Justice PIUS C.KURIAKOSE\n\n Dated :15\/01\/2007\n\n O R D E R\n                          PIUS C.KURIAKOSE, J.\n\n                        ----------------------------------\n\n                      W.P.(C)NO. 1669   of    2007\n\n                        ----------------------------------\n\n                Dated this 15th day of  January, 2007\n\n\n                                  JUDGMENT\n<\/pre>\n<p id=\"p_1\">         Sri.Shaji Chirayath, the learned counsel for the petitioner<\/p>\n<p>submits that it may not be possible for the petitioner to file any<\/p>\n<p>objection  to the proceedings which are  proposed under <a href=\"\/doc\/14139509\/\" id=\"a_1\">Section<\/p>\n<p>32<\/a>   of   the     Co-operative   Societies   Act   unless   the   petitioner   is<\/p>\n<p>supplied with a copy of the enquiry report which is referred to as<\/p>\n<p>item   Nos.   5   and   6   in   Ext.P1.       Sri.P.N.Santhosh,   the   learned<\/p>\n<p>Government   Pleader   submits   that   there   is   no   practice   of<\/p>\n<p>supplying parties with copies of the enquiry reports.  An enquiry<\/p>\n<p>has   been   conducted     with   reference   to   the   records   which   are<\/p>\n<p>maintained   in   the   office   of   the   petitioner&#8217;s   society   itself.       The<\/p>\n<p>learned   Government   Pleader   submits   that   on   10.1.2007   the<\/p>\n<p>petitioner did not even appear before the   Joint Registrar.     The<\/p>\n<p>counsel   for   the   petitioner   would   submit   that   on   10.1.2007,   the<\/p>\n<p>petitioner   submitted   Exts.P2   and   P3   before   the   Joint   Registrar<\/p>\n<p>requesting for  seeking copies of the enquiry  report and  related<\/p>\n<p>papers.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     I   do   not   propose   to   go   into   the   eligibility   of   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.1669\/2007                         2<\/span><\/p>\n<p>petitioner   to   have   copies   of   the   enquiry   report.     But,     since<\/p>\n<p>Exts.P2 and P3 have been submitted by the petitioner, this writ<\/p>\n<p>petition   will   stand   disposed   of     directing   the   first   respondent   &#8211;<\/p>\n<p>Joint   Registrar   to   take   up   Exts.P2   and   P3   today   itself   and   pass<\/p>\n<p>orders   on     those   applications   unless   they   are   not   already<\/p>\n<p>rejected.  In other words, it is clarified that orders on Ext.P1 will<\/p>\n<p>be passed only after copies of  the orders to be passed on Exts.P2<\/p>\n<p>and P3 are served on the petitioner.
