Dabhi, learned Additional Public Prosecutor waives service<br \/>\nof notice of Rule on behalf of respondent-State of Gujarat.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\napplication has been filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure, 1973, for grant of bail in connection with FIR, being C.R.<br \/>\nNo. I-62 of 2008, registered at Koth Police Station, Taluka : Dholka,<br \/>\nDistrict : Ahmedabad, for offences punishable under <a href=\"\/doc\/1868826\/\" id=\"a_1\">Sections 498(A)<\/a>,<br \/>\n<a href=\"\/doc\/455468\/\" id=\"a_2\">307<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of the Indian Penal Code, <a href=\"\/doc\/751411\/\" id=\"a_4\">Sections 3<\/a> and <a href=\"\/doc\/209280\/\" id=\"a_5\">7<\/a> of the Dowry<br \/>\nProhibition Act and <a href=\"\/doc\/1655530\/\" id=\"a_6\">Sections 5<\/a>, <a href=\"\/doc\/632642\/\" id=\"a_7\">6<\/a> and <a href=\"\/doc\/132204\/\" id=\"a_8\">7<\/a> of the Domestic Violence Act.\n<\/p>\n<p id=\"p_3\">3.\t\tThe<br \/>\nallegation contained in the FIR is that the applicant, along with<br \/>\nother co-accused persons, is involved in the commission of the<br \/>\nabove-mentioned offences.\n<\/p>\n<p id=\"p_4\">4.\t\tMr.\n<\/p>\n<p id=\"p_5\">C.B. Dastoor, learned Advocate for the applicant has submitted that<br \/>\nthe applicant is innocent and he has been falsely implicated in the<br \/>\ncommission of the alleged offence. That, the daughter of the<br \/>\ncomplainant sustained injuries accidentally, while she was preparing<br \/>\nfood at night and this has been stated by her, in her Dying<br \/>\nDeclaration. That, the applicant and his parents themselves, took the<br \/>\ndaughter of the complainant to the hospital, to provide medical<br \/>\ntreatment to her.  That, the FIR is filed after a period of about 15<br \/>\ndays, with some ulterior motive. Even otherwise, the daughter of the<br \/>\ncomplainant has been discharged from the hospital, long back. That,<br \/>\nthere is no likelihood that the applicant may abscond, tamper with<br \/>\nthe evidence or pressurize the witnesses and, therefore, the<br \/>\napplication for bail may be favorably considered.\n<\/p>\n<p id=\"p_6\">5.\t\tMr.\n<\/p>\n<p id=\"p_7\">L.B. Dabhi, learned APP on behalf of the respondent-State has<br \/>\nstrongly opposed the grant of bail to the applicant.\n<\/p>\n<p id=\"p_8\">6.\t\tI<br \/>\nhave considered the submissions made by the learned Counsel for the<br \/>\nrespective parties, and perused the contents of the FIR as well as<br \/>\nother material on record. It appears from the narration in the FIR<br \/>\nthat the allegations levelled against the applicant are of a vague<br \/>\nand general nature.  It further transpires from the material on<br \/>\nrecord that the daughter of the complainant  has herself stated, in<br \/>\nher Dying Declaration, that she has received injuries accidentally,<br \/>\nwhile cooking. Considering the totality of the facts and<br \/>\ncircumstances of the case, as emerging from the material on record,<br \/>\nthe manner in which the offence is alleged to have taken place and<br \/>\nthe nature and gravity of the offence, the application deserves to be<br \/>\nallowed.\n<\/p>\n<p id=\"p_9\">7.\t\tFor<br \/>\nthe reasons stated above, the<br \/>\napplication is allowed. The applicant is ordered to be released on<br \/>\nbail in connection with FIR being C.R. No. I-62 of 2008 registered<br \/>\nwith Koth Police Station, Taluka : Dholka, District : Ahmedabad,  on<br \/>\nhis executing a personal bond to the tune of Rs.10,000\/- (Rupees Ten<br \/>\nThousand Only), with one solvent surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that<br \/>\nthe applicant:\n<\/p>\n<p id=\"p_10\">\ta)\tshall<br \/>\n\tnot take undue advantage of his \tliberty or abuse his liberty in any<br \/>\n\t\tmanner;\n<\/p>\n<p id=\"p_11\">\tb)\tshall<br \/>\n\tnot act in a manner injurious to \tthe \tinterest of the prosecution<br \/>\n\tor \ttamper with \tevidence or intimidate \twitnesses;\n<\/p>\n<p id=\"p_12\">\tc)<br \/>\n\t \tshall maintain law and order and shall \tcooperate fully with the<br \/>\n\tinvestigating \tofficers and shall make himself \tavailable \tfor<br \/>\n\tinvestigation, as and \twhenever directed;\n<\/p>\n<p id=\"p_13\">\td)\tshall<br \/>\n\tmark his presence before the \tInvestigating Officer of the concerned<br \/>\n\t\tPolice Station on the 15th and 30th day of<br \/>\n\t\tevery English calendar month, between \t10:00 am to<br \/>\n\t5:00 pm, till the\tcommencement of trial;\n<\/p>\n<p id=\"p_14\">\te)\tshall<br \/>\n\tnot leave the local limits of the \tState of Gujarat without the<br \/>\n\tprior \tpermission of the concerned Sessions \tJudge;\n<\/p>\n<p id=\"p_15\">\tf)\tshall<br \/>\n\tfurnish his residential address \tto \tthe \tInvestigating Officer and<br \/>\n\talso to \tthe \tcourt at the time of execution of \tthe \tbond and shall<br \/>\n\tnot change his\tresidential \taddress \twithout prior permission of<br \/>\n\tthis \tCourt;\n<\/p>\n<p id=\"p_16\">\tg)\tshall<br \/>\n\tsurrender his Passport, if any, \tto \tthe \tlower Court within a week.\n<\/p>\n<p id=\"p_17\">8.\t\tIf<br \/>\nthe applicant commits breach of any of the above conditions, the<br \/>\nconcerned Sessions Judge will be free to issue warrants or take<br \/>\nappropriate action in the matter.\n<\/p>\n<p id=\"p_18\">9.\t\tIt<br \/>\nis made clear that no observations made by this Court be construed as<br \/>\nhaving any bearing on the merits of the case, at the time of the<br \/>\ntrial. The trial Court will proceed in accordance with law,<br \/>\nunaffected and uninfluenced by any observations contained in this<br \/>\norder.\n<\/p>\n<p id=\"p_19\">10.\t\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p id=\"p_20\">11.\t\tRule<br \/>\nis made absolute.
