AGRAWAL, J. :-\n<\/p>\n<p id=\"p_1\">     Special leave granted.\n<\/p>\n<p id=\"p_2\">     C. Muralidhar,  the respondent  herein, was employed as<br \/>\nMotor  Vehicle\tInspector  with\t the  Government  of  Andhra<br \/>\nPradesh. In  1987 a  criminal case  (C.C. No. 8 of 1987) was<br \/>\nfiled against  him wherein he was prosecuted for the offence<br \/>\npunishable under  the <a href=\"\/doc\/1331755\/\" id=\"a_1\">Prevention of Corruption Act<\/a>, 1947 for<br \/>\nholding assets\tdisproportionate to  his  known\t sources  of<br \/>\nincome. Disciplinary proceedings were also initiated against<br \/>\nthe respondent\ton the\tbasis of a charge memo dated January<br \/>\n21, 1988  issued by  the Enquiry Officer under Rule 19(2) of<br \/>\nthe Andhra  Pradesh Civil  Services (Classification, Control<br \/>\nand Appeal)  Rules, 1963.  Some of  the charges\t in the said<br \/>\ncharge memo related to holding of assets disproportionate to<br \/>\nthe known  sources of  income while  some charges related to<br \/>\nhis having  acquired the  assets without  permission of\t the<br \/>\ndepartment in  violation of  Andhra Pradesh  Civil  Services<br \/>\n(Conduct) Rules, 1964. The respondent filed R.P. No. 3714 of<br \/>\n1989  before  the  Andhra  Pradesh  Administrative  Tribunal<br \/>\n(hereinafter referred  `the Tribunal&#8217;)\twherein he  assailed<br \/>\nthe validity  of the  charge memo  dated January 21, 1988 on<br \/>\nthe ground that in view of the pendency of the criminal case<br \/>\nwherein he  was being prosecuted on the charge of possessing<br \/>\nassets disproportionate\t to the known sources of income, the<br \/>\ninitiation of  disciplinary proceedings\t for the same charge<br \/>\nwas illegal. During the pendency of the said petition before<br \/>\nthe Tribunal  the Special Judge of SPE &amp; ACB cases, Nellore,<br \/>\nby  his\t  judgment  dated  April  28,  1994,  acquitted\t the<br \/>\nrespondent of  the charge  under <a href=\"\/doc\/1229833\/\" id=\"a_1\">section  5(1)(e)<\/a> read\twith<br \/>\n5(2) of\t <a href=\"\/doc\/1331755\/\" id=\"a_2\">Prevention of\tCorruption Act<\/a> for possessing assets<br \/>\ndisproportionate  to   the  known   source  of\tincome.\t The<br \/>\naforesaid decision  in the  criminal case was not brought to<br \/>\nthe notice  of the  Tribunal when  R.P. No. 3714 of 1989 was<br \/>\ntaken up. The Tribunal, while disposing of the said petition<br \/>\non March  1, 1995, observed that further information was not<br \/>\nmade available\tto the\tTribunal regarding the criminal case<br \/>\nand directed  that if  the criminal  case has  already\tbeen<br \/>\ndisposed of  and the judgment has become final so far as the<br \/>\nissue  pertaining   to\tthe   disproportionate\t assets\t  is<br \/>\nconcerned, the\tdepartmental enquiry, cannot be held for the<br \/>\nvery same  charge of  possessing assets\t disproportionate to<br \/>\nthe known  sources of  income. The Tribunal was, however, of<br \/>\nthe view that other charges in departmental proceedings that<br \/>\nthe respondent acquired the assets without permission of the<br \/>\ndepartment are\tnot part  of the charge in the criminal case<br \/>\nbefore\tthe  Special  Judge  and  the  Tribunal,  therefore,<br \/>\ndirected that it would be open to the authorities to proceed<br \/>\nwith the  charges regarding the acquisition and disposing of<br \/>\nproperties without  permission\tof  the\t government  or\t the<br \/>\ndepartment or  of other\t delinquencies as required under the<br \/>\nGovernment Servant&#8217;s Conduct Rules. After taking note of the<br \/>\njudgment of  Special Judge  dated  April  28,  1994  in\t the<br \/>\ncriminal case  filed against  the respondent, the Government<br \/>\nof Andhra  Pradesh passed  an order,  G.O.Ms. No.  74  dated<br \/>\nApril 24, 1995, whereby it was decided :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;The   government\t after\t careful<br \/>\n     examination  of  the  matter,  have<br \/>\n     decided that  further action in the<br \/>\n     criminal  case   of  allegation  of<br \/>\n     disproportionate\tassets\t against<br \/>\n     Sri. C.  Muralidhar, Motor\t Vehicle<br \/>\n     Inspector, be dropped, since he was<br \/>\n     acquitted\tby  the\t ACB  Court  and<br \/>\n     found    not    guilty    of    the<br \/>\n     allegation.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">     In the said order there is no reference to the judgment<br \/>\nof the\tTribunal dated\tMarch 1,  1995 in  R.P. No.  3714 of<br \/>\n1989.\n<\/p>\n<p id=\"p_4\">     On\t February   20,\t 1996\ta  fresh  charge  memo\t(No.<br \/>\n50236\/XI\/83) was  issued to  the respondent under Rule 20(4)<br \/>\nof  the\t  Andhra  Pradesh  Civil  Services  (Classification,<br \/>\nConduct and  Appeal)  Rules,  1991.  The  said\tcharge\tmemo<br \/>\nrelated to  violation of  the Andhra  Pradesh Civil Services<br \/>\n(Conduct)  Rules,   1964  for  acquiring  and  disposing  of<br \/>\nproperties without  informing and taking permission from the<br \/>\ngovernment  for\t the  same.  The  respondent  filed  another<br \/>\npetition (O.  A. No.  2250  of\t1996)  before  the  Tribunal<br \/>\nchallenging the\t validity of  the said charge memo issued on<br \/>\nFebruary 20, 1996. The said petition has been allowed by the<br \/>\nTribunal by  the impugned  judgment dated  June 4, 1996. The<br \/>\nTribunal has held that in view of G.O.Ms. No. 74 dated April<br \/>\n24 24,\t1995  dropping\tthe  disciplinary  action  initiated<br \/>\nagainst the  respondent, it   was  not open  to\t subordinate<br \/>\nauthority to  initiate disciplinary action by issuing charge<br \/>\nmemo dated  February 20,  1996. The Tribunal has, therefore,<br \/>\nset aside the said charge memo. Hence this appeal.\n<\/p>\n<p id=\"p_5\">     We have  heard Shri  K Ramkumar,  the  learned  counsel<br \/>\nappearing for  the appellants  and Shri L. Nageswar Rao; the<br \/>\nlearned counsel for the respondent.\n<\/p>\n<p id=\"p_6\">     The judgment  of the  Tribunal dated  March 1,  1995 in<br \/>\nR.P. No.  3714 of  1989 was  confined to charges relating to<br \/>\npossessing  assets  disproportionate  the  known  source  of<br \/>\nincome wherein\tthe  Tribunal  had  held  that\tdisciplinary<br \/>\nproceedings on\tthe said  charges could\t not be held. In the<br \/>\nsaid judgment  the Tribunal had clearly indicated that other<br \/>\ncharges in  the\t disciplinary  proceedings  viz.,  that\t the<br \/>\nrespondent had\tacquired assets\t without permission  of\t the<br \/>\ngovernment or department, were not part of the charge before<br \/>\nthe Special  Judge of  SPE and\tACB cases and it was open to<br \/>\nthe  authorities  to  proceed  with  the  charges  regarding<br \/>\nacquisition or disposing of properties without permission of<br \/>\nthe government\tor the\tdepartment or of other delinquencies<br \/>\nas required  under the\tGovernment Servants&#8217;  Conduct Rules.<br \/>\nThough the said judgment of the Tribunal dated March 1, 1995<br \/>\nhas not\t been referred to in the order, G.O.Ms. No. 74 dated<br \/>\nApril 24,  1995 passed\tby the Government but the said order<br \/>\nis also\t confined in  its application  to  the\tdisciplinary<br \/>\nproceedings  in\t  so  far  as  they  related  to  charge  of<br \/>\npossessing  assets  disproportionate  to  known\t sources  of<br \/>\nincome because\tin the said order reference has been made to<br \/>\nthe judgment  of the  Special Judge  dated  April  28,\t1994<br \/>\nwhereby the  respondent was  acquitted of  the charge  under<br \/>\n<a href=\"\/doc\/1229833\/\" id=\"a_3\">section 5(1)(e)<\/a>\t read with <a href=\"\/doc\/1420677\/\" id=\"a_4\">section 5(2)<\/a> of the Prevention of<br \/>\nCorruption Prevention  Act. The direction regarding dropping<br \/>\nof proceedings\tin  the\t order,\t G.O.Ms.  No.  74,  1994  as<br \/>\ncontaining  the\t  direction  that  disciplinary\t proceedings<br \/>\nagainst the respondent in respect of other charges regarding<br \/>\nacquisition and\t disposing of  properties without permission<br \/>\nto the\tgovernment or  the department  as required under the<br \/>\nAndhra Pradesh Civil Services Rules, 1964 were also directed<br \/>\nto be  dropped. In  the circumstances  we do  not  find\t any<br \/>\ninfirmity in  the charge memo dated February 20, 1996 issued<br \/>\nin respect  of charge  involving violation of Andhra Pradesh<br \/>\nCivil  Service\t (Conduct)  Rules,   1964  in  acquiring  or<br \/>\ndisposing properties without permission of the government or<br \/>\nthe department.\n<\/p>\n<p id=\"p_7\">     The  appeal   is,\ttherefore,   allowed,  the  impugned<br \/>\njudgment of the Tribunal dated June 4, 1996 is set aside and<br \/>\nO.A. No.  2250 of 1996 filed by the respondent is dismissed.<br \/>\nThis matter  has been  pending since  long. The disciplinary<br \/>\nauthority  is\tdirected  to   conclude\t  the\tdisciplinary<br \/>\nproceedings initiated  on the basis of the charge memo dated<br \/>\nFebruary 20,  1996 expeditiously, preferably within a period<br \/>\nof one year, No. order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Govt.
