Justice S.SIRI JAGAN\n\n Dated :03\/11\/2009\n\n O R D E R\n                        S.SIRI JAGAN,J.\n                      -------------------------\n             W.P ( C) Nos.25701 &amp; 26535 of 2009\n                      --------------------------\n             Dated this the 3rd November,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>     The Kerala State Electricity Board decided to construct<\/p>\n<p>a 220 KV Sub Station at Kattakkada in Trivandrum District.<\/p>\n<p>For this purpose, towers have to be erected and power lines<\/p>\n<p>have to be drawn for 30kms               from Pothenkode to<\/p>\n<p>Kattakkada. The total project cost is Rs.112 crores. This is<\/p>\n<p>necessitated because presently part of the southern district<\/p>\n<p>and part of the Trivandrum City are fed through 110 KV line<\/p>\n<p>from Pothenkode to Kattakkada which is overloaded. Hence<\/p>\n<p>these parts are facing voltage problems and frequent<\/p>\n<p>interruption in power supply, which would also affect the<\/p>\n<p>pumping of water to the capital city from Aruvikkara. The<\/p>\n<p>project is intended for supplying power to the proposed<\/p>\n<p>prestigious Vizhinjam Port also. The survey of the line was<\/p>\n<p>carried out in 2003 and the competent authority approved<\/p>\n<p>the route after studying various alternatives and a route<\/p>\n<p>was selected which according to the Board would cause<\/p>\n<p>least inconvenience to all concerned. But the petitioners in<\/p>\n<p>these two writ petitions through whose properties also<\/p>\n<p>W.P ( C) Nos.25701 &amp; 26535 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>these lines would pass objected to the drawing of the lines.<\/p>\n<p>Therefore, the matter was referred to the Additional<\/p>\n<p>District Magistrate, Thiruvananthapuram who heard the<\/p>\n<p>petitioners in these two writ petitions separately and<\/p>\n<p>passed separate orders which are Ext.P5 in WPC No.26535<\/p>\n<p>of 2009 and Ext.P6 in WPC No.25701\/09 by which the<\/p>\n<p>objections raised by the petitioners were rejected and the<\/p>\n<p>Board was permitted to draw the electric lines through the<\/p>\n<p>route proposed by them. Both orders were passed on<\/p>\n<p>28.2.2007. Petitioners have challenged those orders on<\/p>\n<p>10.9.2009 and 18.9.2009 respectively, on the ground that<\/p>\n<p>the alternate routes suggested by the petitioners have not<\/p>\n<p>been properly considered by the Additional District<\/p>\n<p>Magistrate, who disposed of their objections by a non-<\/p>\n<p>speaking order.        Petitioners therefore submit that the<\/p>\n<p>impugned orders are liable to be quashed and the<\/p>\n<p>Additional District Magistrate is liable to be directed to<\/p>\n<p>reconsider       the alternate routes      suggested by the<\/p>\n<p>petitioners.\n<\/p>\n<p>      2.     The Board has filed a counter affidavit in which<\/p>\n<p>they would reiterate that the route proposed by them is the<\/p>\n<p>W.P ( C) Nos.25701 &amp; 26535 of 2009<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>most suitable route and no change is called for in the same.<\/p>\n<p>      3.     I have considered the rival contentions in detail.<\/p>\n<p>It is true that the Additional District Magistrate had not<\/p>\n<p>given elaborate reasons to reject the alternate routes<\/p>\n<p>suggested by the petitioners. But it must be remembered<\/p>\n<p>that the Additional District Magistrate is not a legally<\/p>\n<p>trained person and he cannot be expected to write an order<\/p>\n<p>under 16(1) of the Indian Telegraph Act like a judgment.<\/p>\n<p>      4.     In the above circumstances, I wanted the<\/p>\n<p>petitioners to satisfy me as to the suitability of their<\/p>\n<p>alternate     routes.    Admittedly, the petitioners have not<\/p>\n<p>chosen to conduct any survey of their own. The line runs<\/p>\n<p>into 30 kms. Even a slight change at one point would<\/p>\n<p>ultimately result in a very big change in the ultimate<\/p>\n<p>alignment at the destination point.      Petitioners are only<\/p>\n<p>concerned with their own inconvenience.          Petitioner in<\/p>\n<p>WPC No.25701\/09 has vaguely alleged malafides. He has<\/p>\n<p>not chosen to implead any person against whom malafides<\/p>\n<p>are alleged, in his personal capacity and has not been able<\/p>\n<p>to provide any material in support of his contention of<\/p>\n<p>malafides. Petitioner in the other writ petition does not<\/p>\n<p>W.P ( C) Nos.25701 &amp; 26535 of 2009<br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>even allege malafides. It is settled law that this Court can<\/p>\n<p>interfere with      orders passed under Sec. 16 (1) of the<\/p>\n<p>Indian Telegraph Act only if the decision taken is perverse<\/p>\n<p>or the same is mala fide. In cases of such large projects, it<\/p>\n<p>is     usual    that       some people   would   be slightly<\/p>\n<p>inconvenienced by the same which is not avoidable.      That<\/p>\n<p>cannot be the sole reason for changing the alignment. If at<\/p>\n<p>this point of time, a resurvey is ordered to look into the<\/p>\n<p>alternate route suggested by the petitioners, it would delay<\/p>\n<p>the project itself indefinitely which would be against public<\/p>\n<p>interest.
