BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                  Crl.M.C.No. 3465 of 2007\n                  - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 16th day of November, 2007\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">      The petitioner has been arrayed as an accused in a private<\/p>\n<p>complaint filed by the first respondent herein. The petitioner has<\/p>\n<p>come to this Court with a prayer that powers under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a><\/p>\n<p>Cr.P.C. may be invoked to quash the proceedings against him.<\/p>\n<p id=\"p_1\">      2. It will be apposite to briefly advert to the relevant facts,<\/p>\n<p>which has culminated in the initiation of the prosecution against<\/p>\n<p>the petitioner on a private complaint. About an incident which<\/p>\n<p>took place on 19.12.2004, the first respondent had lodged a F.I.<\/p>\n<p>statement    before the police and crime 341 of 2004 was<\/p>\n<p>registered   at the Kollengode police station.                In that the<\/p>\n<p>complainant had specifically alleged that two persons, including<\/p>\n<p>the petitioner herein, (who was shown as the first accused) had<\/p>\n<p>committed offences punishable under <a href=\"\/doc\/661069\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/770961\/\" id=\"a_2\">323<\/a> and <a href=\"\/doc\/267625\/\" id=\"a_3\">324<\/a><\/p>\n<p>r\/w. 34 <a href=\"\/doc\/1569253\/\" id=\"a_4\">I.P.C<\/a>. against the defacto complainant.               Crime  was<\/p>\n<p>B.A.No. 3465 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>registered. Investigation was conducted and final report was filed by<\/p>\n<p>the police after such investigation.\n<\/p>\n<p id=\"p_2\">      3. In the final report submitted by the police, no allegations were<\/p>\n<p>raised against the petitioner and the petitioner was dropped from the<\/p>\n<p>array of accused. Final report showed only one accused, i.e. the<\/p>\n<p>second accused in the F.I.R., as the sole accused. It would appear that<\/p>\n<p>no notice was ever given to the first respondent of the dropping of the<\/p>\n<p>petitioner from the array of accused. The first respondent received<\/p>\n<p>summons from the court in the police charge case to appear as a<\/p>\n<p>witness. He went to the court and at that stage, it appears, he came to<\/p>\n<p>realise that the petitioner has been dropped from the array of accused.<\/p>\n<p>He tendered evidence on oath. In the evidence, he implicated the<\/p>\n<p>petitioner herein also. The learned Prosecutor filed an application<\/p>\n<p>under <a href=\"\/doc\/435819\/\" id=\"a_5\">Section 319<\/a> Cr.P.C. that cognizance may be taken against the<\/p>\n<p>petitioner herein also.\n<\/p>\n<p id=\"p_3\">      4. In the mean time, the first respondent filed a private complaint<\/p>\n<p>raising his grievance against the dropping of the petitioner from the<\/p>\n<p>array of accused. That complaint was pending as Crl.M.P. Adverting<\/p>\n<p>B.A.No. 3465 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    3<\/span><\/p>\n<p>to that facts and on that ground the petition filed by the Prosecutor<\/p>\n<p>under <a href=\"\/doc\/435819\/\" id=\"a_6\">Section 319<\/a> Cr.P.C. was dismissed.            Later, the learned<\/p>\n<p>Magistrate took cognizance of the offences allegedly committed by the<\/p>\n<p>petitioner on the basis of the private complaint (copy of which is<\/p>\n<p>Annex.A) filed by the first respondent.\n<\/p>\n<p id=\"p_4\">       5. The petitioner has now come to this court with a prayer that<\/p>\n<p>powers under <a href=\"\/doc\/1679850\/\" id=\"a_7\">Section 482<\/a> Cr.P.C. may be invoked to quash the case<\/p>\n<p>initiated on the basis of the private complaint against the petitioner.<\/p>\n<p>What is the reason? The only reason urged is that the police after<\/p>\n<p>investigation had come to the conclusion that the petitioner is not<\/p>\n<p>guilty and had dropped him from the array of accused. That is no<\/p>\n<p>reason to foreclose the option of the first respondent to file a private<\/p>\n<p>complaint. That the police had dropped the petitioner from the array of<\/p>\n<p>accused is certainly not a valid reason to not entertain the private<\/p>\n<p>complaint filed by the first respondent later.<\/p>\n<p id=\"p_5\">       6. The learned counsel for the petitioner then contends that there<\/p>\n<p>was delay in the filing of the private complaint. There is nothing to<\/p>\n<p>show that notice was given to the first respondent before or at the time<\/p>\n<p>B.A.No. 3465 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                   4<\/span><\/p>\n<p>when cognizance was taken only against the second accused shown in<\/p>\n<p>the F.I.R.  As stated earlier, there is nothing to show that any such<\/p>\n<p>notice\/information was given to the first respondent. The allegation is<\/p>\n<p>not barred by limitation and there is no contention before me that<\/p>\n<p>cognizance was barred by the provisions relating to limitation in the<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_8\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_6\">     7. It follows from the above discussions that the powers under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_9\">Section 482<\/a> Cr.P.C. do not deserve to be invoked against the<\/p>\n<p>cognizance taken of the offences alleged against the petitioner as per<\/p>\n<p>Annex.A complaint by the learned Magistrate.<\/p>\n<p id=\"p_7\">     8.
