BASANT, J.\n\n               -------------------------------------------------\n\n                          B.A.NO.3971 OF  2007\n\n               -------------------------------------------------\n\n                 Dated this the  5th day of July, 2007\n\n\n\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      The   petitioners   are   accused   2,   3   and   4   in   a   crime<\/p>\n<p>registered under Sec.302 of the <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>.   In the First Information<\/p>\n<p>Statement, the names   of the petitioners do appear; but there<\/p>\n<p>is   no   allegation   of   any   contumacious   act   against   them.         An<\/p>\n<p>F.I.R.   was   registered   as   early   as   on   31\/1\/06.     The   alleged<\/p>\n<p>incident had taken place on the night of 28\/1\/06.  In the F.I.R.,<\/p>\n<p>the 1st accused alone is arrayed as an accused.  The brother of<\/p>\n<p>the deceased had lodged the First Information Statement.<\/p>\n<p id=\"p_1\">      2.       The   crux   of   the   allegations   in   the   F.I.R.   is   that   the<\/p>\n<p>deceased,   the   accused   and   the   petitioners   had   together     in   a<\/p>\n<p>very   joyous   mood     in   an   autorikshaw   of   one   Jayakrishnan   to<\/p>\n<p>attend   the   festival   in   a   local   temple.       While   they   were<\/p>\n<p>travelling   in   the   autorikshaw,   there   was   some   disagreement<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.NO.3971 OF  2007                    -: 2 :-<\/span><\/p>\n<p>and   exchange   of   words   between   the   1st  accused   and   the<\/p>\n<p>deceased.       The   1st  accused   is   alleged   to   have   beaten\/hit   the<\/p>\n<p>deceased with a stone.   The deceased was left by the side of the<\/p>\n<p>road   in   the   injured   condition   and   all   others   went   home.       The<\/p>\n<p>next  morning  the   deceased  was found  lying  at the  place   where<\/p>\n<p>they left him.     He was removed to the hospital.     Subsequently,<\/p>\n<p>he   succumbed   to   the   injuries   after   a   surgery   was   allegedly<\/p>\n<p>performed   on   him.         Investigation   commenced   with   the   1st<\/p>\n<p>accused alone on the party array.   In the course of investigation,<\/p>\n<p>the   petitioners   have   been   arrayed   as   accused.       The   principal<\/p>\n<p>accused has been arrested and enlarged on bail.   The petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">       3.   The learned counsel for the petitioners submits that, in<\/p>\n<p>any   view   of   the   matter,   the   petitioners   do   not   deserve   to   be<\/p>\n<p>arrested and kept in custody to face an allegation under Sec.302<\/p>\n<p>of the <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>.     There is no specific overt act alleged to have been<\/p>\n<p>committed   by   any   of   the   petitioners   against   the   deceased.     At<\/p>\n<p>worst,   the   allegation   can   only   be   that   they   did   not   remove   the<\/p>\n<p>injured to the hospital after he suffered injuries allegedly at the<\/p>\n<p>hands of the 1st accused.   The learned counsel for the petitioners<\/p>\n<p>points out that no one assumed or anticipated the injuries to turn<\/p>\n<p>out   to   be   fatal,   even   going   by   the   prosecution   case.       For   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.NO.3971 OF  2007                     -: 3 :-<\/span><\/p>\n<p>alleged   indiscretion   committed   by   the   petitioners     &#8211;   that   of   not<\/p>\n<p>removing  a friend  who  had  suffered  some minor   injuries  to the<\/p>\n<p>hospital and  for having left  him at the place where he was and<\/p>\n<p>for having proceeded to their respective houses, they may not be<\/p>\n<p>compelled to suffer and endure  the undeserved trauma of arrest<\/p>\n<p>and   incarceration   for   a   capital   offence.         This   is   an   ideally   fit<\/p>\n<p>case   where   the   powers   under   Sec.438   of   the   <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.   can   and<\/p>\n<p>ought   to   be   invoked   in   favour   of   the   petitioners,   submits   the<\/p>\n<p>learned counsel for the petitioners.     The petitioners are willing<\/p>\n<p>to   co-   operate   with   the   Investigators.     They   shall   surrender<\/p>\n<p>before   the   Investigators   and   make   themselves   available   for<\/p>\n<p>interrogation for any length of time as  may be prescribed by this<\/p>\n<p>Court in the interests of justice reasonably, submits the learned<\/p>\n<p>counsel for the petitioners.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       4.       The   learned   Public   Prosecutor   does   not   make   any<\/p>\n<p>concession   obviously   because   of   the   gravity     of   the   allegation<\/p>\n<p>raised.       But   called   upon   to   point   out   and   explain   the   culpable<\/p>\n<p>and   contumacious   role   of   the   petitioners,   I   find     the   learned<\/p>\n<p>Public   Prosecutor   has   not   made   any   submission   which   can<\/p>\n<p>persuade   this   Court   to     feel   that   the   petitioners   will   even<\/p>\n<p>remotely have to face the  charge under Sec.302 of the <a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a>.   The<\/p>\n<p>autorikshaw   driver   is   the   only   other   person   other   than   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">B.A.NO.3971 OF  2007                   -: 4 :-<\/span><\/p>\n<p>accused   and   the   deceased   who   had   allegedly   witnessed   the<\/p>\n<p>occurrence.       His   statement   does   not   specifically   indicate   any<\/p>\n<p>overt   act   committed   by     the   petitioners   or   even   sharing   of   the<\/p>\n<p>common   intention\/common     object     to   cause   the   death   of   the<\/p>\n<p>deceased.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">      5.   I   am,   in   these   circumstances,   satisfied   that<\/p>\n<p>notwithstanding   the   fact   that   the   very   serious   allegation   &#8211;   of<\/p>\n<p>murder has been raised against the petitioners, they are entitled<\/p>\n<p>to   the   invocation   of   the   extraordinary   equitable   discretion<\/p>\n<p>available  to this  Court.     Appropriate conditions can, of course,<\/p>\n<p>be   imposed   in   the   interests   of   a   fair,   efficient   and   expeditious<\/p>\n<p>investigation.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">      6.       In   the   result,   this   petition   is   allowed.     Following<\/p>\n<p>directions are issued under Sec.438 of the <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>:<\/p>\n<p id=\"p_10\">      (i)   The   petitioners   shall   appear   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m. on 12\/7\/07.  They shall<\/p>\n<p>be   released   on   regular   bail   on   their   executing   bonds   for<\/p>\n<p>Rs.25,000\/- each with two solvent sureties each for the like sum<\/p>\n<p>to the satisfaction of the learned Magistrate.<\/p>\n<p id=\"p_11\">      (ii)     The   petitioners   shall   make   themselves   available   for<\/p>\n<p>interrogation before the  Investigating Officer  between 10 a.m.<\/p>\n<p>and 4 p.m. on 13\/7\/07, 14\/7\/07, 15\/7\/07 and 16\/7\/07.  During this<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">B.A.NO.3971 OF  2007                     -: 5 :-<\/span><\/p>\n<p>period   it   shall   be   open   to   the    Investigating   Officer  to   keep<\/p>\n<p>themselves in custody, interrogate them and effect recoveries, if<\/p>\n<p>any.  Thereafter, the petitioners shall make themselves  available<\/p>\n<p>for   interrogation   before   the  Investigating   Officer  on   all<\/p>\n<p>Mondays and Fridays between 10 a.m. and 12 noon until further<\/p>\n<p>orders.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">        (iii)       If   the   petitioners   do   not   appear   before   the   learned<\/p>\n<p>Magistrate as directed in clause (i),  directions issued above shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to<\/p>\n<p>arrest the petitioners and deal with them in accordance with law<\/p>\n<p>as if those directions were not issued at all;\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">        (iv)  If the petitioners were arrested prior to their surrender<\/p>\n<p>on 12\/7\/07 as directed in clause (i) above,  they shall be released<\/p>\n<p>on   their   executing   bonds   for   Rs.25,000\/-   each   without   any<\/p>\n<p>sureties undertaking to appear before the learned Magistrate on<\/p>\n<p>12\/7\/07.\n<\/p>\n<p id=\"p_16\">\n<p id=\"p_17\">                                                                Sd\/-<\/p>\n<pre id=\"pre_1\">\n\n\n\n\n                                                         (R.
