Misc. No.42807 of 2010\n                  GUDDU YADAV son of Sri Ram Charitra Yadav\n                                    Versus\n                              STATE OF BIHAR\n                                   -----------\n<\/pre>\n<p id=\"p_1\">3\/   14.03.2011,               Heard learned counsel for the petitioner and the State.<\/p>\n<p id=\"p_1\">                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under sections 25(1-b) a, 26 of the <a href=\"\/doc\/1934415\/\" id=\"a_1\">Arms Act<\/a>.<\/p>\n<p id=\"p_2\">                               It has been submitted that the petitioner is in custody<\/p>\n<p>                   since 16.08.2010 for recovery of one country made pistol and one<\/p>\n<p>                   cartridge and apart from one other case he has clean antecedents.<\/p>\n<p id=\"p_3\">                               Considering the same, let the petitioner, above named,<\/p>\n<p>                   be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                   thousand) with two sureties of the like amount each or any other<\/p>\n<p>                   surety to be fixed by the court below to the satisfaction of the Chief<\/p>\n<p>                   Judicial Magistrate, Gaya, in connection with Gaya Mufassil P.S.<\/p>\n<p>                   Case No. 129 of 2010, subject to the conditions (i) That one of the<\/p>\n<p>                   bailors will be a close relative of the petitioner, who will give an<\/p>\n<p>                   affidavit giving genealogy as to how he is related with the petitioner<\/p>\n<p>                   and another bailor shall be the father of the petitioner. The bailors<\/p>\n<p>                   will undertake to furnish information to the court about any change<\/p>\n<p>                   in the address of the petitioner, (ii) That the bailors shall also state<\/p>\n<p>                   on affidavit that they will inform the court concerned if the<\/p>\n<p>                   petitioner is implicated in any other case of similar nature after his<\/p>\n<p>                   release in the present case and thereafter the court below will be at<\/p>\n<p>                   liberty to initiate the proceeding for cancellation of bail on the<\/p>\n<p>                   ground of misuse, (iii) That the petitioner will give an undertaking<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>       that he will receive the police papers on the given date and be<\/p>\n<p>       present on date fixed for charge and if he fails to do so on two given<\/p>\n<p>       dates and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>       cancelled for reasons of misuse, and (iv) That the petitioner will be<\/p>\n<p>       well represented on each date and if he fails to do so on two<\/p>\n<p>       consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p id=\"p_4\">                   The fact that there is only one other case pending against<\/p>\n<p>       the petitioner shall be verified by the Magistrate before releasing the<\/p>\n<p>       petitioner on bail.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">JA\/-                                           (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Guddu Yadav vs State Of Bihar on 14 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
