Justice S.SIRI JAGAN\n\n Dated :18\/08\/2008\n\n O R D E R\n                      S.SIRI JAGAN, J\n               ==================\n                 W.P(C)No.17773 of 2008\n               ==================\n        Dated this the 18th day of August, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner is challenging proceedings under the<\/p>\n<p>Securitisation and Reconstruction of Financial Assets and<\/p>\n<p><a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>, 2002, initiated by<\/p>\n<p>the respondents for coercive recovery of loan amounts due<\/p>\n<p>from the petitioner.     However, the petitioner does not<\/p>\n<p>dispute the liability to pay or the quantum. The petitioner<\/p>\n<p>only seeks permission to pay off the amounts in<\/p>\n<p>instalments. This is opposed by the counsel for the bank.<\/p>\n<p id=\"p_1\">     2. However, taking a lenient view, I dispose of this<\/p>\n<p>writ petition with the following directions.<\/p>\n<p id=\"p_2\">     The petitioner shall pay an amount of Rs. 2 lakhs<\/p>\n<p>within one month. The balance amount shall be paid in<\/p>\n<p>six equal monthly instalments starting from 1.11.2008.<\/p>\n<p>Subsequent instalments shall be paid on the 1st working<\/p>\n<p>day of every succeeding month. If the petitioner pays the<\/p>\n<p>above amounts in time without default, proceedings under<\/p>\n<p>the Act shall be kept in abeyance.
