Among other<\/p>\n<p> activities, it is involved in breaking up old<\/p>\n<p> ships and selling off the scrap.<\/p>\n<p id=\"p_4\">2.On knowing about the availability of two tanks as<\/p>\n<p> part of scrap, the plaintiff offered to purchase<\/p>\n<p> them from the defendant. The tanks were provided<\/p>\n<p> for inspection and sale in &#8220;as is where is<\/p>\n<p> condition&#8221;. The plaintiff purchased those tanks<\/p>\n<p> and transported the same for its purpose.<\/p>\n<p id=\"p_5\">3.The plaintiff sued on the plea that it was<\/p>\n<p> thereafter noted that cement and other materials<\/p>\n<p> were embedded inside the tanks and therefore, the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">AS384\/96              -: 2 :-<\/span><\/p>\n<p> tanks weighed beyond their real worth. On this<\/p>\n<p> plea,   the   plaintiff     sued  for   refund of<\/p>\n<p> proportionate amounts out of the consideration<\/p>\n<p> paid by the plaintiff to the defendant. They<\/p>\n<p> also claimed certain amounts allegedly spent for<\/p>\n<p> transit and also towards damages on account of<\/p>\n<p> amounts spent, including for cleaning up the<\/p>\n<p> tanks.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">4.That the tanks were part of scrap is an admitted<\/p>\n<p> situation.  The  appealing     defendant, SILK, a<\/p>\n<p> public sector company, was involved in breaking<\/p>\n<p> up old ships and taking over and selling the<\/p>\n<p> scrap. Materials were provided for sale on &#8220;as<\/p>\n<p> is where is basis&#8221;. What is involved is sale of<\/p>\n<p> goods. There is no material on record or even a<\/p>\n<p> plea by the plaintiff that there was any offer<\/p>\n<p> by SILK or representation to the defendant as<\/p>\n<p> regards the quality of the goods. There is no<\/p>\n<p> plea or evidence that the defendant represented<\/p>\n<p> to the plaintiff that the tanks were of a<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">AS384\/96              -: 3 :-<\/span><\/p>\n<p> particular quality or that it is maintained in a<\/p>\n<p> particular  manner.  Obviously,   therefore, the<\/p>\n<p> principle   of   caveat     emptor applies.  The<\/p>\n<p> plaintiff  had  admittedly    the opportunity to<\/p>\n<p> inspect the goods and take it, if it wanted.<\/p>\n<p id=\"p_8\">5.On the aforesaid facts and circumstances, the<\/p>\n<p> plaintiff&#8217;s claim in its entirety was wholly<\/p>\n<p> unfounded and the plaintiff ought to have been<\/p>\n<p> non-suited. The court below, however, decreed<\/p>\n<p> the suit allowing recovery of Rs.87,960\/- with<\/p>\n<p> its future interest. On the evidence on record,<\/p>\n<p> in the light of what is stated above, we do not<\/p>\n<p> find any ground to sustain the impugned decree.<\/p>\n<p id=\"p_9\">6.We may take note of the fact that the defendant<\/p>\n<p> had offered to return a particular amount to the<\/p>\n<p> plaintiff which the plaintiff did not receive.<\/p>\n<p> In the aforesaid premise, we allow this appeal<\/p>\n<p> and dismiss the suit without prejudice to the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">AS384\/96              -: 4 :-<\/span><\/p>\n<p> plaintiff  collecting      any amount   that the<\/p>\n<p> defendant voluntarily pays.
