JOSEPH, J.\n                       ------------------------------\n                     W.P(c) No. 31453 of 2008\n                       ------------------------------\n               Dated this the 30th day of October, 2008\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">           Third respondent in this writ petition is deleted from party<\/p>\n<p>array as requested by the petitioner. Respondents 1 and 2 appeared<\/p>\n<p>through counsel.\n<\/p>\n<p id=\"p_1\">     2.    Heard both sides.\n<\/p>\n<p id=\"p_2\">     3.    Petitioner is the first defendant in O.S. No.345 of 2008 of<\/p>\n<p>the Sub Court, Thalassery. On the request of respondents 1 and 2,<\/p>\n<p>Advocate Commissioner was appointed in that case to report on<\/p>\n<p>matters requested in the application, including taking inventory of<\/p>\n<p>movables, immovable properties and accounts etc. Advocate<\/p>\n<p>Commissioner inspected the premises on 10\/10\/2008 and 11\/10\/2008<\/p>\n<p>and thereafter, requested that police assistance be given to him for<\/p>\n<p>further inspection. According to the learned counsel for petitioner,<\/p>\n<p>though petitioner had appeared in that case, learned sub judge ordered<\/p>\n<p>police assistance as per order in I.A No.3674 of 2008 without even<\/p>\n<p>giving notice of the application to the petitioner. The Advocate<\/p>\n<p>Commissioner gave memo to the petitioner intimating further<\/p>\n<p>W.P(c) No. 31453\/ 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>inspection on 28\/10\/2008.\n<\/p>\n<p id=\"p_3\">       4.     As per order dated 24\/10\/2008, this court after hearing the<\/p>\n<p>learned counsel for petitioner had directed that the order granting<\/p>\n<p>police assistance to the Advocate Commissioner will stand suspended<\/p>\n<p>till 28\/10\/2008. Counsel for petitioner had then undertaken that the<\/p>\n<p>petitioner will cooperate with the Advocate Commissioner and produce<\/p>\n<p>whatever records are available for inspection of the Advocate<\/p>\n<p>Commissioner and also comply with all other directions of the<\/p>\n<p>Advocate Commissioner. Counsel for petitioner states that whatever<\/p>\n<p>records available were produced for the inspection of the advocate<\/p>\n<p>commissioner. His grievance is that the order giving police assistance<\/p>\n<p>was without notice to the petitioner. Counsel pointed out that though<\/p>\n<p>the second defendant (who is not a party in this proceeding) had filed<\/p>\n<p>applications      for review   of   the  order   appointing    Advocate<\/p>\n<p>Commissioner and to recall the order for police assistance, learned Sub<\/p>\n<p>Judge closed the application seeking recall of the order for police<\/p>\n<p>assistance.\n<\/p>\n<p id=\"p_4\">       5.     It is contended by the learned counsel for respondents 1<\/p>\n<p>W.P(c) No. 31453\/ 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     3<\/span><\/p>\n<p>and 2 that the        inspection of the Advocate commissioner is not<\/p>\n<p>completed. It is contended that the order of the learned Sub Judge<\/p>\n<p>granting police assistance is still in force and what is closed is an<\/p>\n<p>application filed by the second defendant in the suit to recall that order.<\/p>\n<p id=\"p_5\">       6.     In the facts and circumstances and on hearing the counsel<\/p>\n<p>on both sides, I am of the view that it is not necessary to keep this writ<\/p>\n<p>petition pending since the application to review the order appointing<\/p>\n<p>Advocate Commissioner is pending consideration before the learned<\/p>\n<p>Sub Judge. So far as the complaint of the petitioner that police<\/p>\n<p>assistance was ordered without notice to him is concerned, it will be<\/p>\n<p>open to any of the parties aggrieved in that regard to seek review of the<\/p>\n<p>order granting police assistance, if they are otherwise entitled to that<\/p>\n<p>course, and if any such request is made, learned Sub Judge will<\/p>\n<p>consider that request on its merit.\n<\/p>\n<p id=\"p_6\">       7.     It is made clear that the observations contained in the<\/p>\n<p>interim order passed by this court on 24\/10\/2008 will be confined to<\/p>\n<p>the disposal of the request for interim relief in this petition. Learned<\/p>\n<p>Sub Judge shall dispose of the application pending or moved before<\/p>\n<p>W.P(c) No. 31453\/ 2008<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                    4<\/span><\/p>\n<p>him untrammeled by any of the observations contained in the interim<\/p>\n<p>order or in this judgment. It will be open to the petitioner to raise<\/p>\n<p>whatever contentions he has raised in this writ petition before the<\/p>\n<p>learned Sub Judge if the petitioner is otherwise entitle to that course.<\/p>\n<p id=\"p_7\">       With the above observations, the writ petition is closed.<\/p>\n<p id=\"p_8\">                                THOMAS P.
