Sethi\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">SETHI,J.\n<\/p>\n<p id=\"p_1\">\tLeave granted.\n<\/p>\n<p id=\"p_2\">\tAggrieved by the framing of charges against him under <a href=\"\/doc\/1279834\/\" id=\"a_1\">Sections<br \/>\n376<\/a>, <a href=\"\/doc\/1185693\/\" id=\"a_1\">511<\/a>, <a href=\"\/doc\/513777\/\" id=\"a_2\">451<\/a> and <a href=\"\/doc\/203036\/\" id=\"a_3\">354<\/a> of the Indian Penal Code, the respondent-accused<br \/>\nfiled a revision petition in the High Court which was allowed vide the<br \/>\norder impugned in this appeal by quashing the charges framed against<br \/>\nhim.  The appellant-complainant-prosecutrix has filed this appeal<br \/>\nsubmitting that the impugned order is against the provisions of law as<br \/>\nthe High Court could not prevent the holding of trial by sitting in<br \/>\nappeal against the order of framing of charge by sifting and weighing<br \/>\nthe evidence recorded during the investigation.\n<\/p>\n<p id=\"p_3\">\tWe find substance in the submission made on behalf of the<br \/>\nappellant.  The revision power under<a href=\"\/doc\/1569253\/\" id=\"a_4\"> the Code<\/a> of Criminal procedure<br \/>\ncannot be exercised in a routine and casual manner.  While exercising<br \/>\nsuch powers the High Court has no authority to appreciate the evidence<br \/>\nin the manner as the trial and the appellate courts are required to do.<br \/>\nRevisional powers could be exercised only when it is shown that there<br \/>\nis a legal bar against the continuance of the criminal proceedings or<br \/>\nthe framing of charge or the facts as stated in the First Information<br \/>\nReport even if they are taken at the face value and accepted in their<br \/>\nentirety do not constitute the offence for which the accused has been<br \/>\ncharged.  This Court in <a href=\"\/doc\/1735113\/\" id=\"a_5\">Kanti Bhadra Saha &amp; Anr. v. State of West<br \/>\nBengal<\/a> [2000 (1) SCC 722] has held that there is no legal requirement<br \/>\nfor the trial court to write a reasoned or lengthy order for framing<br \/>\nthe charges.\n<\/p>\n<p id=\"p_4\">\tIn the instant case the learned Judge ignored the basic<br \/>\nprinciples which conferred the jurisdiction upon the High Court for<br \/>\nexercise of revisional powers.\tIt was premature for the High Court to<br \/>\nsay that the material placed before the trail court was insufficient<br \/>\nfor framing the charge or that the statement of the prosecutrix herself<br \/>\nwas not sufficient to proceed further against the accused-respondent.\n<\/p>\n<p id=\"p_5\">\tAs the impugned order has been passed against the settled<br \/>\nposition of law, it is unsustainable and is accordingly set aside.  The<br \/>\norder of framing the charge passed by the trial court against the<br \/>\naccused is upheld with directions to it to proceed with the trial of<br \/>\nthe case and dispose of the same on merits in accordance with law.\n<\/p>\n<p id=\"p_6\">\t\t\t\t&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;J.\n<\/p>\n<p id=\"p_7\">\t\t\t\t\t\t(M.B.
