Challenge       in    this     writ     petition   is against<\/p>\n<p>proceedings    initiated       under       the     provisions  of  the<\/p>\n<p>Securitization and Reconstruction of Financial Assets and<\/p>\n<p><a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>, 2002 <a href=\"\/doc\/52229129\/\" id=\"a_1\">(SARFAESI Act<\/a>),<\/p>\n<p>consequent to default committed by the petitioner in<\/p>\n<p>repayment of a housing loan availed form the respondent<\/p>\n<p>Bank. The loan in question was availed in the year 2003, to<\/p>\n<p>the tune of Rs.1,50,000\/-. The petitioner committed default<\/p>\n<p>in payment of the monthly installments and recovery from<\/p>\n<p>the petitioner&#8217;s salary is being continued as evidenced from<\/p>\n<p>Ext.P2. Now coercive steps for taking over possession of<\/p>\n<p>the secured asset is being persued on issuing Ext.P1 notice.<\/p>\n<p id=\"p_1\">     2.   Eventhough various grounds are raised against<\/p>\n<p>the proceedings, the petitioner confines his prayer to the<\/p>\n<p>extent of permitting regularization of the loan account, by<\/p>\n<p>W.P.(C)No. 35744 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -2-<\/span><\/p>\n<p>paying the defaulted amounts along with interest and<\/p>\n<p>expenses if any liable. Learned standing counsel appearing<\/p>\n<p>for respondent submitted that an amount of about<\/p>\n<p>Rs.90,000\/- is due towards defaulted arrears.       Since the<\/p>\n<p>loan account is in chronic default the respondent is not<\/p>\n<p>favoring in permitting any extended period for wiping off<\/p>\n<p>the liability.\n<\/p>\n<p id=\"p_2\">      3.    Having considered facts and circumstances of the<\/p>\n<p>case, I am of the opinion that the petitioner can be<\/p>\n<p>permitted to regularize the account within a reasonable<\/p>\n<p>time on payment of the defaulted amounts in installments.<\/p>\n<p id=\"p_3\">      4.    Accordingly the petitioner is directed to make<\/p>\n<p>payment of the entire amounts due pertaining to the<\/p>\n<p>defaulted installments along with interest\/penal interest and<\/p>\n<p>expenses if any liable, in four (4) equal monthly installments<\/p>\n<p>starting from 15.01.2010 and on or before the 15th day of<\/p>\n<p>the succeeding months. If arrears in the loan account is<\/p>\n<p>cleared payment as directed above, the respondent shall<\/p>\n<p>permit the petitioner to continue payment of future<\/p>\n<p>W.P.(C)No. 35744 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -3-<\/span><\/p>\n<p>installments in accordance with the original schedule of<\/p>\n<p>repayment.\n<\/p>\n<p id=\"p_4\">      5.    It is made clear that on the event of failure to pay<\/p>\n<p>any of the installments as stipulated as above, the Bank will<\/p>\n<p>be free to proceed with further steps pursuant to the<\/p>\n<p>notices already issued, and on any such event the petitioner<\/p>\n<p>will be precluded from raising any subsequent challenge<\/p>\n<p>against such proceedings either before this court or before<\/p>\n<p>any other forum.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                          C.K.
