Justice T.R.RAMACHANDRAN NAIR\n\n Dated :17\/02\/2009\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR,J.\n                       -------------------------\n                   W.P ( C) No.4333 of 2009\n                      --------------------------\n             Dated this the 17th February,2009\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Presently the petitioner is aggrieved by the order of<\/p>\n<p>transfer Exhibit-P6 by which he has been transferred from<\/p>\n<p>the office of the Special Tahasildar, (LA)         Kollam to<\/p>\n<p>Kasargod.    The transfer is ordered pending further steps<\/p>\n<p>to take disciplinary action.\n<\/p>\n<p id=\"p_1\">     2.    Learned counsel for the petitioner submitted<\/p>\n<p>that even though there were some enquiries           already<\/p>\n<p>conducted    involving    the    petitioner     and Valuation<\/p>\n<p>Assistant,the allegations against them are not really<\/p>\n<p>correct. It is pointed out that going by Exhibit-P5, the<\/p>\n<p>Valuation Assistant was transferred only to Collectorate<\/p>\n<p>Accounts Wing, 13 kms away from the office of the Special<\/p>\n<p>Tahsildar (LA), Kollam.\n<\/p>\n<p id=\"p_2\">     3.    Petitioner is aggrieved by the order of transfer<\/p>\n<p>mainly on two grounds that he is innocent of the matter<\/p>\n<p>and secondly that his brother is serving in Indian Army<\/p>\n<p>W.P ( C) No.4333 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>and he is looking after their mother and his family.<\/p>\n<p>Earlier, when the petitioner was transferred out of Kollam<\/p>\n<p>district by Exhibit P6 (a), his superior officer had requested<\/p>\n<p>the Director of Survey and Land Records to extend his<\/p>\n<p>tenure of service to the next 3 years in Kollam district to<\/p>\n<p>enable him to look after their mother and the family.<\/p>\n<p id=\"p_3\">      4.     Presently, the petitioner has filed Exhibit-P7<\/p>\n<p>representation seeking for an accommodation in any of the<\/p>\n<p>vacancies in Kollam district so that he can look after his<\/p>\n<p>family including the mother.\n<\/p>\n<p id=\"p_4\">      5.     Going by Exhibit-P6, the order of transfer has<\/p>\n<p>been issued pending consideration of action against him. It<\/p>\n<p>is one issued in the exigencies of service. The proceedings<\/p>\n<p>show that there was a preliminary enquiry by the<\/p>\n<p>Inspection Vigilance Wing and it is mainly based on their<\/p>\n<p>report that the order of transfer has been passed. The said<\/p>\n<p>order cannot be said to be arbitrary or illegal. Therefore,<\/p>\n<p>the petitioner will have to join      the transferee station<\/p>\n<p>awaiting further orders in the matter.
