(ORAL)\n<\/pre>\n<p id=\"p_1\">             The present revision petition was filed against the order passed<\/p>\n<p>by the Judicial Magistrate Ist Class, Ludhiana whereby complaint preferred<\/p>\n<p>by Rajan Sharma against Kaushal Sharma, proprietor, M\/s Myelin<\/p>\n<p>Laboratories, 9 Golden Plaza Market, Queen&#8217;s Road, Amritsar was<\/p>\n<p>dismissed in default on 31.8.2000. The concerned Magistrate in his order<\/p>\n<p>has recorded that case called several times since morning. None has come<\/p>\n<p>present on behalf of the complainant.        At 3.30 P.M. complaint was<\/p>\n<p>dismissed in default. However, exemption for personal appearance was<\/p>\n<p>granted to the accused.\n<\/p>\n<p id=\"p_1\">             In the present case, accused had been summoned to stand trial.<\/p>\n<p>Dismissal of complaint under <a href=\"\/doc\/466785\/\" id=\"a_1\">Section 256<\/a> Cr.P.C. in summons case amount<\/p>\n<p>to acquittal.   Therefore, the remedy available with the complainant-\n<\/p>\n<p id=\"p_2\"> Crl.Rev.No.364 of 2001                                          [2]<\/p>\n<p>petitioner was to file an application for leave to appeal as envisaged under<\/p>\n<p><a href=\"\/doc\/1856707\/\" id=\"a_1\">Section 378(4)<\/a> Cr.P.C.. The present revision petition is not maintainable.<\/p>\n<p>In the present case, complaint was filed as cheque amounting to Rs.37,475\/-<\/p>\n<p>dated 7.8.1998 had bounced. The case under the <a href=\"\/doc\/1132672\/\" id=\"a_2\">Negotiable Instruments<\/p>\n<p>Act<\/a> fall under summons case as defined under <a href=\"\/doc\/328668\/\" id=\"a_3\">Section 2(w)<\/a> and (x) <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>..<\/p>\n<p>This Court cannot come to the rescue of the petitioner as appropriate<\/p>\n<p>remedy available to the petitioner was to file application for leave to appeal.<\/p>\n<p>Hence, the present revision petition is dismissed being not maintainable.<\/p>\n<p id=\"p_3\">                              ( KANWALJIT SINGH AHLUWALIA )<br \/>\nMarch 3, 2009.
