            The vehicle belonging to petitioner was<\/p>\n
allegedly seized for infraction of the provisions of the<\/p>\n
Kerala Protection of River Banks (Protection and Regulation<\/p>\n
of removal of sand) Act, 2002. He has approached the<\/p>\n
District Collector, the 1st respondent for release of the<\/p>\n
vehicle and is aggrieved by the non-consideration of his<\/p>\n
request as such.\n<\/p>\n
            2. The nature of the power exercised by the<\/p>\n
District Collector and the parameters within which such<\/p>\n
power is to be exercised have been dealt with by a Bench<\/p>\n
of this Court in Sanjayan Vs.Tahasildar [2007 (4) KLT<\/p>\n
597 . Principles have been reiterated in Subramanian Vs.<\/p>\n
State of Kerala [2009 (1) KLT 77).\n<\/p>\n
            3.   In   Subramanian’s    case,   this  Court<\/p>\n
observed that the power exercised by the District Collector<\/p>\n
W.P ( C) No.14807 of 2009<\/p>\n

is under Section 23 of the Kerala Protection of River Banks<\/p>\n
(Protection and Regulation of removal of sand) Act, 2002.<\/p>\n
It is also, therefore, quasi judicial in character. Reasons<\/p>\n
will have to be given by the District Collector while passing<\/p>\n
orders under Section 23 of the Kerala Protection of River<\/p>\n
Banks (Protection and Regulation of removal of sand) Act,<\/p>\n
2002 read with Rules 27 and 28 of Kerala Protection of<\/p>\n
River Banks and Regulation of Removal of Sand Rules<\/p>\n
2002. If there is a contention that the transportation of<\/p>\n
sand was supported by a pass issued by the competent<\/p>\n
local authority, that has to be referred.      The materials<\/p>\n
which are placed before the District Collector by the<\/p>\n
subordinate officials shall also be looked into. This has<\/p>\n
been indicated in Subramanian’s case. If motion is made<\/p>\n
by the owners of the vehicle for release of the vehicle on<\/p>\n
interim custody, it will be subject to the conditions<\/p>\n
mentioned in paragraph 58 of the said judgment. The<\/p>\n
District Collector may pass orders on such applications for<\/p>\n

interim custody. (The scope of the directions contained in<\/p>\n
Subramanian’s case       have later been dealt with in WPC<\/p>\n
No.14319\/2009.         Appropriate clarifications have been<\/p>\n
issued in the latter judgment). Further conditions can be<\/p>\n
imposed in the course of release of the vehicle as<\/p>\n
indicated by this Court in Shoukathali Vs. Tahasildar<\/p>\n
[2009 (1) KLT 640].\n<\/p>\n
              4.   Keeping in mind the observations made<\/p>\n
in the judgments in Shoukathali’s case and Subramanian’s<\/p>\n
case and other judgment which have been referred to, the<\/p>\n
1st respondent in this case shall pass final orders in the<\/p>\n
matter of confiscation\/release of the vehicle in question<\/p>\n
after conducting an appropriate enquiry, as early as<\/p>\n
possible, at any rate, within three months from the date of<\/p>\n
receipt of a copy of this judgment.\n<\/p>\n
              5.   In the meanwhile, if a motion is made by<\/p>\n
the petitioner for interim custody of the vehicle, then<\/p>\n
orders shall be passed by the District Collector on the<\/p>\n

application for interim custody of the vehicle, within three<\/p>\n
weeks from the date of receipt of a copy of this judgment<\/p>\n
in the light of the observations contained in Shoukathali<\/p>\n
Vs. Tahasildar [2009 (1) KLT 640], Subramanian Vs. State<\/p>\n
of Kerala [2009 (1) KLT 77) and the judgment in WPC<\/p>\n
No.14319 of 2009.\n<\/p>\n
              The writ petition is disposed of as above. The<\/p>\n
petitioner shall produce copies of the judgments in<\/p>\n
Subramanian, Shoukathali and W.P (C ) No.14319 of 2009<\/p>\n
along with the certified copy of this judgment before the<\/p>\n
