Siswan, District Siwan.\n<\/p>\n<p id=\"p_1\">                                                                  &#8230;&#8230;&#8230;Petitioner<br \/>\n                                     Versus<br \/>\nTHE STATE OF BIHAR<br \/>\n                                                                  &#8230;&#8230;Opposite Party<\/p>\n<p>03\/-   30-09-2010             Heard learned counsel for the petitioner and<\/p>\n<p>                      Additional Public Prosecutor for the State.<\/p>\n<p id=\"p_2\">                              This is an application under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the<\/p>\n<p>                      Code of Criminal Procedure seeking quashing of order<\/p>\n<p>                      dated 5.1.2009 passed by Chief Judicial Magistrate, Siwan<\/p>\n<p>                      in Pachrukhi P.S. Case No. 99 of 2004 taking cognizance<\/p>\n<p>                      for the offences under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Sections 302<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_2\">307<\/a>, <a href=\"\/doc\/1540253\/\" id=\"a_3\">326<\/a>, <a href=\"\/doc\/1208971\/\" id=\"a_4\">353<\/a>, <a href=\"\/doc\/94452\/\" id=\"a_5\">414<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_6\">34<\/a><\/p>\n<p>                      of the Indian Penal Code and 25(1-B) A, 26\/27 of the <a href=\"\/doc\/1934415\/\" id=\"a_7\">Arms<\/p>\n<p>                      Act<\/a>.\n<\/p>\n<p id=\"p_3\">                              Initially, main contention of the learned counsel for<\/p>\n<p>                      the petitioner was that petitioner was neither named in the<\/p>\n<p>                      case nor there is any possibility of involvement of any<\/p>\n<p>                      person other than named and there is also no material<\/p>\n<p>                      against petitioner brought during investigation.<\/p>\n<p id=\"p_4\">                               However, taking into consideration that case<\/p>\n<p>                      before the court below is ready for hearing on the point of<\/p>\n<p>                      charge, learned counsel for the petitioner seeks permission<\/p>\n<p>                      to withdraw this application with a liberty to agitate all his<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -2-<\/span><\/p>\n<p>          points before the trial court, who shall consider the materials<\/p>\n<p>          and pass appropriate order in accordance with law.<\/p>\n<p id=\"p_5\">                   Permission is granted.\n<\/p>\n<p id=\"p_6\">                   Accordingly, this application stands dismissed as<\/p>\n<p>          withdrawn.\n<\/p>\n<p id=\"p_7\">\n<pre id=\"pre_1\">Praveen                                     (Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ayub Khan vs The State Of Bihar on 30 September, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
