Joseph, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">     The Chairman, Headload Workers&#8217; Welfare Fund Board,<\/p>\n<p>Thrissur is suo motu impleaded as the additional seventh<\/p>\n<p>respondent and the Assistant Labour Officer, Kodungalloor as<\/p>\n<p>additional eighth respondent and the learned Government<\/p>\n<p>Pleader appears for the additional eighth respondent.<\/p>\n<p id=\"p_3\">     2. The prayer in the Writ Petition is to issue a writ of<\/p>\n<p>mandamus directing the first respondent to afford sufficient and<\/p>\n<p>meaningful protection to the petitioner and his workers for<\/p>\n<p>doing all the loading and unloading works connected with his<\/p>\n<p>business throughout the Thrissur District without any threat or<\/p>\n<p>any sort of obstruction from the workers belonging to the<\/p>\n<p>various units of respondent Unions 3 to 6.<\/p>\n<p id=\"p_4\">     3. The case of the petitioner, in brief, is as follows:<\/p>\n<p>     Petitioner is the proprietor of a Distribution Firm engaged<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.3989\/2010 W                 2<\/span><\/p>\n<p>in distribution of napkins, soaps, powder, earbuds, shampoo etc.<\/p>\n<p>of M\/s. Johnson &amp; Johnson, Reckitt Benkicer in Thrissur<\/p>\n<p>District. Petitioner himself and his salesmen and drivers of the<\/p>\n<p>distribution van are carrying on the loading and unloading<\/p>\n<p>works connected with the distribution of the said items to retail<\/p>\n<p>shops throughout Thrissur District. They have been doing it for<\/p>\n<p>the last twenty years without any obstruction from workers<\/p>\n<p>belonging to the Unions 3 to 6. There is obstruction alleged on<\/p>\n<p>13.01.2010.     Petitioner files Ext.P1 complaint to the first<\/p>\n<p>respondent and Ext.P2 before the second respondent.<\/p>\n<p id=\"p_5\">      4. We heard the learned counsel appearing for the parties.<\/p>\n<p>Learned counsel for the additional seventh respondent submits<\/p>\n<p>that there is no authority with the second respondent and the<\/p>\n<p>petitioner may have to approach the additional seventh<\/p>\n<p>respondent. Learned counsel for the petitioner would submit<\/p>\n<p>that the petitioner will approach the additional seventh<\/p>\n<p>respondent representing his grievance. Learned counsel for the<\/p>\n<p>fifth respondent would submit as long as the loading and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.3989\/2010 W                  3<\/span><\/p>\n<p>unloading work is done in light covered delivery vehicles, they<\/p>\n<p>will not obstruct. We record the submission and dispose of the<\/p>\n<p>Writ Petition as follows:\n<\/p>\n<p id=\"p_6\">      In case there is any obstruction from respondents 3 to 6 to<\/p>\n<p>the loading and unloading work in respect of goods carried by<\/p>\n<p>the petitioner in light covered delivery vehicles, the first<\/p>\n<p>respondent will afford protection to the petitioner as against<\/p>\n<p>them. It is open to the petitioner to represent the matter before<\/p>\n<p>the additional eighth respondent regarding his grievance. The<\/p>\n<p>additional eighth respondent will look into the matter under<\/p>\n<p>Section 21 of the Act. The present arrangement will be subject<\/p>\n<p>to the decision as may be taken by the statutory authorities.<\/p>\n<p>Petitioner will produce a copy of this Judgment before the<\/p>\n<p>additional eighth respondent.\n<\/p>\n<p id=\"p_7\">                                                  Sd\/=<br \/>\n                                             K.M.
