No.11158.09\n\n\n\n          Writ Petition No. 11158 of 2009\n16\/03\/2011\n    Shri Gajendra Singh, learned counsel for\nthe petitioner.\n    Shri Anshuman Singh, learned counsel for\nthe respondent No. 2.<\/pre>\n<p id=\"p_1\">    Challenge in this petition is to an order<br \/>\ndated    19-08-2009      passed     by   the       Industrial<br \/>\nCourt,       Jabalpur,     whereby           Appeal           No.<br \/>\n21\/09\/MPIR       preferred     by      respondent             No.<br \/>\n2\/Municipal      Corporation      against          the    order<br \/>\ndated 09-02-2009 passed by the Labour Court<br \/>\nhas been allowed.\n<\/p>\n<p id=\"p_1\">    The order dated 09-02-2009 was passed in<br \/>\na proceeding under section 31(3) read with<br \/>\nsection 61 of the M. P. Industrial Relations Act,<br \/>\n1960 (for short &#8216;the Act of 1960) whereby the<br \/>\npetitioner    herein     had   sought        the    relief       of<br \/>\npromotion to the post of Lower Division Clerk<br \/>\nand had claimed for difference of wages on<br \/>\nsuch promotion. The petitioner at the relevant<br \/>\ntime was discharging his duty as a labour and<br \/>\nlooking after the work of pump operation. By<br \/>\norder    dated    09-02-2009      the    Labour          Court<br \/>\nallowed   the    application    with     a    direction          to<br \/>\n                                                  W.P. No.11158.09<\/p>\n<p>respondent No.1\/Corporation             to promote        the<br \/>\npetitioner as Lower Division Clerk. Against this<br \/>\norder    an    appeal      was       preferred   by       the<br \/>\nrespondent\/Corporation under section 65 of the<br \/>\nAct of 1960. The said appeal was allowed on<br \/>\n19-08-2009.\n<\/p>\n<p id=\"p_2\">      Grievance     of   the   petitioner   is   that     the<br \/>\nappellate      Court      without       affording         any<br \/>\nopportunity of hearing to the petitioner has<br \/>\ndecided the appeal and set aside the order<br \/>\ndated 09-02-2009. It is urged that this action of<br \/>\nthe appellate Court has greatly prejudiced the<br \/>\ncause of the petitioner as he had no opportunity<br \/>\nto defend he order dated 09-02-2009 which was<br \/>\nin his favour.\n<\/p>\n<p id=\"p_3\">      Learned counsel appearing for respondent\/<br \/>\nCorporation submits that before the appellate<br \/>\nCourt notices were tendered on the petitioner<br \/>\nby registered with acknowledgment due letter<br \/>\nand the appellate Court assuming that despite<br \/>\nof   service   of   notice,    the    workman    did      not<br \/>\nappear, proceeded to decide the case on merit.<br \/>\nIt is also urged that there is no inherent right<br \/>\non the petitioner to seek promotion to the post<br \/>\nof Lower Division Clerk when the petitioner<br \/>\n                                                            W.P. No.11158.09<\/p>\n<p>was found to be working as a labourer on daily<br \/>\nwages. It is urged that the approach of the<br \/>\nLabour      Court       in    directing          the     Municipal<br \/>\nCorporation to promote the petitioner on the<br \/>\npost of Lower Division Clerk was contrary to all<br \/>\ncanons of justice and was rightly intercepted<br \/>\nwith by the appellate Court.\n<\/p>\n<p id=\"p_4\">      Be that as it may, in this petition we have<br \/>\ncalled   upon      to   examine          as    to    whether        the<br \/>\npetitioner    was       afforded         any     opportunity           of<br \/>\nhearing by the Industrial Court in an appeal<br \/>\npreferred by respondent\/Corporation.\n<\/p>\n<p id=\"p_5\">      Paragraph 4 of the impugned order records<br \/>\na finding regarding the issuance of notice by<br \/>\nregistered    acknowledgment                   due     letter.     The<br \/>\nappellate    Court           drew    a     presumption             that<br \/>\ndespite of service of notice the workman did<br \/>\nnot turn up. The appellate Court accordingly<br \/>\nproceeded     to    hear       and       finally     decided        the<br \/>\nmatter in absence of the workman.\n<\/p>\n<p id=\"p_6\">      Paragraph 4 of the impugned order when<br \/>\nexamined      closely         would           reveal     that       the<br \/>\npresumption drawn by the appellate Court that<br \/>\nthe   workman       was having due                  knowledge          of<br \/>\nappeal is not correct. Admittedly, that the<br \/>\nnotice sent by registered acknowledgment due<br \/>\nwas not served and was returned unserved. The<br \/>\nIndustrial Court in our considered opinion was,<br \/>\ntherefore,        not        justified            in       drawing              a<br \/>\npresumption          of     service          of     notice         on       the<br \/>\npetitioner herein.\n<\/p>\n<p id=\"p_8\">    In    view        whereof           since          there       was        no<br \/>\neffective service of notice on the petitioner, the<br \/>\nfinding of service of notice recorded by the<br \/>\nIndustrial Court suffers from vice of perversity<br \/>\nand the order based on such finding is not<br \/>\nsustainable in the eyes of law. The impugned<br \/>\norder dated 19-08-2009 is, therefore, quashed.<br \/>\nThe matter is remitted to the Industrial Court,<br \/>\n                                            W.P. No.11158.09<\/p>\n<p>Jabalpur, for its decision on merit afresh after<br \/>\naffording    opportunity   of    hearing   to       the<br \/>\npetitioner   herein.
