Justice V.GIRI\n\n Dated :21\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">11\/2007\n\n O R D E R\n                            V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No<\/a>. 32763 of 2007\n                     --------------------------\n            Dated this the 21st November, 2007\n\n                       J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner joined the Civil Supplies Department on<\/p>\n<p>31.5.2001 as L.D.Clerk. The           petitioner is  a physically<\/p>\n<p>handicapped person. According to him, his probation has been<\/p>\n<p>declared on 4.10.2004.      But he was denied promotion to the<\/p>\n<p>post of U.D.Clerk because he has not passed the Departmental<\/p>\n<p>Language test.     According to the petitioner, the Government<\/p>\n<p>has issued several orders granting exemption to deaf students<\/p>\n<p>from the study of regional languages.         He makes a reference<\/p>\n<p>to G.O (MS) Rt No.135\/88\/G.Edn dated 1.9.1983.          Petitioner<\/p>\n<p>refers to the provisions under the Persons with        Disabilities<\/p>\n<p>(Equal Opportunities, Protection of Rights and Full Participation)<\/p>\n<p>Act, 1995.\n<\/p>\n<p id=\"p_1\">     2.   Petitioner submits that the Government has power to<\/p>\n<p>grant exemption from acquiring qualification prescribed as<\/p>\n<p>per Rule 10 (aaa) of Part II of the Kerala State and Subordinate<\/p>\n<p>Service Rules, 1958. Petitioner also submits that he is not able<\/p>\n<p>to pass any test in language only because of a severe hearing<\/p>\n<p>impairment on account of which his permanent disability has<\/p>\n<p>W.P ( C) No. 32763 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                2<\/span><\/p>\n<p>been assessed at 90%. He has brought his grievance to the<\/p>\n<p>Government     by   Exhibit-P15   produced    along   with    I.A.<\/p>\n<p>15110\/2007. In my view,the Government should sympathetically<\/p>\n<p>consider the petitioner&#8217;s case highlighted in Exhibit-P15. The<\/p>\n<p>Government should also bear in mind the provisions of Persons<\/p>\n<p>with Disabilities (Equal Opportunities, Protection of Rights and<\/p>\n<p>Full Participation) Act, 1995 which mandates that no person<\/p>\n<p>shall be denied any promotion merely by reason of the disability<\/p>\n<p>as such.\n<\/p>\n<p id=\"p_2\">     After having heard the learned counsel for the petitioner<\/p>\n<p>and the learned Government Pleader, this writ petition is<\/p>\n<p>disposed of directing the 1st respondent to look into Exhibit-P15<\/p>\n<p>after hearing the petitioner or a representative, and take a<\/p>\n<p>decision keeping in mind the provisions of the Disabilities Act,<\/p>\n<p>within two months from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                                               (V.GIRI, JUDGE)<br \/>\nma<\/p>\n<p>W.P ( C) No. 32763 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            2<\/span><\/p>\n<p>                               K.THANKAPPAN,J<\/p>\n<p>                              CRL.A.
