Justice K.SURENDRA MOHAN\n\n Dated :07\/09\/2009\n\n O R D E R\n         PIUS C.KURIAKOSE &amp; K.SURENDRA MOHAN, JJ.\n                      ------------------------\n                     R.C.R.No.173 OF 2009\n                      ------------------------\n\n             Dated this the 7thday of September, 2009\n\n                              ORDER\n<\/pre>\n<p id=\"p_1\">Pius C.Kuriakose, J.\n<\/p>\n<p id=\"p_1\">      The tenant is in revision and we have heard the submissions<\/p>\n<p>of Sri. A .Geoge Jacob, learned counsel for the revision petitioner<\/p>\n<p>and Sri. M.P.Madhavan Kutty, learned counsel for the respondent.<\/p>\n<p>Even though Sri.George Jacob has addressed us very strenuously<\/p>\n<p>and persuasively on the various grounds raised in this<\/p>\n<p>memorandum of revision assailing order of eviction passed<\/p>\n<p>against the revision petitioner, we are not persuaded to hold<\/p>\n<p>that the order of the Rent Control Court, which was confirmed by<\/p>\n<p>the Rent Control Appellate Authority, is vitiated to the extent of<\/p>\n<p>warranting invocation of the revisional jurisdiction of this court<\/p>\n<p>under Section 20 of Act 2 of 1965. We do not find any illegality,<\/p>\n<p>irregularity or impropriety justifying interference in revision.<\/p>\n<p id=\"p_2\">      2. As his last submission, Sri.George Jacob requested that<\/p>\n<p>atleast one year&#8217;s time be given to the revision petitioner, who is<\/p>\n<p>a barber, for surrendering the premises. This request is very<\/p>\n<p>stiffly opposed by Sri.Madhavan Kutty. However, having regard<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">RCR .No.173\/2009                 2<\/span><\/p>\n<p>to the facts and circumstances of this case, we feel that there is<\/p>\n<p>justification for granting    time to the revision petitioner till<\/p>\n<p>30\/6\/2010 for surrendering the premises subject to certain<\/p>\n<p>conditions.   Accordingly, the RCR is decided      in the following<\/p>\n<p>terms;\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             1). We dismiss the RCR confirming the eviction order<\/p>\n<p>        passed by the Rent Control Court and the Appellate<\/p>\n<p>        Authority.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             2). The Execution Court is directed not to order or<\/p>\n<p>        effect delivery of the petition schedule building in favour<\/p>\n<p>        of the respondent landlord       subject to the following<\/p>\n<p>        conditions;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                     i). The revision petitioner shall file an<\/p>\n<p>                affidavit  before  the      Execution   Court<\/p>\n<p>                undertaking to give peaceful surrender of<\/p>\n<p>                the   petition  schedule   building   to   the<\/p>\n<p>                respondent     landlord   on     or    before<\/p>\n<p>                30\/6\/2010    and   undertaking    further   to<\/p>\n<p>                discharge the entire arrears of rent, which is<\/p>\n<p>                due   in respect of the petition schedule<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">RCR .No.173\/2009                  3<\/span><\/p>\n<p>              building, within one month and also to pay<\/p>\n<p>              occupational charges at the current rate<\/p>\n<p>              rates till actual surrender of the building is<\/p>\n<p>              given to the respondent.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                    ii). Affidavit as directed above shall be<\/p>\n<p>              filed within three weeks from today.
