SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tThe<br \/>\npresent petition arises out of interlocutory order passed by<br \/>\nRevisional Authority &#8211; Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat, by which, during the pendency of the Revision<br \/>\nApplication pending before it, Revisional Authority has refused to<br \/>\ngrant stay of the order dated 19\/07\/2010 passed by Collector, Surat<br \/>\nin Suo Motu Revision Case No.15\/2010.\n<\/p>\n<p id=\"p_1\">2.\t\tIt<br \/>\nis to be noted that the dispute is with respect to mutation entry and<br \/>\nas per settled proposition of law, mutation entry in the revenue<br \/>\nrecord does not confer any right, title and interest in the land in<br \/>\nquestion, in whose favour the entry has been mutated. As the Revision<br \/>\nApplication is still pending for final disposal before the Revisional<br \/>\nAuthority, any observation in the present proceedings may affect the<br \/>\ncase of the either parties and, therefore, the present petition is<br \/>\nnot entertained. However, in the facts and circumstances of the case,<br \/>\nRevisional Authority is hereby directed to finally decide and dispose<br \/>\nof the said Revision Application at the earliest but not later than<br \/>\nsix months from the date of receipt of writ of this order. It goes<br \/>\nwithout saying that the Revisional Authority shall decide and dispose<br \/>\nof the aforesaid Revision Application in accordance with law and on<br \/>\nmerits and without in any way being influenced by the impugned order<br \/>\nand\/or earlier order refusing to grant stay and any observations made<br \/>\nby the Revisional Authority may be treated as tentative while<br \/>\ndeciding the stay application only.\n<\/p>\n<p id=\"p_2\">\t\tWith<br \/>\nthis, the present petition is disposed of.
