the original petitiO_ner:_’fi1ed’:the’Writ vpetdition contending<\/p>\n
that  had .p.etition schedule property<\/p>\n
from  R.  a Deed of Sale dated<\/p>\n
 8.1151989. VTheH””first respondent had issued a<\/p>\n
 preliminary’notification proposing to acquire the said<\/p>\n
  by the \ufb01nal noti\ufb01cation issued by the<\/p>\n
V –V State Goyernment. Arun R Rawal chailenged the said<\/p>\n
0′ 0jI1oti\ufb01_cation in W.P.2311’7\/1982 before this Court. This<\/p>\n
‘   by its order dated 18.10.1990 quashed the \ufb01nal<\/p>\n
noti\ufb01cation dated 30.11.1977 only in so far as the<\/p>\n
petition schedule land is concerned. Thereafter, the<\/p>\n
State Government issued a noti\ufb01cation under<\/p>\n

Sec.48[1) of the Land Acquisition Act<\/a> dated 25.5.1994
\nwithdrawing the said land from acquisition,”-.I\u00bbt is<\/p>\n
contended that the petition schedule <\/p>\n
allotted by the BDA in favour of the 211?’ <\/p>\n
7.11.1997. The BDA executedlvailsiale\u00ab.Vd’eed”i–n_.:i*eVspect.o\u00abf<\/p>\n
the said land in favoureof the~-A.l2\ufb02–d <\/p>\n
6.8.2002. The 2nd respondentllin_turnsoldl  property<\/p>\n
in favour of 3″?  aiddeed  sale dated
\n31.8.2005. Thereforeathhe ;\u00a7\u00a7;tit1c’;r1\u00e9rt7has filed this writ<\/p>\n

3. During the pendency of the writ petition,<\/p>\n
Msomashekhar Rao passed away. Therefore”vhispllegal<\/p>\n

4. I have heard Sri S V   <\/p>\n
for the petitioners and Sri B:’V._gShankaranarajfmia: Raolgil<\/p>\n
learned Counsel Vfer’ resp0ndent._ No.1′,-.  B K
\nManjunath, learned  i’or_.:re,spondent No.2 and<\/p>\n
Sri M S Bha.gwat_’..– learnedflotirilselp forjrespondent No.3.<\/p>\n
 lira? the petitioners would
\ncontend that ‘:.jS.om.ashekhara Rao purchased the<\/p>\n
petition schedule ‘property from its previous owner<\/p>\n
  Rayval  deed of sale dated 8.11.1989. It is<\/p>\n
 _oi__1ly he came to know that certain<\/p>\n
ac-qui-sitiovh proceedings are pending in respect of the<\/p>\n
 ~  land. Arun R Rawal had filed a Writ petition ‘before<\/p>\n
 court in W.P.23117\/82 challenging the acquisition<\/p>\n
 proceeding. This Court quashed the final noti\ufb01cation in<\/p>\n
so far as the petition schedule property is concerned.<\/p>\n
During the pendency of the writ petiton, Arun R Rawal<\/p>\n

Is<\/p>\n
sold the property in favour of M Somashekhar Rao. The<\/p>\n
State Government issued a notification<\/p>\n
Sec.48[1) of the Land Acquisition Act<\/a> as  ~<\/p>\n
‘D’ dated 25.5.1994 withdrawing  the iiigibin  ”<\/p>\n
acquisition. Thus, M.Somashekhar  <\/p>\n
absolute owner and in possessiofn __of

\nallotting the said site  respondent
\nbecause the  had  Vporihivterest over the<\/p>\n
petition schgedule  2116 respondent<\/p>\n
has no:,:lrigh’tl;’ti_tIeAV  inter.e_st_ over the petition schedule
\nproperty.”‘hVC4’couidnot “sold the same in favour of<\/p>\n
3rd respondent;-. __Therefore, the allotment letter issued<\/p>\n
 ‘=.__in fayour of 21%’ respondent and the<\/p>\n
 executed by the BDA in favour<\/p>\n
 of 2% re’sp’oiident and the sale deed executed by the<\/p>\n
if ” <  respondent in favour of 3" respondent in respect of<\/p>\n
.l_j;pe't–ition schedule property requires to be quashed.<\/p>\n
6. On the other hand, the learned Advocates<\/p>\n
appearing for 23d and 3″ respondents would contend<\/p>\n
it<\/p>\n
that the petition schedule property did not belong to<\/p>\n
Arun R Rawal. It was the property of the BDA. The'”BDA<\/p>\n
allotted the site in question in favour <\/p>\n
respondent. The 2nd respondent has sold    d <\/p>\n
favour of 3rd respondent. It is  j;argL5;4ed.’: <\/p>\n
property described in the noti\ufb01catiori at fdinezgureg  <\/p>\n
and the sale deed at AnneXuree\u00ab.i:A’   different.
\nNeither boundaries V  _tl9te ;_p1′”operty__ described in
\nAnnexures ‘D’ and  are rx1eas”urerrrents tally with<\/p>\n
each 0ther74.The1\u20ace_i.es ~serious title ‘dispute in respect of<\/p>\n

8. The main contention of the petitioners is that<\/p>\n
having regard to the quashing of the \ufb01nal notification as<\/p>\n
2<\/span><\/p>\n
merits and in accordance with law without being in\ufb02uenced<\/p>\n
by the observations made in this order. Registry is<\/p>\n
to return the original records to the learned Cou\ufb01sei *<\/p>\n
