  the Division Bench of the Karnataka High Court,<br \/>\ndated December\t22, 1995  made in  M.F.A. Nos.\t2688\/88\t and<br \/>\nbatch.\n<\/p>\n<p id=\"p_2\">     Notification under <a href=\"\/doc\/169774\/\" id=\"a_1\">section 4(1)<\/a> of the Land Acquisition<br \/>\nAct (for  Short, the &#8216;Act&#8217;) acquiring a large extent of land<br \/>\nwas published  on  March  25,  1971.  The  Land\t acquisition<br \/>\nOfficer in &#8230;&#8230;. award granted compensation at the rate of<br \/>\nRs. 8,000\/- per acre for the dry lands with which we are not<br \/>\nconcerned. We  are not\tconcerned with\tother  land  because<br \/>\nthere is  no appeal  in the  behalf.  On  reference    under<br \/>\n<a href=\"\/doc\/1517117\/\" id=\"a_1\">section\t 18<\/a>  of\t the  Act,  the\t Civil\tCourt  enhanced\t the<br \/>\ncompensation to\t Rs.  15,000\/-\tper  acre.  The\t High  Court<br \/>\nremitted   the\t matter\t  to   the   reference\t Court\t for<br \/>\nreconsideration. Thereafter,  the reference  Court  enhanced<br \/>\nthe compensation  to Rs. 38,000\/-. On appeal, the High Court<br \/>\nby the\timpugned judgment  has enhanced\t the compensation to<br \/>\nRs. 12\/- per sq. yd. which amounts to Rs. 58.000\/- per acre.<br \/>\nIt is  seen the\t since the  respondents have  not filed\t any<br \/>\nappeal under  <a href=\"\/doc\/634137\/\" id=\"a_2\">Section  26<\/a>  of  the  Act\t against  the  award<br \/>\ngranting enhanced  compensation of Rs. 38,000\/- per acre, we<br \/>\ndo not\tpropose to  go into  the enhancement  granted by the<br \/>\nreference Court.\n<\/p>\n<p id=\"p_3\">     The only  question is:  whether the High Court would be<br \/>\njustified in  enhancing the compensation to Rs. 12\/- per sq.<br \/>\nyd., in\t other words, Rs. 58,000\/- per acre. Admittedly, the<br \/>\nland is\t dry land  and\tthe  land  Acquisition\tOfficer\t had<br \/>\npointed out  in his award that the converted lands for which<br \/>\nhe had\tawarded compensation  at the rate of Rs. 9,000\/- and<br \/>\nRs. 10,000\/-  per acre,\t bear different\t connotation to\t the<br \/>\nactual dry  land existing  as on  that date.  The  potential<br \/>\nvalue shall  be determined  for the  land existing as on the<br \/>\ndate of\t the notification and not after subsequent developed<br \/>\nland bears no relevance to further enhancement of the value.<br \/>\nUnder  these   circumstances,  the  High  Court\t has  wholly<br \/>\nincorrect in  enhancing the compensation to Rs. 12\/- per sq.<br \/>\nyd., i.e. Rs. 58,000\/- per acre.\n<\/p>\n<p id=\"p_4\">     The appeals  are accordingly  allowed and\tthe judgment<br \/>\nand order  of the High Court stand set aside and that of the<br \/>\nreference Court stands confirmed.
