Registrar, Firms Societies And Chits And\nOthers\nPetitioner Counsel :- Vivek Mishra\nRespondent Counsel :- C.S.C.,Anil Kumar Sharma,H.V.\nSrivastava\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p id=\"p_1\">The petitioner has sought the quashing of the order dated 25th<br \/>\nAugust, 2009 passed by the Deputy Registrar, Firms, Societies and<br \/>\nChits (hereinafter referred to as the &#8216;Deputy Registrar&#8217;) by which<br \/>\nhe has rejected the objections filed by the petitioner under <a href=\"\/doc\/67345983\/\" id=\"a_1\">Section<br \/>\n12-D<\/a> of the Societies Registration Act, 1860 (hereinafter referred<br \/>\nto as the &#8216;Act&#8217;) for cancelling the registration of the Society on the<br \/>\nground that it had been obtained by fraud or misrepresentation.\n<\/p>\n<p id=\"p_1\">Sri Vivek Mishra, learned counsel appearing for the petitioner has<br \/>\nraised a number of submissions against the impugned order but it<br \/>\nis pointed out by Sri Anil Kumar Sharma, learned counsel<br \/>\nappearing for the respondents that against the order passed under<br \/>\n<a href=\"\/doc\/72793332\/\" id=\"a_1\">Section 12-D(1)(c)<\/a> of the Act an appeal lies to the Commissioner<br \/>\nof the Division under Sub-section 2 of Section 12-D.\n<\/p>\n<p id=\"p_2\">It is not disputed by Sri Mishra learned counsel appearing for the<br \/>\npetitioner that an appeal can be filed under <a href=\"\/doc\/72793332\/\" id=\"a_2\">Section 12-D(1)(c)<\/a> of<br \/>\nthe Act. In such circumstances, the Court declines to entertain this<br \/>\npetition as the petitioner can file an appeal to the Commissioner of<br \/>\nthe Division under <a href=\"\/doc\/27331726\/\" id=\"a_3\">Section 12-D(2)<\/a> of the Act.\n<\/p>\n<p id=\"p_3\">Sri Mishra then submitted that he will file an appeal within a<br \/>\nperiod of three weeks&#8217; from today but a direction may be issued to<br \/>\ndecide the appeal expeditiously.\n<\/p>\n<p id=\"p_4\">The petition is, accordingly, dismissed on the ground of<br \/>\navailability of statutory alternative remedy.
