No.30101 of 2008\n               ---------------------------------\n        Dated, this the 3rd day of November, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner seeks a direction to the 2nd respondent,<\/p>\n<p>a Co-operative Society, which works with Government<\/p>\n<p>participation, not to fill up the post of Deputy General<\/p>\n<p>Manager    (Finance,  Accounts     and   Internal Audit)   by<\/p>\n<p>deputation. His contention is that he is, at present, holding<\/p>\n<p>charge of that post and as per Ext.P1 Government Order and<\/p>\n<p>Ext.P2 Feeder Category Rules, the method of recruitment to<\/p>\n<p>that post is by promotion. It is, accordingly, contended that<\/p>\n<p>the Feeder Category Rules does not authorise deputation.<\/p>\n<p id=\"p_1\">     2.    The 2nd respondent has filed a counter affidavit,<\/p>\n<p>placing therewith Ext.R2(a), which, according to it, is the<\/p>\n<p>Special Rules issued with the approval of the Registrar in<\/p>\n<p>supersession of Ext.P2.\n<\/p>\n<p id=\"p_2\">WP(C) No.30101\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             -2-<\/span><\/p>\n<p id=\"p_3\">     3.    The 2nd respondent passed resolution No.661 at<\/p>\n<p>its meeting held on 15th &amp; 16th July, 2008 to take recruits<\/p>\n<p>through deputation from the Finance Secretariat of the<\/p>\n<p>Government, to appoint a Deputy General Manager (F &amp; A)<\/p>\n<p>on deputation for a period of one year. Going by Ext.R2(a)<\/p>\n<p>Special Rules, promotion, deputation and direct recruitment<\/p>\n<p>are methods of appointment to the category of Deputy<\/p>\n<p>Manager (F&amp; I), serial No. 37 in Ext.R2(a).<\/p>\n<p id=\"p_4\">     4.    Section  80B(4)  of   the   Kerala  Co-operative<\/p>\n<p>Societies Act and Rule 185A of the Kerala Co-operative<\/p>\n<p>Societies Rules provide for deputation.    Section 80B and<\/p>\n<p>Rule 185 sub-rule (1) authorise the making of the feeder<\/p>\n<p>category by the Co-operative Society. That feeder category,<\/p>\n<p>on approval, will bind the establishment also. Even if the<\/p>\n<p>feeder categories are thus prescribed, deputation would be<\/p>\n<p>available as a method of recruitment only in situations,<\/p>\n<p>which warrant such a course, having regard to Rule 185A.<\/p>\n<p>WP(C) No.30101\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -3-<\/span><\/p>\n<p>Whatever that be, while deputation cannot be used as a<\/p>\n<p>weapon to deprive a legitimate aspiration for being<\/p>\n<p>considered for promotion in the case in hand, the<\/p>\n<p>uncontroverted plea of the 2nd respondent, in paragraph 4 of<\/p>\n<p>the counter affidavit, is that the petitioner is only an<\/p>\n<p>Assistant Manager and he is, therefore, not in the feeder<\/p>\n<p>category for promotion to the post of Deputy General<\/p>\n<p>Manager.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">     5.    Going by Ext.R2(a), Managers constitute the<\/p>\n<p>feeder category to the post of Deputy General Manager.<\/p>\n<p>Assistant Managers constitute the feeder category to the<\/p>\n<p>post of Deputy Manager, which category, in turn is the<\/p>\n<p>feeder category for the posts of Managers. Therefore, going<\/p>\n<p>by the counter affidavit, the petitioner is two steps below<\/p>\n<p>the feeder category for the post of Deputy General Manager.<\/p>\n<p>With that factual situation, even if it is taken that Ext.P2 is<\/p>\n<p>the Feeder Category Rules in vogue, Managers form the<\/p>\n<p>WP(C) No.30101\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                 -4-<\/span><\/p>\n<p>feeder category for consideration for promotion to the post<\/p>\n<p>of Deputy General Manager. As already noticed, in spite of<\/p>\n<p>a reply affidavit is being placed on record, the contention of<\/p>\n<p>the 2nd respondent that the petitioner is not in the feeder<\/p>\n<p>category, he being only an Assistant Manager, is not<\/p>\n<p>controverted.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">     6.    With that scenario, the petitioner has no locus to<\/p>\n<p>challenge any proposal for deputation to the category of<\/p>\n<p>Deputy General Manager (F &amp; A) in the establishment of the<\/p>\n<p>2nd respondent, since, the petitioner cannot be conceived to<\/p>\n<p>be a person aggrieved by any such course of action.
