It is<br \/>\nalso stated that the appellant is not having any means of her<br \/>\nlivelihood and unable to contest the case and to maintain herself.\n<\/p>\n<p id=\"p_1\">      A reply has been filed by respondent in which the aforesaid<br \/>\nallegations have been denied. It is stated in the reply that the<br \/>\nappellant is having half acre of land at village Juwadi, Tehsil and<br \/>\nDist. Singrauli and she is earning Rs.4,000\/- per month by selling<br \/>\nmilk of she goats and cows etc. So no maintenance amount is<br \/>\nrequired. It is also stated that in the proceedings under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section<br \/>\n125<\/a> of Code of Criminal Procedure, an amount of Rs.500\/- has<br \/>\nbeen fixed by way of maintenance to the appellant and Rs.300\/-<br \/>\ntowards Kumari Sarita Kushwaha, daughter of the parties.\n<\/p>\n<p id=\"p_2\">      It is submitted by the appellant that looking to the salary of<br \/>\nthe respondent, an adequate amount towards maintenance<br \/>\npendente lite be allowed.\n<\/p>\n<p id=\"p_3\">      The learned counsel appearing for the respondent opposed<br \/>\nthe prayer and reiterated the contentions. From the perusal of the<br \/>\nrejoinder filed by the appellant, it appears that she has denied all<br \/>\nthe allegations of the reply. It is stated by the appellant that the<br \/>\nrespondent is earning Rs.25,000\/- per month. From the perusal of<br \/>\nthe pay slip, filed by the respondent, it appears that the<br \/>\nrespondent is getting Rs.30,522.55 per month.Out of this, there<br \/>\nare deductions of Rs.17,929.85 towards various loans etc. of the<br \/>\nrespondent. However, the net pay of the respondent is<br \/>\nRs.12,593\/- as is appearing from the perusal of the pay slip of the<br \/>\nmonth of Feb.2010. However, in the month of March, 2010, the<br \/>\n                                  FA No.924\/2007<\/p>\n<p>                 Kusumdevi                              Brahaspat<\/p>\n<p>      net pay was Rs.14,187\/- and in the month of June, his net pay<br \/>\n      was Rs.18,668.\n<\/p>\n<p id=\"p_4\">             Considering the aforesaid, we find that the appellant is<br \/>\n      having no means of her livelihood and looking to the status of the<br \/>\n      respondent, she is entitled for adequate maintenance pendente<br \/>\n      lite and also litigation expenses. We find it appropriate to allow<br \/>\n      Rs.5,000\/- towards litigation expenses and Rs.5,000\/- towards<br \/>\n      maintenance pendente lite per month.\n<\/p>\n<p id=\"p_5\">             The aforesaid amount shall be payable by the respondent<br \/>\n      from the next month and shall be payable on or before 10 th of<br \/>\n      every month to the appellant. The amount shall be paid by the<br \/>\n      respondent to the appellant by a pay order payable in the name of<br \/>\n      Smt.Kusumdevi or he may deposit the said amount before the trial<br \/>\n      Court at Waidhan, Dist. Sidhi.\n<\/p>\n<p id=\"p_6\">              So far as arrears are concerned, the respondent shall<br \/>\n      deposit all the arrears from the date of filing of the application I.e.<br \/>\n      10th December, 2007 in equal ten instalments payable every<br \/>\n      month by the respondent to the appellant.\n<\/p>\n<p id=\"p_7\">             So far as litigation expenses are concerned, the said<br \/>\n      amount shall be deposited by the respondent within a period of 15<br \/>\n      days from today.\n<\/p>\n<p id=\"p_8\">             The amount of maintenance paid to the appellant under<br \/>\n      <a href=\"\/doc\/1056396\/\" id=\"a_2\">Section 125<\/a> of the Code of Criminal Procedure shall be given due<br \/>\n      adjustment to the respondent.\n<\/p>\n<p id=\"p_9\">             Certified copy as per Rules.\n<\/p>\n<pre id=\"pre_1\">             (Krishn Kumar Lahoti)                      (Sanjay Yadav)\n                    Judge                                   Judge\n\n\n\nJLL\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Kusumdevi vs Brahaspat on 26 July, 2010 FA No.924\/2007 Kusumdevi Brahaspat 26.7.2010.
