Civil Application has<br \/>\n\tbeen filed to review, recall and or modify the judgment and order<br \/>\n\tdated 8-3-2011 passed in Special Civil Application No.13099 of 1994.\n<\/p>\n<p>Heard learned advocate, Mr.Jayraj<br \/>\n\tChauhan, for the applicant, Mr.B.C.Dave for the opponent NO.1 and<br \/>\n\tlearned APP, Mr.L.R.Pujari for the opponent No.2.\n<\/p>\n<p>It is submitted by Mr.Jayraj<br \/>\n\tChauhan that the impugned judgment did not incorporate certain<br \/>\n\tdecisions cited by him.\n<\/p>\n<p>It is to be noted that apart from<br \/>\n\tthe decisions relied on by the learned counsel, Mr.Jayraj Chauhan,<br \/>\n\tas recorded in the impugned judgment, learned advocate for the<br \/>\n\tapplicant has also relied on the following decisions:\n<\/p>\n<p>i)<br \/>\n\t2001(4)  G.L.R. Page 3180 in the case of Shamalsha Girdhari Co.Vs.<br \/>\n\tState of Gujarat and Ors;\n<\/p>\n<p>ii)<br \/>\n\t1995 Supp(3) Supreme Court Cases page 249 in the case of State of<br \/>\n\tOrissa and Others Vs. Brundaban Sharma and another; and<\/p>\n<p>iii)<br \/>\n\tAIR 2005 Supreme Court page 592 in the case of Board of Control for<br \/>\n\tCricket, India and another Vs. Netaji Cricket Club and others.\n<\/p>\n<p>He has also taken this Court through<br \/>\n\trelevant provisions of Contract Act, 1872 and the Transfer of<br \/>\n\tProperty Act, 1882.\n<\/p>\n<p>There<br \/>\n\tcannot be any dispute regarding the ratio laid down by the High<br \/>\n\tCourt as well as the Hon&#8217;ble Apex Court in the decisions cited by<br \/>\n\tthe learned advocate, Mr.Jayraj Chauhan. However, looking to<br \/>\n\tthe facts and circumstances of the case, it appears that facts of<br \/>\n\tthe present case and facts in the aforesaid decisions relied on by<br \/>\n\tMr.Jayraj Chauhan are totally different and hence, aforesaid<br \/>\n\tdecisions are not applicable to the facts of the present case. Apart<br \/>\n\tfrom the above, it is reiterated that the proceedings were initiated<br \/>\n\tafter a period of 13 years and hence, relying on the decision a<br \/>\n\tDivision Bench of this Court rendered in the case of Vitthalbhai<br \/>\n\tM.Patel &amp; Others Vs. Deputy Collector &amp; Another in<br \/>\n\tLetters Patent Appeal No.363 of 2000 in Special Civil<br \/>\n\tApplication No.3250 of 1988, impugned<br \/>\n\torders were quashed and set aside by this Court and Special Civil<br \/>\n\tApplication was allowed.\n<\/p>\n<p>\tNo interference is called for in the said findings.\n<\/p>\n<p>\tThus,<br \/>\n\tthis Misc. Civil Application is partly allowed. Decisions cited by<br \/>\n\tthe learned advocate, Mr.Jayraj Chauhan, for the applicant-original<br \/>\n\trespondent No.2\/3 is incorporated in the impugned judgment.
