Justice THOMAS P.JOSEPH\n\n Dated :15\/09\/2010\n\n O R D E R\n                    THOMAS P.JOSEPH, J.\n            ====================================\n                      Tr.P(C) No.360 of 2009\n            ====================================\n          Dated this the 15th   day of September,    2010\n\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">      Respondent is served on the petition but he has not<\/p>\n<p>responded.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.    This petition is filed by the wife seeking transfer of<\/p>\n<p>O.P. No.253 of 2009 from Family Court, Thodupuzha to Family<\/p>\n<p>Court, Kottayam at Ettumanoor. Petitioner is a resident           of<\/p>\n<p>Puliyanoor in Mutholi Village, Palai. Petitioner filed M.C. No.303 of<\/p>\n<p>2009 in Family Court, Kottayam, at Ettumanoor claiming<\/p>\n<p>maintenance from the respondent-husband. Respondent has filed<\/p>\n<p>O.P. No.253 of 2009 in Family Court, Thodupuzha for dissolution<\/p>\n<p>of marriage. Though distance wise petitioner has no reason to<\/p>\n<p>seek transfer, request is based on         pendency of the case at<\/p>\n<p>Thodupuzha.     Since M.C. No.303 of 2009 is pending in Family<\/p>\n<p>Court, Kottayam at Ettumanoor and so far there is no request for<\/p>\n<p>transfer of that case to Thodupuzha it is appropriate that both the<\/p>\n<p>cases are decided by the same court. Hence I am inclined to allow<\/p>\n<p>this petition.\n<\/p>\n<p id=\"p_3\">      Resultantly, petition is allowed in the following lines:<\/p>\n<p>Tr.P(C) No.360 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -: 2 :-<\/span><\/p>\n<p id=\"p_4\">            (i)    O.P. No.253 of 2009 pending in Family<\/p>\n<p>     Court, Thodupuzha is withdrawn from that court and<\/p>\n<p>     transferred     to     Family  Court,   Kottayam,    at<\/p>\n<p>     Ettumanoor.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">            (ii)   The transferor court while transmitting<\/p>\n<p>      records of the case to the transferee court shall fix<\/p>\n<p>      date for appearance of      parties in the transferee<\/p>\n<p>      court with due    intimation to the counsel for both<\/p>\n<p>      parties.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">            (iii)  The transferee court shall ensure that all<\/p>\n<p>      the cases are posted on the same dates, as far as<\/p>\n<p>      possible.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">            (iv)   It is made clear that except when<\/p>\n<p>      physical presence of respondent in court is necessary<\/p>\n<p>      he can appear through counsel.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">                                 THOMAS P.
