It is not<br \/>\n\ta case for reinstatement.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tadvocate Ms. Shah submitted that while passing aforesaid order on<br \/>\n\t18\/8\/2010, respondent no. 2 has not considered Government Resolution<br \/>\n\tdated 20\/7\/2007.  She submitted that initially suspension period is<br \/>\n\tto be remained continue upto ninety days.  Then it can be extended<br \/>\n\tfor further period of ninety days but there is no further extension<br \/>\n\torder passed by respondent.  Therefore, according to Government<br \/>\n\tResolution dated 20\/7\/2007, such suspension order is considered to<br \/>\n\tbe invalid.\n<\/p>\n<p id=\"p_3\">She<br \/>\n\talso relied upon suspension order which has been passed by<br \/>\n\trespondent page 19 dated 9\/6\/2008.  She also made clear that after<br \/>\n\tsix months, quantum of suspension allowance has been increased from<br \/>\n\t50% to 75%, but there was no extension of suspension order or period<br \/>\n\tof suspension is not extended. Therefore, present petition is filed.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\taffidavit in reply is not filed by respondent no. 2 who is authority<br \/>\n\thas power to suspend present petitioner.  In light of this back<br \/>\n\tground, petitioner is facing both i.e. Criminal Prosecution as well<br \/>\n\tas Departmental inquiry.  In such circumstances, he is under<br \/>\n\tsuspension though more than three years have passed.  Therefore, it<br \/>\n\tis better that let respondent no. 2 may re-examine matter in light<br \/>\n\tof Government Resolution dated 20\/7\/2007.  Then to pass appropriate<br \/>\n\treasoned order in accordance with law, which will meet end of<br \/>\n\tjustice between parties.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tlight of above facts and circumstances, it is directed to respondent<br \/>\n\tno. 2 to reconsider decision dated 18\/8\/2010 while considering<br \/>\n\tGovernment Resolution dated 20\/7\/2007.
