RAJU @ BIHAREE SURENDRASING THAKUR - Petitioner(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT &amp; 2 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nMR PRAJAPATI for\nPetitioner(s) : 1, \nMS SHACHI MATHUR, AGP for Respondent(s) :\n1-3 \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\nDate\n: 22\/02\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">The<br \/>\n\t detenu has  been  detained under the provisions   of   Gujarat<br \/>\n\tPrevention of Anti-Social Activities Act, 1985 (hereinafter referred<br \/>\n\tto as `the Act of 1985&#8242;) by the  order dated  22-9-2009 passed by<br \/>\n\tthe Police Commissioner, Surat City, and detenu has been declared as<br \/>\n\tbootlegger.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tlearned advocate for the petitioner and the learned AGP for the<br \/>\n\tState.    Also  perused the  record.\n<\/p>\n<p id=\"p_2\">It<br \/>\n\tappears that a solitary offence being Puna Police Station III.Crime<br \/>\n\tRegister No.341 of 2009 dated 1-9-2009 under the prohibition Act has<br \/>\n\tbeen registered against the detenue  alleging that 4700 bottles of<br \/>\n\tcountry made liquor of different brands  weighing 180 mm worth<br \/>\n\tRs.1,41,000\/- and other articles were found from the possession of<br \/>\n\tthe detenu. On the basis of registration of the said solitary case,<br \/>\n\tthe detaining authority held that since the said activities of<br \/>\n\tselling country made liquor of the present detenu were harmful to<br \/>\n\tthe health of the public, to restrain from carrying further illegal<br \/>\n\tactivities, the detenu has been detained. It appears from the order<br \/>\n\tthat the activities of the detenu cannot be said to be disturbing<br \/>\n\tthe  public order .  It also appears from the order passed by<br \/>\n\tthe detaining authority that  grounds which are mentioned in the<br \/>\n\torder are in reference to the situation of  law and order  and<br \/>\n\tnot  public order .\n<\/p>\n<p id=\"p_3\">Except<br \/>\n\tthe statements of some anonymous witnesses, there is no material on<br \/>\n\trecord which shows that the detenu is carrying on activities of<br \/>\n\tselling country made liquor which is harmful to the health of the<br \/>\n\tpublic. In the case of <a href=\"\/doc\/687998\/\" id=\"a_1\">Ashokbhai Jivraj @ Jivabhai Solanki v.<br \/>\n\tPolice Commissioner, Surat<\/a> [(2001) (1) GLH 393), having<br \/>\n\tconsidered the decision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_1\">Ram<br \/>\n\tManohar Lohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court<br \/>\n\theld that the case wherein the detention order passed on the basis<br \/>\n\tof the statements of the witnesses fall under the maintenance of<br \/>\n\t law and order  and not  public order .\n<\/p>\n<p id=\"p_4\">Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention of a detenu, the detaining authority must come to<br \/>\n\ta definite finding that there is threat to the  public order<br \/>\n\tand it is very clear that the present case would not fall within the<br \/>\n\tcategory of threat to  public order . In that view of the<br \/>\n\tmatter, when the order of detention has been passed by the detaining<br \/>\n\tauthority without having adequate grounds for passing the said<br \/>\n\torder, it cannot be sustained and, therefore, it deserves to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tpetition is allowed. The impugned order of detention dated 22-9-2009<br \/>\n\tpassed by the Police Commissioner, Surat City, against  the detenu<br \/>\n\tis hereby quashed and set  aside.   The detenu is ordered to be set<br \/>\n\tat liberty forthwith,  if  not  required  in  any other case.<br \/>\n\tRule is made absolute accordingly.
