SRI PANKAJ KAMBOJ, THE SUPERINTENDENT OF POLICE, HAZARIBAGH\n         (JHARKHAND)\n--------------------------------------------------------------------- RESPONDENTS\/OPPOSITE PARTIES\n                                                     ********\n<\/pre>\n<p id=\"p_1\">4        23.2.2011                            The Superintendent of Police, Hazaribagh has filed a<\/p>\n<p>                                show cause and produced a bankers Cheque in the name of Baldeo<\/p>\n<p>                                Mandal the petitioner in this case by which Rs. 71,881\/- is being<\/p>\n<p>                                paid to the petitioner by way of suspension allowance.<\/p>\n<p id=\"p_1\">                                              Learned counsel for the petitioner accepts the Cheque<\/p>\n<p>                                with an objection that the interest ought to be paid to the<\/p>\n<p>                                petitioner. Since there is no order for payment of interest in the<\/p>\n<p>                                main writ application, I do not think it proper to order payment of<\/p>\n<p>                                interest in the contempt application.\n<\/p>\n<p id=\"p_2\">                                              The second submission on behalf of the petitioner is<\/p>\n<p>                                that the suspension allowance should be paid from the date on<\/p>\n<p>                                which the petitioner was suspended i.e. 14.3.1993 to 28.10.2000.<\/p>\n<p id=\"p_3\">                                              On behalf of respondent no. 6, it is submitted that in<\/p>\n<p>                                fact the petitioner had remained in custody and was only released<\/p>\n<p>                                in 2008, at no point of time the petitioner informed the concerned<\/p>\n<p>                                authority regarding his incarnation and the authorities only got<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>         knowledge of this fact from the Superintendent of Jail, Bhagalpur<\/p>\n<p>         and, therefore, the petitioner cannot make any claim that he should<\/p>\n<p>         be granted suspension allowance for the aforesaid period.<\/p>\n<p id=\"p_4\">                     If the petitioner is aggrieved with the aforesaid<\/p>\n<p>         payment, he may take recourse the remedy available to him under<\/p>\n<p>         the law.
