BASANT, J.\n                     - - - - - - - - - - - - - - - - - - - - - - - - -\n                          Crl.R.P.Nos. 545 of 2005 &amp;\n                       2634, 2637 &amp; 2639  of   2006\n                     -  - - - - - - - - - - - - - - - - - - - - - - - -\n               Dated this the  18th day of   September, 2006\n\n\n                                     O R D E R\n<\/pre>\n<p id=\"p_1\">       These   revision     petitions   are   directed   against     concurrent<\/p>\n<p>verdicts   of     guilty,   conviction   and   sentence   in   four     prosecutions<\/p>\n<p>against  the  same  parties    for   the   offence   punishable  under   <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section<\/p>\n<p>138<\/a> of the N.I. Act.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     As   agreed   by   the   rival   contestants,   I   am   proceeding   to<\/p>\n<p>dispose of all the four revision petitions by a common order.<\/p>\n<p id=\"p_3\">       3.     These prosecutions relate to  four different cheques issued<\/p>\n<p>by the  petitioner herein to the complainant, each for an   amount of<\/p>\n<p>Rs. 36,133\/-.       The petitioner\/accused now faces a sentence of S.I.<\/p>\n<p>for a period of one month  and  to pay   an  amount of Rs. 36,133\/- as<\/p>\n<p>compensation  and in default  to undergo S.I. for a further period of<\/p>\n<p>two months in Crl.R.P. 545 of 2005.   In all the other   three cases,<\/p>\n<p>which are coming up for admission, the petitioner faces a sentence of<\/p>\n<p>S.I.  for a  period of  two months and to pay an amount of Rs.37,000\/-<\/p>\n<p>Crl.R.P.Nos. 545 of 2005, &amp;<br \/>\n2634, 2637 &amp; 2639  of   2006<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                            2<\/span><\/p>\n<p>each   as  compensation  and  in default  to  undergo  S.I. for  a period  of one<\/p>\n<p>month each.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       4.         The     signatures in the four cheques are not disputed.       The<\/p>\n<p>notices   of   demand,   though     duly     received   and   acknowledged,     did   not<\/p>\n<p>admittedly evoke any response.    A witness was  examined on the side of<\/p>\n<p>the  complainant in all the four cases and relevant documents were marked.<\/p>\n<p>The accused  attempted to advance a contention  that the  cheques were not<\/p>\n<p>issued for the due discharge of any legally enforcible   debt\/liability.<\/p>\n<p id=\"p_6\">       5.    The courts below, in these circumstances,   concurrently came to<\/p>\n<p>the conclusion that   the  complainant   has   succeeded   in   establishing  all<\/p>\n<p>ingredients of   the  offence punishable   under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the N.I.   Act<\/p>\n<p>in all the four prosecutions.        Accordingly they   proceeded to pass the<\/p>\n<p>impugned  concurrent judgments.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       6.       Called   upon   to   explain   the   nature   of   challenge   which   the<\/p>\n<p>petitioner wants to mount against the impugned concurrent judgments, the<\/p>\n<p>learned counsel for the petitioner   does not strain to assail the verdicts of<\/p>\n<p>Crl.R.P.Nos. 545 of 2005, &amp;<br \/>\n2634, 2637 &amp; 2639  of   2006<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                               3<\/span><\/p>\n<p>guilty and conviction on merits.     He only   prays   that   leniency   may<\/p>\n<p>be<\/p>\n<p>shown on the question  of sentence and some time may be granted  to the<\/p>\n<p>petitioner to discharge the liability and avoid the default sentence.<\/p>\n<p id=\"p_9\">       7.   Having gone through the impugned concurrent judgments in all<\/p>\n<p>the four prosecutions, I reckon that as an informed and fair stand taken by<\/p>\n<p>the learned counsel for the petitioner.    In the total  absence of challenge on<\/p>\n<p>any   specific   ground   against   the   verdicts   of   guilty   and   conviction,   I   am<\/p>\n<p>satisfied that it is not necessary for me to advert to the facts in any greater<\/p>\n<p>detail in this common order.     I am satisfied that the verdicts of guilty and<\/p>\n<p>conviction are absolutely justified and  unexceptionable.<\/p>\n<p id=\"p_10\">       8.   Coming to the question of sentence, I find merit in the prayer for<\/p>\n<p>leniency.    I have already adverted to the principles governing imposition<\/p>\n<p>of   sentence   in   a   prosecution   under   <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section   138<\/a>   of   the   N.I.   Act   in   the<\/p>\n<p>decision in  <a href=\"\/doc\/163658\/\" id=\"a_3\">Anilkumar   v.   Shammy<\/a>    (2002 (3) KLT 852).   In the facts<\/p>\n<p>Crl.R.P.Nos. 545 of 2005, &amp;<br \/>\n2634, 2637 &amp; 2639  of   2006<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                             4<\/span><\/p>\n<p>and circumstances of the case, I   do   not find   any     compelling  reasons<\/p>\n<p>which  can  persuade   this   court  to    insist   on    imposition   of   any  deterrent<\/p>\n<p>substantive sentence of imprisonment on the petitioner.   Leniency can be<\/p>\n<p>shown   on   the   question   of   sentence,   but   subject   to   the   compulsion   of<\/p>\n<p>ensuring  adequate and just  compensation to the victim\/complainant,    who<\/p>\n<p>has   been   compelled   to   wait   from   2001   (all   the   four   cheques   are   dated<\/p>\n<p>February and sMarch, 2001) and to fight three rounds of legal battle  for the<\/p>\n<p>redressal of  his  genuine grievances.    The challenge can succeed only  to<\/p>\n<p>the above extent.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">       9.  In the result:\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">       (a)  These revision petitions  are allowed in part.<\/p>\n<p id=\"p_15\">       (b)  The impugned verdicts of guilty and conviction of the petitioner<\/p>\n<p>in all the four prosecutions under <a href=\"\/doc\/1823824\/\" id=\"a_4\">Section 138<\/a> of the N.I. Act  are upheld.<\/p>\n<p id=\"p_16\">       )     But   the   sentence   imposed   is   modified   and   reduced.     In<\/p>\n<p>supersession of the  sentence imposed on the petitioner by the courts below,<\/p>\n<p>he is sentenced in all the four prosecutions to undergo imprisonment   till<\/p>\n<p>Crl.R.P.Nos. 545 of 2005, &amp;<br \/>\n2634, 2637 &amp; 2639  of   2006<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                            5<\/span><\/p>\n<p>rising of court.   He is further directed   under <a href=\"\/doc\/640437\/\" id=\"a_5\">Section 357(3)<\/a> Cr.P.C. to pay<\/p>\n<p>an     amount     of   Rs.45,000\/-(Rupees   forty     five   thousand   only)   each   as<\/p>\n<p>compensation  and in default to undergo S.I. for a period of 45 days each.<\/p>\n<p>If realised  the entire amount shall be released to the complainant.<\/p>\n<p id=\"p_17\">       10.  The petitioner shall appear  before the learned Magistrate on or<\/p>\n<p>before 30.11.2006 to serve the modified sentence hereby imposed.       The<\/p>\n<p>sentence shall not be executed till that date.      If the petitioner does   not so<\/p>\n<p>appear, the learned Magistrate shall thereafter   proceed to take  necessary<\/p>\n<p>steps  to execute the modified sentence hereby imposed.<\/p>\n<p id=\"p_18\">                                                        (R.
