BASANT, J.\n\n              -------------------------------------------------\n\n                        B.A. NO. 4383 OF  2007\n\n              -------------------------------------------------\n\n              Dated this the   20th   day of July, 2007\n\n\n\n                                 ORDER\n<\/pre>\n<p id=\"p_1\">      The petitioner faces allegations, inter alia, under Sec.376<\/p>\n<p>of the <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>.     He is alleged to have kidnapped a girl aged about<\/p>\n<p>15 years and committed rape on her.    A crime was registered.\n<\/p>\n<p id=\"p_1\">Investigation   is   in   progress.       The   petitioner   apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p id=\"p_2\">      2.       The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the   petitioner   is   absolutely   innocent.       It   is   prayed   that<\/p>\n<p>directions under Sec.438 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. may be issued in favour<\/p>\n<p>of the petitioner.\n<\/p>\n<p id=\"p_3\">      3.  The learned Public Prosecutor opposes the application.\n<\/p>\n<p id=\"p_4\">The   crime   was   registered   as   early   as   on   3\/10\/06.     The<\/p>\n<p>petitioner had applied for anticipatory bail before  the  learned<\/p>\n<p>Sessions   Judge  and   by   order   dated   28\/4\/07,   the  learned<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">  B.A. NO. 4383 OF  2007                 -: 2 :-<\/span><\/p>\n<p>Sessions   Judge  had   allowed   the   said   petition   subject   to<\/p>\n<p>conditions.   The   petitioner   has   not   complied   with   the   said<\/p>\n<p>directions.       Suppressing   the   fact   that   the  learned   Sessions<\/p>\n<p>Judge, Alappuzha,  had passed an order of anticipatory bail dated<\/p>\n<p>28\/4\/07   in   Crl.M.P.No.1162\/07,   this   application   for   anticipatory<\/p>\n<p>bail   has   been   filed   before   this   Court,   it   is   submitted.     In   these<\/p>\n<p>circumstances,     the   extraordinary   equitable   discretion   under<\/p>\n<p>Sec.438   of   the   <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.   may   not   be   invoked   in   favour   of   such   a<\/p>\n<p>petitioner, submits the learned Public Prosecutor.\n<\/p>\n<p id=\"p_5\">       4.   Without   going   into   details,   I   am   satisfied   that   the<\/p>\n<p>petitioner   has   not   come   to   this   Court   with   sufficiently   clean<\/p>\n<p>hands   to   justify   the   prayer   for   invocation   of   the   extraordinary<\/p>\n<p>equitable   discretion.       The   learned   counsel   submits   that   the<\/p>\n<p>counsel   was   unaware   of   the   earlier   application   filed   by   the<\/p>\n<p>petitioner.   But it is difficult for me to assume that the petitioner<\/p>\n<p>did   not   know   about   the   same.       This   bail   application   has   been<\/p>\n<p>filed   with   a   specific   assertion   in   the   petition   that   no   earlier<\/p>\n<p>application had been moved before any court.\n<\/p>\n<p id=\"p_6\">       5.     I   am,   in   these   circumstances,   satisfied   that   the<\/p>\n<p>petitioner is not entitled to invoke the discretion under Sec.438<\/p>\n<p>of the <a href=\"\/doc\/445276\/\" id=\"a_3\">Cr.P.C<\/a>.      He must now resort to the ordinary and normal<\/p>\n<p>procedure   of   surrendering   before   the  Investigating   Officer  or<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">  B.A. NO. 4383 OF  2007             -: 3 :-<\/span><\/p>\n<p>the learned Magistrate having jurisdiction and then seek regular<\/p>\n<p>bail in the ordinary course.\n<\/p>\n<p id=\"p_7\">      6.   In the result, this bail application is dismissed; but with<\/p>\n<p>the   observation   that   if   the   petitioner   surrenders   before   the<\/p>\n<p>learned   Magistrate   and   seeks   bail,   after   giving   sufficient   prior<\/p>\n<p>notice   to   the   Prosecutor   in   charge   of   the   case,   the   learned<\/p>\n<p>Magistrate   must   proceed   to   pass   appropriate   orders   on   merits<\/p>\n<p>and expeditiously.\n<\/p>\n<p id=\"p_8\">                                                                 Sd\/-\n<\/p>\n<p id=\"p_9\">                                                  (R.
