BHAVADASAN, J\n                    ---------------------------\n                   C.R.P.No.193 OF 2009\n                -----------------------------------\n          Dated this the 23rd day of March, 2010\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">     Aggrieved by the order dated 24.12.2008 in AA.30\/03<\/p>\n<p>before the Appellate Authority, Under the Kerala (Land<\/p>\n<p>Reforms Act), the respondent come up in revision.<\/p>\n<p id=\"p_1\">     2.    The petitioner claims that he had obtained a<\/p>\n<p>purchase    certificate     dated     13.3.1991    in suo-moto<\/p>\n<p>proceedings No.1141\/78, 1142\/78, 1143\/1978            by order<\/p>\n<p>dated 10.3.1986 of Land Tribunal, Thrissur. The petitioner<\/p>\n<p>claims to be in absolute possession and enjoyment of 67<\/p>\n<p>cents of land consisting of 251\/2 cents of garden land in<\/p>\n<p>survey No.1285\/P 91\/2 cents Nilam in survey No.1284\/P and<\/p>\n<p>32 cents of Nilam in Survey No.1286\/1 and 2 of Kalloor<\/p>\n<p>Vadakkummury Village.        It is claimed that the purchase<\/p>\n<p>certificate was issued in pursuance of compromise, validly<\/p>\n<p>entered into between the petitioner and the first respondent<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRP No.193\/09                   2<\/span><\/p>\n<p>who was the land lord then.          It is claimed that first<\/p>\n<p>respondent was represented by a lawyer.            While the<\/p>\n<p>petitioner was enjoying the land conveyed to him, it is<\/p>\n<p>stated that the respondents began to interfere with his<\/p>\n<p>peaceful possession and enjoyment of the property and that<\/p>\n<p>constrained the petitioner to file O.S.148\/03 before the<\/p>\n<p>Munsiff Court, Chalakudy for an injunction. An interlocutory<\/p>\n<p>application was filed for interim relief and that was granted.<\/p>\n<p>Since the respondent in the I.A violated the order of<\/p>\n<p>injunction, proceedings initiated for that purpose also.<\/p>\n<p id=\"p_2\">     3. The first respondent who is the present Manager,<\/p>\n<p>filed a petition before the Appellate Authority against the<\/p>\n<p>order of granting purchase certificate by the Land Tribunal,<\/p>\n<p>Thrissur. There was a delay in filing the appeal, for which<\/p>\n<p>application for condonation of delay was filed. Despite the<\/p>\n<p>objection filed, without considering the objections from the<\/p>\n<p>side of the petitioner, delay was condoned and appeal was<\/p>\n<p>taken on file and later by the impugned order, the appeal<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRP No.193\/09                 3<\/span><\/p>\n<p>was remanded and directed the Land Tribunal for        fresh<\/p>\n<p>consideration.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">     4.    The learned counsel appearing for the petitioner<\/p>\n<p>pointed out that the main basis on which Appellate Authority<\/p>\n<p>persuaded to remand the case was absence of compromise<\/p>\n<p>deed among the record, based on which purchase certificate<\/p>\n<p>said to be have been issued. It is pointed out that records<\/p>\n<p>are now available and it contains the compromise entered<\/p>\n<p>into   between    the  parties  and   the  matter   requires<\/p>\n<p>reconsideration.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">     5. The learned counsel appearing for the respondent<\/p>\n<p>pointed that if it is being remanded for fresh consideration<\/p>\n<p>by the Appellate Authority for the issued raised by the<\/p>\n<p>appellant the objections raised by the respondent are also to<\/p>\n<p>be considered.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">     6.    The files made available before this court were<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">CRP No.193\/09                  4<\/span><\/p>\n<p>perused. This court had opportunity to go through the file in<\/p>\n<p>which compromise is seen recorded and said to have issued<\/p>\n<p>in favour of the petitioner. It is contended before this court<\/p>\n<p>by the respondent that the Manager who is said to have<\/p>\n<p>signed the compromise deed has not signed and filed<\/p>\n<p>compromise. The very compromise is in dispute. All these<\/p>\n<p>are matters which are to be considered by the appellate<\/p>\n<p>authority who is a fact finding body. In the light of the<\/p>\n<p>above fact it is only proper that appellate authority<\/p>\n<p>reconsider the issue.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">     7.    In the result, this revision petition is allowed,<\/p>\n<p>impugned order is set aside.       The Appellate Authority is<\/p>\n<p>directed to consider this matter afresh in the light of what<\/p>\n<p>has been stated above after hearing both sides.           The<\/p>\n<p>Appellate Authority is directed to keep the file in safe<\/p>\n<p>custody.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">                               P.
